Abstract

ABSTRAK Ngasag merupakan tradisi mengambil sisa hasil panen di lahan pertanian dan masih bertahan hingga saat ini di Kabupaten Lampung Selatan. Ngasag umumnya dilakukan pada tanaman singkong, padi, dan jagung. Sebagian masyarakat sebelum melakukan ngasag meminta izin terlebih dahulu kepada pemilik lahan pertanian, sedangkan sebagian lainnya tidak meminta izin karena menganggapnya sebagai kebiasaan yang lumrah dan telah berlangsung lama. Tujuan penelitian ini untuk menganalisis eksistensi dan praktik tradisi ngasag di Kabupaten Lampung Selatan, dan untuk menganalisis Hukum Ekonomi Syariah terhadap tradisi ngasag di kabupaten tersebut. Penelitian ini merupakan penelitian lapangan dengan metode kualitatif. Data penelitian diperoleh dari data primer berupa hasil observasi, wawancara, dan dokumentasi. Data sekunder berupa buku, jurnal, dan literatur terkait. Hasil penelitian menunjukkan bahwa tradisi ngasag di Kabupaten Lampung Selatan masih eksis dan dipraktikkan oleh sebagian masyarakat sebagai kegiatan mengambil sisa hasil panen di lahan milik orang lain. Tradisi tersebut berfungsi sebagai warisan budaya dan membantu masyarakat berpenghasilan rendah dalam memenuhi kebutuhan hidup. Berdasarkan analisis Hukum Ekonomi Syariah, tradisi ngasag termasuk dalam kategori 'urf fi'liy dan 'urf shahih karena telah berlangsung secara turun-temurun, diterima oleh masyarakat, serta mengandung kemaslahatan. Dari aspek al-milkiyah, tradisi ngasag dibenarkan karena objek yang diambil merupakan sisa hasil panen yang telah ditinggalkan dan dilakukan atas dasar kerelaan pemilik lahan, sehingga tidak termasuk perbuatan mengambil harta secara batil. Selain itu, tradisi ngasag selaras dengan Pasal 17, 18, dan 19 dalam KHES karena mencerminkan asas ijtima'iyah, asas manfaat, serta tidak bertentangan dengan ketentuan mengenai cara memperoleh harta dan sifat kepemilikan. ABSTRACT Ngasag is a traditional practice of collecting leftover agricultural produce from farmlands and has continued to exist in South Lampung Regency to the present day. This practice is commonly carried out on cassava, rice, and corn fields. Before engaging in ngasag, some community members seek permission from the landowners, while others do not, as they consider it a common and long-established custom within the local community. This study aims to look into the existence and practices of the ngasag tradition in South Lampung Regency, and to examine the tradition from the perspective of Islamic Economic Law. This study employs a qualitative field research approach. The primary data were obtained through observation, interviews, and documentation, while the secondary data were collected from books, academic journals, and related literature. The findings of this study indicate that the ngasag tradition in South Lampung Regency continues to exist and is still practiced by a segment of the local community as the practice of collecting leftover crops from other people's agricultural land. This tradition serves not only as a cultural heritage but also as a means of supporting low-income communities in meeting their daily needs. From the perspective of Islamic Economic Law, the ngasag tradition falls under the categories of 'urf fi'liy and 'urf shahih, as it has been passed down from generation to generation, is widely accepted by the community, does not contradict Islamic law, and promotes public welfare (maslahah). From the perspective of al-milkiyah (ownership rights), the practice of ngasag is considered permissible because the objects collected are abandoned remnants of harvests, and the practice is carried out based on the willingness and consent of the landowners. Therefore, it does not constitute an unlawful appropriation of another person's property. The ngasag tradition is in accordance with Articles 17, 18, and 19 of the Compilation of Sharia Economic Law (KHES), as it embodies the principles of ijtima'iyah, benefit, while remaining consistent with the provisions governing the lawful acquisition of property and the nature of ownership rights.
