Abstract
ABSTRAK Penelitian ini dilatarbelakangi oleh fenomena pasangan suami istri yang masih hidup serumah setelah terjadinya talak bā’in kubrā di masyarakat Kelurahan Way Urang Kalianda. Secara normatif, talak bā’in kubrā memutus hubungan perkawinan secara sempurna sehingga mantan suami dan istri kembali berstatus bukan mahram. Namun, realitas sosial menunjukkan masih adanya praktik tinggal bersama dengan berbagai alasan. Rumusan masalah dalam penelitian ini adalah bagaimana praktik hidup serumah setelah talak bā’in kubrā berlangsung di masyarakat Kelurahan Way Urang Kalianda dan bagaimana pandangan hukum Islam terhadap hidup serumah setelah talak bā’in kubrā dalam perspektif Saad Al-Żarī‘ah . Penelitian ini merupakan penelitian lapangan (field research) dengan pendekatan kualitatif. Data diperoleh melalui wawancara mendalam terhadap tiga pasangan mantan suami istri, observasi, dan dokumentasi pendukung yang berkaitan dengan status perceraian dan kondisi sosial informan. Teknik analisis data menggunakan reduksi data, penyajian data, dan penarikan kesimpulan. Hasil penelitian menunjukkan bahwa praktik hidup serumah pasca talak bā’in kubra masih terjadi dan dipengaruhi oleh faktor ekonomi, kepentingan anak, keterbatasan tempat tinggal, dan tekanan sosial. Dalam perspektif Saad Al-Żarī‘ah, praktik tersebut berpotensi menimbulkan mafsadat seperti kaburnya batas hubungan non-mahram, potensi khalwat, serta fitnah sosial sehingga secara prinsip perlu dibatasi dan dihindari kecuali dalam kondisi darurat yang bersifat sementara dengan pemisahan yang ketat. ABSTRACT This study is conducted based on the phenomenon of divorced couples continuing to live together after the pronouncement of ṭalāq bā’in kubrā in the community of Way Urang Village, Kalianda. Normatively, ṭalāq bā’in kubrā completely dissolves the marital relationship, thereby restoring the former husband and wife to the status of non-mahram individuals. Nevertheless, social realities indicate that cohabitation after divorce still occurs for various reasons. The research questions addressed in this study are: how the practice of cohabitation after ṭalāq bā’in kubrā is carried out within the community of Way Urang Village, Kalianda, and how Islamic law views such cohabitation from the perspective of Sadd al-Dharī‘ah?. This study involved field research employing a qualitative approach. Data were collected through in-depth interviews with three divorced couples, observations, and documentation of divorce decisions. The data analysis techniques covered data reduction, data presentation, and conclusion drawing. The findings reveal that the practice of cohabitation after ṭalāq bā’in kubrā continues to occur and is influenced by economic factors, children’s interests, limited housing availability, and social pressure. From the perspective of Sadd al-Żarī‘ah, such practices have the potential to generate mafsadah (harm), including the blurring of boundaries between non-mahram individuals, the possibility of khalwah (seclusion), and negative social perceptions. Therefore, cohabitation after ṭalāq bā’in kubrā should generally be avoided except in temporary emergency situations accompanied by strict separation measures.
