Abstract

ABSTRAK Penelitian ini bertujuan untuk menganalisis pengimplementasian kedisiplinan Pegawai Negeri Sipil (PNS) berdasarkan Pasal 1 ayat (4) Peraturan Pemerintah Nomor 94 Tahun 2021 di Kantor Kecamatan Kalianda Kabupaten Lampung Selatan serta meninjau fenomena tersebut melalui perspektif Fiqh Siyasah. Disiplin aparatur pemerintah merupakan pilar utama dalam menyelenggarakan tata kelola pemerintahan yang baik (good governance) demi tercapainya kemaslahatan publik (maslahah ammah). Metode penelitian yang digunakan adalah metode kualitatif deskriptif dengan pendekatan studi lapangan (field research). Data primer diperoleh melalui wawancara mendalam dengan Camat, Sekretaris Kecamatan, serta staf pegawai negeri sipil di lingkungan Kantor Kecamatan Kalianda, sedangkan data sekunder dikumpulkan melalui studi dokumentasi peraturan perundang-undangan dan literatur fiqh siyasah. Hasil penelitian menunjukkan bahwa implementasi Pasal 1 ayat (4) PP No. 94 Tahun 2021 tentang kesanggupan menaati kewajiban dan menghindari larangan, khususnya terkait pematuhan jam kerja, telah diupayakan secara maksimal oleh Camat selaku pimpinan institusi melalui pengawasan melekat, penerapan sanksi administratif, dan pembinaan berkala. Namun, di lapangan masih ditemukan hambatan berupa fluktuasi kedisiplinan oknum pegawai dan kendala teknis operasional. Dalam perspektif Fiqh Siyasah, pengimplementasian regulasi kedisiplinan ini berkolerasi erat dengan konsep Siyasah Dusturiyyah (politik perundang-undangan) dan Siyasah Tanfidziyyah (politik pelaksanaan undang-undang), di mana penegakan amanah oleh ulil amri wajib ditaati oleh bawahan demi menegakkan sistem administrasi negara yang bersih, bertanggung jawab, dan berorientasi pada kemaslahatan umat. ABSTRACT This research aims to analyze the implementation of Civil Servants' (PNS) discipline based on Article 1 Paragraph (4) of Government Regulation Number 94 of 2021 at the Kalianda District Office, South Lampung Regency, and to review this phenomenon through the perspective of Fiqh Siyasah. The discipline of government apparatuses is a primary pillar in organizing good governance to achieve public interest (maslahah ammah). The research method used is descriptive qualitative with a field research approach. Primary data were obtained through in-depth interviews with the District Head (Camat), District Secretary, and civil servant staff within the Kalianda District Office, while secondary data were collected through documentary studies of statutory regulations and fiqh siyasah literature. The results indicate that the implementation of Article 1 Paragraph (4) of Government Regulation No. 94 of 2021 regarding the commitment to comply with obligations and avoid prohibitions—specifically related to working hours compliance—has been maximally pursued by the District Head as the institutional leader through inherent supervision, implementation of administrative sanctions, and regular coaching. However, obstacles such as fluctuations in the discipline of certain personnel and technical operational challenges are still found in the field. In the perspective of Fiqh Siyasah, the implementation of this disciplinary regulation is closely correlated with the concepts of Siyasah Dusturiyyah (constitutional politics) and Siyasah Tanfidziyyah (executive/administrative politics), where the enforcement of mandate (amanah) by the authorities (ulil amri) must be obeyed by subordinates to establish a state administration system that is clean, accountable, and oriented toward the welfare of the community (ummah).
