Abstract

ABSTRAK Perkembangan jasa nail art extension sebagai bagian dari perawatan dan penunjang penampilan memberikan kemudahan bagi konsumen untuk memperoleh kuku yang lebih panjang, rapi, dan menarik. Namun, di balik manfaat tersebut terdapat risiko yang dapat dialami konsumen, seperti iritasi kulit, rasa panas, gatal, kemerahan, serta kondisi kuku alami yang menjadi tipis dan mudah patah setelah pemasangan. Permasalahan tersebut ditemukan pada praktik pemasangan nail art extension di Nail art Baby Moys Bandar Lampung, di mana informasi mengenai risiko penggunaan belum disampaikan secara menyeluruh kepada konsumen. Kondisi ini menimbulkan persoalan mengenai pemenuhan hak konsumen atas keamanan, keselamatan, serta informasi yang benar, jelas, dan jujur. Oleh karena itu, penelitian ini bertujuan untuk mengetahui praktik pemasangan nail art extension, bentuk perlindungan terhadap konsumen yang mengalami iritasi kulit dan kuku, serta tinjauannya berdasarkan hukum Islam dan hukum positif. Penelitian ini menggunakan jenis penelitian lapangan (field research) dengan pendekatan yuridis empiris. Data diperoleh melalui wawancara dengan pemilik jasa nail art extension dan konsumen yang mengalami keluhan setelah menggunakan jasa tersebut, serta melalui dokumentasi dan studi kepustakaan. Data dianalisis secara kualitatif dengan menghubungkan temuan di lapangan dengan prinsip-prinsip hukum Islam dan ketentuan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Hasil penelitian menunjukkan bahwa praktik pemasangan nail art extension di Nail art Baby Moys dilakukan berdasarkan permintaan konsumen, tetapi informasi mengenai risiko iritasi, reaksi alergi, dan kerusakan kuku belum diberikan secara menyeluruh. Penanganan terhadap konsumen yang mengalami keluhan dilakukan melalui konsultasi, pelepasan extension, dan pemberian saran perawatan, tetapi belum terdapat mekanisme kompensasi dan standar penyelesaian kerugian yang jelas. Berdasarkan hukum Islam, praktik tersebut perlu memperhatikan prinsip kemaslahatan, kejujuran, keterbukaan, dan larangan menimbulkan kemudaratan, termasuk berkaitan dengan unsur gharar dan tadlis. Sementara berdasarkan hukum positif, perlindungan konsumen berkaitan dengan hak atas keamanan, keselamatan, dan informasi yang benar, jelas, serta jujur sebagaimana diatur dalam Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. ABSTRACT The development of nail art extension services as a form of beauty treatment and personal appearance enhancement provides consumers with the convenience of having longer, neat, and attractive nails. However, behind these benefits, consumers may face several risks, including skin irritation, burning sensations, itching, redness, and weakened or brittle natural nails after the application. Such issues were found in the practice of nail art extension at Nail art baby moys Bandar Lampung, where information regarding the potential risks of the service has not been fully communicated to consumers. This condition raises concerns regarding the fulfillment of consumers’ rights to safety, security, and accurate, clear, and honest information. Therefore, this research aims to examine the practice of nail art extension application, the forms of protection provided to consumers experiencing skin and nail irritation, and its analysis from the perspectives of Islamic law and positive law. This research employs field research with a juridical-empirical approach. Data were obtained through interviews with the nail art extension service provider and consumers who experienced complaints after using the service, as well as through documentation and literature studies. The data were analyzed qualitatively by relating the findings in the field to the principles of Islamic law and the provisions of Law Number 8 of 1999 concerning Consumer Protection. The results show that the application of nail art extension at Nail art baby moys is carried out according to consumers’ requests; however, information regarding the risks of irritation, allergic reactions, and nail damage has not been fully provided. Complaints from consumers are handled through consultation, removal of the extension, and aftercare advice, but there is no clear compensation mechanism or standard procedure for resolving consumer losses. From the perspective of Islamic law, the practice should uphold the principles of public benefit (maslahah), honesty, transparency, and the prohibition of causing harm, including issues related to gharar and tadlis. From the perspective of positive law, consumer protection concerns the rights to safety, security, and accurate, clear, and honest information as regulated under Law Number 8 of 1999 concerning Consumer Protection.
