Abstract

ABSTRAK Penelitian ini dilatarbelakangi oleh adanya kebijakan administratif berupa Surat Edaran Dirjen Bimas Islam Nomor P- 005/DJ.III/HK.00.7/10/2021 tentang Pernikahan dalam Masa ‘Iddah Istri yang berdampak pada penerapan Syibhul ‘iddah suami dalam praktik pencatatan pernikahan di Kantor Urusan Agama (KUA) Kecamatan Way Halim. Kebijakan tersebut menimbulkan perbedaan pemahaman di masyarakat karena dalam hukum Islam klasik tidak dikenal kewajiban ‘iddah bagi laki-laki. Oleh karena itu, penelitian ini bertujuan untuk mengetahui implementasi kebijakan Syibhul ‘iddah suami di KUA Kecamatan Way Halim serta menganalisisnya dalam perspektif hukum keluarga Islam melalui pendekatan maslahah mursalah. Rumusan masalah dalam penelitian ini adalah bagaimana implementasi kebijakan Syibhul ‘iddah suami berdasarkan Surat Edaran Dirjen Bimas Islam Nomor P-005/DJ.III/HK.00.7/10/2021 di KUA Kecamatan Way Halim dan bagaimana analisis hukum keluarga Islam terhadap kebijakan tersebut dalam perspektif maslahah mursalah. Penelitian ini merupakan penelitian lapangan (field research) dengan pendekatan kualitatif deskriptif analitis yang menggunakan metode observasi, wawancara, dan dokumentasi sebagai teknik pengumpulan data. Pendekatan normatif digunakan untuk menganalisis kebijakan berdasarkan sumber hukum Islam dan teori maqāṣid al-syarī‘ah, sedangkan pendekatan empiris digunakan untuk melihat praktik penerapannya di lapangan. Hasil penelitian menunjukkan bahwa implementasi kebijakan Syibhul ‘iddah suami di KUA Kecamatan Way Halim telah berjalan sesuai ketentuan administratif yang berlaku. Namun demikian, dalam praktiknya masih terdapat kendala berupa perbedaan pemahaman masyarakat terhadap kebijakan tersebut. Dalam perspektif hukum keluarga Islam melalui pendekatan maslahah mursalah, kebijakan Syibhul ‘iddah suami dapat dipahami sebagai bentuk ijtihad kelembagaan yang bertujuan menjaga ketertiban administrasi perkawinan, mencegah potensi poligami terselubung, serta memberikan kesempatan bagi pasangan untuk melakukan rujuk selama masa ‘iddah , sehingga sejalan dengan prinsip kemaslahatan dalam hukum Islam. ABSTRACT This research is motivated by the existence of an administrative policy in the Circular Letter of the Director General of Islamic Community Guidance Number P-005/DJ.III/HK.00.7/10/2021 concerning Marriage During the Wife’s ‘iddah Period, which has implications for the implementation of Syibhul ‘iddah for husbands in marriage registration practices at the Office of Religious Affairs (KUA) of Way Halim District. This policy has generated different interpretations among the public, since classical Islamic law does not recognize the obligation of ‘iddah for men. Therefore, this study aims to examine the implementation of the Syibhul ‘iddah policy for husbands at KUA Way Halim District and to analyze it from the perspective of Islamic family law through the approach of maslahah mursalah. The research questions focus on how the implementation of the Syibhul ‘iddah policy based on the Circular Letter of the Director General of Islamic Community Guidance Number P-005/DJ.III/HK.00.7/10/2021 is carried out at KUA Way Halim District and how the policy is analyzed within the framework of Islamic family law from the perspective of maslahah mursalah. This study is a field research using a qualitative descriptiveanalytical approach. Data were collected through observation, interviews, and documentation. A normative approach was applied to analyze the policy based on Islamic legal sources and the theory of maqāṣid al-sharī‘ah, while an empirical approach was used to examine its implementation in practice at the research site. The results show that the implementation of the Syibhul ‘iddah policy for husbands at KUA Way Halim District has been carried out in accordance with existing administrative regulations. However, in practice, there are still challenges related to differences in public understanding of the policy. From the perspective of Islamic family law through the maslahah mursalah approach, the Syibhul ‘iddah policy for husbands can be understood as a form of institutional ijtihād aimed at maintaining order in marriage administration, preventing the potential occurrence of hidden polygamy, and providing an opportunity for reconciliation between former spouses during the ‘iddah period. Therefore, the policy is considered consistent with the principle of public benefit (maslahah) in Islamic law.
