Abstract

ABSTRAK ANALISIS PRINSIP KESEIMBANGAN DALAM KONSEP KAFĀ’AH PERSPEKTIF MAQĀṢID AL-SHARĪ`AH (TELAAH TERHADAP PEMIKIRAN JASSER AUDA) Oleh : Tata Cahwiyadi (2274130014) Konsep kafā’ah dalam pernikahan Islam merupakan salah satu prinsip penting dalam menjaga keharmonisan dan keseimbangan rumah tangga. Namun, dalam praktiknya, konsep ini sering dipahami secara sempit hanya sebatas kesetaraan status sosial dan ekonomi, sehingga menimbulkan problematika ketika dihadapkan dengan realitas masyarakat yang multikultural dan kompleks. Penelitian ini bertujuan untuk menganalisis prinsip keseimbangan dalam konsep kafā’ah ditinjau dari perspektif maqāṣid al-sharī‘ah, serta menelaah pemikiran Jasser Auda dalam merekonstruksi konsep tersebut agar lebih relevan dengan konteks kekinian. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi pustaka (library research), melalui telaah terhadap karya-karya Jasser Auda serta literatur yang relevan. Hasil penelitian menunjukkan bahwa prinsip keseimbangan dalam kafā’ah dapat dimaknai secara lebih luas, yaitu sebagai upaya menghadirkan keadilan, kemaslahatan, dan harmoni dalam rumah tangga, sebagaimana diuraikan dalam pendekatan sistemik maqāṣid al-sharī‘ah Jasser Auda. Penekanan pada kebebasan beragama, keadilan sosial, dan perlindungan hak keluarga menjadi dasar reinterpretasi terhadap kafā’ah. Penelitian ini menemukan bahwa prinsip keseimbangan dalam konsep kafā’ah mencakup dimensi agama, moral, dan sosial yang bertujuan menjaga kesetaraan yang adil antara calon pasangan. Perspektif maqāṣid al-sharī‘ah Jasser Auda memberikan pemahaman bahwa keseimbangan bukan hanya soal status sosial, tetapi juga mencakup perlindungan terhadap hak-hak dasar manusia seperti agama, akal, dan keluarga (ḥifẓ al-dīn, al-‘aql, dan al-usrah), sehingga rumah tangga dapat menjadi ruang bagi kemaslahatan dan keberlanjutan sosial. Pemikiran Jasser Auda dalam merekonstruksi kafā’ah berlandaskan pada pendekatan sistemik maqāṣid al-sharī‘ah yang bersifat dinamis dan kontekstual. Melalui enam fitur sistem seperti keterbukaan (openness), hierarki terintegrasi, dan multi-dimensionalitas, Auda menggeser pemahaman kafā’ah dari yang kaku menjadi responsif terhadap perubahan sosial. Reinterpretasi ini memungkinkan kafā’ah diterapkan secara relevan dengan tetap berpegang pada nilai-nilai maqāṣid, tanpa mengabaikan prinsip dasar agama dalam pernikahan. Kesimpulannya, pembaruan konsep kafā’ah berbasis maqāṣid al-sharī‘ah dapat menjadi solusi normatif yang kontekstual dalam merespons tantangan pernikahan kontemporer. Penelitian ini merekomendasikan pentingnya pendalaman lebih lanjut terhadap dimensi praktis dari prinsip keseimbangan dalam kafā’ah, khususnya dalam kebijakan pernikahan berbasis maqāṣid. ABSTRACT An Analysis of the Principle of Balance in the Concept of Kafā’ah from the Perspective of Maqāṣid al-Sharī‘ah A Study of Jasser Auda’s Thought The concept of kafā’ah in Islamic marriage is one of the key principles in maintaining harmony and balance within the household. However, in practice, this concept is often narrowly understood as limited to social and economic status equality, which leads to problems when confronted with the realities of a multicultural and complex society. This study aimed to analyze the principle of balance within the concept of kafā’ah from the perspective of maqāṣid al-sharī‘ah, and to examine Jasser Auda’s thoughts in reconstructing the concept to make it more relevant to the present-day context. This research employed a qualitative approach using the library research method, through the review of Jasser Auda’s works and other relevant literature. The findings revealed that the principle of balance in kafā’ah can be interpreted more broadly—as an effort to bring about justice, public benefit (maṣlaḥah), and harmony within the household, as outlined in Jasser Auda’s systemic approach to maqāṣid al-sharī‘ah. Emphasis on religious freedom, social justice, and the protection of family rights served as the foundation for reinterpretation of kafā’ah. The study found that the principle of balance in the concept of kafā’ah includes religious, moral, and social dimensions aimed at ensuring fair equality between prospective spouses. Jasser Auda’s maqāṣid al-sharī‘ah perspective provided the understanding that balance is not only about social status, but also encompasses the protection of fundamental human rights such as religion, intellect, and family (ḥifẓ al-dīn, al-‘aql, and al-usrah), so that the household may serve as a space for public benefit and social sustainability. Jasser Auda’s reconstruction of kafā’ah is grounded in a systemic maqāṣid al-sharī‘ah approach that is dynamic and contextual. Through six system features such as openness, integrated hierarchy, and multidimensionality, Auda shifted the understanding of kafā’ah from a rigid framework to one that is responsive to social change. This reinterpretation enables kafā’ah to be applied in a way that remains relevant while upholding the values of maqāṣid, without neglecting the core religious principles of marriage. In conclusion, the renewal of the kafā’ah concept based on maqāṣid alsharī‘ah can serve as a normative and contextual solution in addressing the challenges of contemporary marriage. This study recommends further exploration of the practical dimensions of the balance principle within kafā’ah, particularly in the development of maqāṣid-based marriage policies. .
