Abstract
ABSTRAK Kekerasan dalam rumah tangga (KDRT) memang diakui sebagai alasan sah untuk perceraian dalam sistem hukum Indonesia dan Turki, namun efektivitas implementasinya masih dipertanyakan. Penelitian ini membandingkan kerangka hukum kedua negara melalui metode komparatif-normatif, dengan menganalisis Undang-Undang Nomor 23 Tahun 2004, ketentuan perceraian dalam Undang-Undang Nomor 1 Tahun 1974, dan Kompilasi Hukum Islam di Indonesia, serta membandingkannya dengan Kitab Undang-Undang hukum Turki Nomor 4721 dan Undang-Undang Nomor 6284 tentang Perbandingan Keluarga dan Pencegahan Kekerasan terhadap Perempuan di Turki. Hasil penelitian menunjukkan bahwa meskipun terdapat dasar hukum kedua yurisdiksi, korban masih menghadapi hambatan seperti kesulitan dalam menyediakan bukti, bias budaya, proses peradilan yang kurang responsif terhadap isu gender, dan konsisten yang lemah dalam perlindungan institusional. Indonesia menghadapi masalah mediasi wajib dan standar bukti yang tinggi, sementara Turki berjuang dengan masalah implementasinya dan kecenderungan bias patriatkal oleh pejabat. Studi ini menekankan perlunya perbaikan sturktural agar perlindungan hukum benar-benar efektif secara substansial, bukan hanya kuat secara normatif. ABSTRACT Domestic violence (KDRT) is indeed a recognized reason for divorce in both Indonesian and Turkish legal systems, but the effectiveness of its implementation remains questionable. This study compares the legal frameworks of the two countries through a normative-comparative juridical method, by examining Law No. 23 of 2004, the divorce provisions in Law No. 1 of 1974, and the Compilation of Islamic Law in Indonesia, and comparing them with the Turkish Civil Code No. 4721 and Law No. 6284 concerning Family Protection and Prevention of Violence Against Women in Turkey. The research findings indicate that despite the legal basis in both jurisdictions, victims still face obstacles such as difficulty in providing evidence, cultural bias, a judicial process that is less responsive to gender issues, and weak consistency in institutional protection. Indonesia faces issues of mandatory mediation and high standards of proof, while Turkey grapples with implementation issues and tendencies of patriarchal bias by officials. This study emphasizes the need for structural improvements so that legal protection is truly substantively effective, not just normatively strong.
