Abstract

ABSTRAK Pelaksanaan Pemungutan Suara Ulang (PSU) di Kabupaten Pesawaran berdasarkan Putusan Mahkamah Konstitusi Nomor 20/PHPU.BUP-XXIII/2025 menuntut Badan Pengawas Pemilihan Umum (Bawaslu) Provinsi Lampung melaksanakan pengawasan secara optimal pada setiap tahapan penyelenggaraan. Kondisi tersebut menimbulkan permasalahan mengenai bagaimana pelaksanaan pengawasan yang dilakukan Bawaslu Provinsi Lampung pada tahap persiapan, kampanye, pelaksanaan, pemungutan dan penghitungan suara, hingga penetapan hasil PSU, serta bagaimana pemenuhan prinsip Al-Amanah dan Al- 'Adalah dalam kinerja pengawasan tersebut ditinjau dari perspektif Siyasah Tanfidziyyah. Penelitian ini merupakan penelitian lapangan (field research) dengan pendekatan kualitatif deskriptif. Data primer diperoleh melalui wawancara dengan Bawaslu Provinsi Lampung dan pihak terkait, sedangkan data sekunder diperoleh dari Putusan Mahkamah Konstitusi Nomor 20/PHPU.BUP-XXIII/2025, peraturan perundang-undangan, keputusan Komisi Pemilihan Umum, buku, jurnal, serta dokumen pendukung lainnya. Teknik pengumpulan data dilakukan melalui observasi, wawancara, dan dokumentasi, sedangkan analisis data menggunakan metode kualitatif dengan pola pikir induktif. Hasil penelitian menunjukkan bahwa Bawaslu Provinsi Lampung telah melaksanakan pengawasan PSU secara sistematis pada setiap tahapan, mulai dari persiapan, kampanye, pelaksanaan, pemungutan dan penghitungan suara, hingga penetapan hasil sesuai dengan ketentuan peraturan perundang-undangan dan Putusan Mahkamah Konstitusi. Pengawasan tersebut diwujudkan melalui supervisi terhadap proses pencalonan, pengawasan kampanye, validasi data pemilih, pengawasan logistik, pengawasan pemungutan dan penghitungan suara, serta monitoring dan evaluasi terhadap penanganan laporan dugaan pelanggaran. Dalam perspektif Siyasah Tanfidziyyah, kinerja pengawasan tersebut telah mencerminkan prinsip Al-Amanah melalui sikap profesional, bertanggung jawab, dan berintegritas, serta prinsip Al- 'Adalah melalui pengawasan yang objektif, imparsial, dan memberikan perlakuan yang sama kepada seluruh peserta pemilihan. Dengan demikian, pelaksanaan pengawasan PSU oleh Bawaslu Provinsi Lampung telah sesuai dengan ketentuan hukum positif dan prinsip-prinsip Siyasah Tanfidziyyah. ABSTRACT The implementation of the Re-Voting Election (Pemungutan Suara Ulang/PSU) in Pesawaran Regency based on the Constitutional Court Decision Number 20/PHPU.BUP-XXIII/2025 required the Election Supervisory Agency (Bawaslu) of Lampung Province to conduct optimal supervision throughout every stage of the electoral process. This study examines how Bawaslu of Lampung Province carried out its supervisory role during the preparation, campaign, implementation, voting and votecounting, and final determination stages of the PSU, as well as how the principles of Al-Amanah and Al-'Adalah were fulfilled from the perspective of Siyasah Tanfidziyyah. This study employed field research using a descriptive qualitative approach. Primary data were collected through interviews with officials of Bawaslu of Lampung Province and other relevant informants, while secondary data were obtained from the Constitutional Court Decision Number 20/PHPU.BUP-XXIII/2025, statutory regulations, decisions of the General Election Commission (KPU), books, academic journals, and other supporting documents. Data were collected through observation, interviews, and documentation and were analyzed qualitatively using an inductive approach. The findings indicate that Bawaslu of Lampung Province systematically supervised every stage of the PSU, including preparation, campaign, implementation, voting and vote counting, and the determination of the election results in accordance with statutory regulations and the Constitutional Court's decision. The supervision included oversight of candidate verification, campaign activities, voter data validation, election logistics, voting and vote-counting processes, as well as monitoring and evaluating the handling of alleged election violations. From the perspective of Siyasah Tanfidziyyah, the supervisory performance reflected the principle of Al-Amanah through professionalism, responsibility, and integrity, and the principle of Al- 'Adalah through objective, impartial, and equal treatment of all election participants. Therefore, the supervision of the PSU conducted by Bawaslu of Lampung Province was consistent with both positive law and the principles of Siyasah Tanfidziyyah.
