Abstract

ABSTRAK Jasa penggilingan kopi merupakan praktik yang umum dilakukan oleh masyarakat Desa Paya, Kecamatan Padang Cermin, Kabupaten Pesawaran. Hubungan ini terjadi antara petani sebagai pemilik kopi dan penyedia jasa penggilingan sebagai pihak yang mengolah kopi mentah menjadi kopi siap jual. Dalam perspektif Hukum Ekonomi Syariah, praktik tersebut termasuk dalam akad ijarah, yaitu akad pemanfaatan jasa dengan imbalan tertentu yang disepakati kedua belah pihak. Dalam akad ijarah, terdapat prinsip penting seperti kerelaan (taradhi), kejelasan objek akad, kejelasan upah, serta terhindar dari unsur gharar, maisir. Penelitian ini bertujuan untuk menganalisis praktik penentuan upah penggilingan kopi mentah di Desa Paya serta tinjauannya dalam Hukum Ekonomi Syariah. Metode penelitian yang digunakan adalah kualitatif dengan pendekatan empiris dan normatif melalui observasi, wawancara, dan studi literatur. Hasil penelitian menunjukkan bahwa penentuan upah masih didasarkan pada kebiasaan masyarakat („urf) dengan sistem per kilogram. Namun dalam praktiknya, masih ditemukan permasalahan berupa pemilik jasa penggilingan yang tetap mengambil sebagian kopi meskipun upah telah dibayar dalam bentuk uang. Hal ini menunjukkan adanya ketidakjelasan dan kurangnya transparansi dalam akad. Berdasarkan hukum ekonomi syariah, praktik tersebut belum sepenuhnya sesuai dengan prinsip ijarah, khususnya dalam aspek kejelasan upah dan kerelaan kedua belah pihak (taradhi), sehingga perlu adanya kesepakatan yang lebih jelas dan transparan agar sesuai dengan prinsip syariah. ABSTRACT Coffee grinding services are a common practice carried out by the people of Paya Village, Padang Cermin District, Pesawaran Regency. This relationship occurs between farmers as coffee owners and grinding service providers as parties who process raw coffee into ready-to-sell coffee. In the perspective of Sharia Economic Law, the practice is included in the ijarah contract, which is a contract for the use of services with certain rewards agreed upon by both parties. In the ijarah contract, there are important principles such as willingness (taradhi), clarity of the object of the contract, clarity of wages, and avoidance of elements of gharar, maisir. This study aims to analyze the practice of determining raw coffee grinding wages in Paya Village as well as its review in Sharia Economic Law. The research method used is qualitative with an empirical and normative approach through observation, interviews, and literature studies. The results of the study show that the determination of wages is still based on people's habits ('urf) with a per kilogram system. However, in practice, there are still problems in the form of milling service owners who continue to take part of the coffee even though the wages have been paid in the form of money. This shows the lack of clarity and lack of transparency in the contract. Based on sharia economic law, the practice is not fully in accordance with the principle of ijarah, especially in the aspect of clarity of wages and the willingness of both parties (taradhi), so there needs to be a clearer and more transparent agreement in accordance with sharia principles.
