Abstract

ABSTRAK Penelitian ini dilatarbelakangi oleh masih rendahnya pemahaman masyarakat mengenai pentingnya administrasi dan legalitas tanah wakaf yang berpotensi menimbulkan konflik wakaf keluarga. Banyak masyarakat masih melakukan wakaf secara lisan tanpa pencatatan resmi sehingga menyebabkan ketidakjelasan status hukum tanah wakaf. Penelitian ini bertujuan untuk mengetahui implementasi penyuluhan tanah wakaf dalam rangka menghindari konflik wakaf keluarga oleh Badan Wakaf Indonesia Kabupaten Pesisir Barat perspektif hukum Islam, serta mengetahui faktor pendukung dan penghambat dalam pelaksanaannya. Penelitian ini menggunakan pendekatan kualitatif dengan jenis penelitian lapangan (field research). Data diperoleh melalui observasi, wawancara, dan dokumentasi. Sumber data primer diperoleh dari pihak BWI, Kantor Urusan Agama (KUA) Kecamatan Way Krui, tokoh masyarakat, dan masyarakat Desa Banjar Agung. Sedangkan data sekunder diperoleh dari buku, jurnal, dokumen, dan peraturan perundang-undangan terkait wakaf. Analisis data dilakukan secara deskriptif kualitatif dengan pola berpikir induktif. Hasil penelitian menunjukkan bahwa implementasi penyuluhan tanah wakaf oleh BWI Kabupaten Pesisir Barat bersama KUA Kecamatan Way Krui dilakukan melalui sosialisasi, pengajian, pelayanan langsung, dan pendampingan administrasi wakaf. Penyuluhan tersebut memberikan dampak positif dalam meningkatkan pemahaman masyarakat mengenai pentingnya Akta Ikrar Wakaf (AIW), sertifikasi tanah wakaf, dan legalitas wakaf guna menghindari konflik keluarga. Dalam perspektif hukum Islam, penyuluhan tanah wakaf sejalan dengan prinsip menjaga harta (hifz al-mal) dalam maqashid syariah. Faktor pendukung pelaksanaan penyuluhan meliputi kerja sama antara BWI, KUA, tokoh agama, dan pemerintah desa, sedangkan faktor penghambatnya adalah rendahnya pemahaman masyarakat, masih kuatnya budaya wakaf secara lisan, serta kurangnya kesadaran masyarakat terhadap pentingnya sertifikasi tanah wakaf. ABSTRACT This research was motivated by the low level of public understanding regarding the importance of waqf land administration and legality, which has the potential to cause family waqf conflicts. Many people still perform waqf verbally without official registration, resulting in the unclear legal status of waqf land. This study aims to examine the implementation of waqf land counseling in preventing family waqf conflicts conducted by the Badan Wakaf Indonesia of West Pesisir Regency from the perspective of Islamic law, as well as to identify the supporting and inhibiting factors in its implementation. This study employed a qualitative approach using field research methods. Data were collected through observation, interviews, and documentation. Primary data were obtained from BWI, the Office of Religious Affairs (KUA) of Way Krui District, community leaders, and the people of Banjar Agung Village. Meanwhile, secondary data were obtained from books, journals, documents, and laws and regulations related to waqf. The data were analyzed descriptively using a qualitative approach with an inductive reasoning method. The results of the study indicate that the implementation of waqf land counseling by BWI of West Pesisir Regency in collaboration with the KUA of Way Krui District was carried out through socialization activities, religious gatherings, direct services, and assistance in waqf administration. The counseling had a positive impact on increasing public understanding regarding the importance of the Waqf Pledge Deed (AIW), waqf land certification, and waqf legality in order to prevent family conflicts. From the perspective of Islamic law, waqf land counseling is in line with the principle of protecting property (hifz al-mal) in maqashid sharia. Supporting factors in the implementation of the counseling include cooperation between BWI, KUA, religious leaders, and the village government, while the inhibiting factors include the low level of public understanding, the persistence of verbal waqf culture, and the lack of public awareness regarding the importance of waqf land certification.
