Abstract

ABSTRAK Penelitian ini berfokus pada analisis komparatif mengenai diskursus hijab dalam bingkai feminisme Islam, dengan memfokuskan kajian pada pemikiran dua tokoh intelektual kontemporer, yaitu Fatima Mernissi dan Aminah Wadud. Persoalan hijab dalam beberapa dekade terakhir telah bergeser dari sekadar masalah pakaian keagamaan menjadi medan kontestasi ideologis yang sangat tajam antara penjaga otoritas teks syariat dengan arus dekonstruksi modern. Fenomena ini memicu lahirnya berbagai kegelisahan akademik mengenai sejauh mana penafsiran teks wahyu dapat diadaptasikan dengan nilai-nilai kesetaraan gender dari Fatima Mernissi dan Aminah Wadud, di mana modernitas tanpa kehilangan orisinalitas hukumnya. Penelitian ini bertujuan untuk membedah secara mendalam konstruksi metodologis yang dibangun oleh Mernissi dan Wadud, mengidentifikasi titik temu serta perbedaan pendekatan keduanya, dan akhirnya memberikan penilaian kritis atas validitas argumentasi mereka dalam timbangan hukum Islam yang otoritatif. Metodologi yang digunakan dalam penelitian ini adalah kualitatif berbasis studi kepustakaan (library research). Pendekatan yang digunakan adalah deskriptif-analitis dengan metode studi komparatif (comparative study). Data primer dalam riset ini digali langsung dari karya monumental kedua tokoh, yakni The Veil and the Male Elite karya Fatima Mernissi dan Qur’an and Woman karya Aminah Wadud. Sebagai pisau analisis, peneliti menggunakan perangkat Ushul Fiqh dan Ulumul Qur’an dan konsep Maqasid al-Syariah. Hasil penelitian ini menyimpulkan beberapa temuan mendasar: Pertama, Fatima Mernissi melalui pendekatan sosiologis-historis melakukan desakralisasi terhadap ayat-ayat hijab dengan argumen bahwa hijab merupakan produk dari kondisi darurat sosiopolitik di Madinah abad ke-7. Mernissi memandang hijab sebagai instrumen ruang yang digunakan elit lelaki untuk membatasi agensi perempuan, sehingga ia menyimpulkan bahwa di era modern di mana keamanan publik telah terjamin, kewajiban fisik hijab telah kehilangan relevansi sosiologisnya. Kedua, Aminah Wadud melalui hermeneutika Tauhid melakukan reinterpretasi semantik yang memosisikan hijab sebagai variabel budaya yang bersifat opsional. Wadud menekankan bahwa esensi takwa dan otonomi tubuh lebih utama daripada formalitas lahiriah, sehingga menurutnya, seorang perempuan dapat mencapai derajat kesalehan yang sempurna tanpa harus terikat pada aturan berpakaian yang kaku.Ketiga, melalui analisis kritis yang mendalam, peneliti menemukan adanya kelemahan metodologis yang fundamental dalam pemikiran keduanya. Peneliti mencatat bahwa Mernissi dan Wadud terjebak dalam praktik ta’thīl al-nuṣūṣ (peniadaan fungsi teks) dengan alasan kontekstualisasi. Alih-alih merumuskan hukum yang adaptif, mereka justru menghapuskan kewajiban syar'i melalui rasio. Peneliti berargumen bahwa pendekatan mereka mengabaikan kaidah al-‘ibrah bi ‘umum al-lafzh (ibrah diambil dari keumuman lafaz) dan gagal membedakan antara dimensi ta’abbudi (ibadah murni) dan ta’aqquli (rasional) dalam ayat-ayat hijab. Peniliti juga menilai bahwa hijab sebenarnya adalah wasilah bagi negara Islam di masa Rasulullah saw untuk memperkuat kedudukan Wanita yang dilindungi dengan aturan dan kekuatan negara. ABSTRACT This research focuses on a comparative analysis of the discourse on the hijab within the framework of Islamic feminism, specifically examining the thoughts of two contemporary intellectuals, Fatima Mernissi and Amina Wadud. In recent decades, the issue of the hijab has shifted from a mere matter of religious attire to a sharp field of ideological contestation between the guardians of established Shari'a text authority and the currents of modern deconstruction. This phenomenon has triggered various academic anxieties regarding the extent to which the interpretation of revelation texts can be adapted to the values of gender equality proposed by Fatima Mernissi and Amina Wadud, whereby modernity is achieved without losing its legal originality. This study aims to deeply dissect the methodological constructions built by Mernissi and Wadud, identify the points of convergence and divergence in their approaches, and ultimately provide a critical assessment of the validity of their arguments within the balance of authoritative Islamic law.The methodology used in this study is qualitative based on library research. The approach applied is descriptive-analytical with a comparative study method. Primary data in this research were extracted directly from the monumental works of both figures, namely The Veil and the Male Elite by Fatima Mernissi and Qur’an and Woman by Amina Wadud. As an analytical tool, the researcher utilizes the apparatus of Ushul Fiqh (Islamic Jurisprudence), Ulumul Qur’an (Qur'anic Sciences), and the concept of Maqasid al-Shariah (The Objectives of Shari'a). The results of this study conclude several fundamental findings: First, Fatima Mernissi, through a socio-historical approach, desecralizes the hijab verses with the argument that the hijab was a product of socio-political emergency conditions in 7thcentury Medina. Mernissi views the hijab as a spatial instrument used by the male elite to limit women's agency; thus, she concludes that in the modern era, where public safety is guaranteed, the physical obligation of the hijab has lost its sociological relevance. Second, Amina Wadud, through Tawhidic hermeneutics, performs a semantic reinterpretation that positions the hijab as an optional cultural variable. Wadud emphasizes that the essence of piety and bodily autonomy takes precedence over outward formality; therefore, according to her, a woman can achieve a perfect degree of righteousness without being bound by rigid dress codes.Third, through an in-depth critical analysis, the researcher uncovers fundamental methodological weaknesses in the thinking of both scholars. The researcher notes that Mernissi and Wadud are trapped in the practice of ta’thīl al-nuṣūṣ (nullification of the function of the text) under the guise of contextualization. Instead of formulating adaptive laws, they actually abolish Shari'a obligations through mere reason. The researcher argues that their approach ignores the rule of al-‘ibrah bi ‘umum al-lafzh (lessons are drawn from the generality of the expression) and fails to distinguish between the ta’abbudi (purely devotional) and ta’aqquli (rational) dimensions within the hijab verses. Furthermore, the researcher asserts that the hijab was inherently a strategic instrument (wasilah) utilized by the Islamic state during the era of Prophet Muhammad saw to strengthen the position of women, who were actively protected through formal state regulations and political power.
