Abstract

ABSTRAK Bantuan sosial lanjut usia merupakan kebijakan perlindungan sosial pemerintah dalam menjamin kesejahteraan sosial bagi kelompok rentan sebagaimana diatur dalam Pasal 35 Peraturan Pemerintah Nomor 43 Tahun 2004. Penelitian ini menganalisis implementasi Pasal 35 Peraturan Pemerintah Nomor 43 Tahun 2004 tentang bantuan sosial lanjut usia di Dinas Sosial Kota Bandar Lampung dalam perspektif siyasah tanfidziyah. Metode yang digunakan adalah kualitatif dengan pendekatan melalui wawancara dan dokumentasi. Hasil penelitian menunjukkan bahwa pelaksanaan bantuan sosial lanjut usia belum optimal akibat keterbatasan anggaran dan ketidakakuratan data penerima, sehingga distribusi bantuan belum sepenuhnya tepat sasaran. Kondisi ini berpotensi menimbulkan implikasi hukum berupa tidak terpenuhinya hak konstitusional lanjut usia atas jaminan kesejahteraan sosial, terjadinya maladministrasi dalam pendataan dan penyaluran bantuan, serta potensi penyimpangan administratif yang dapat berujung pada pertanggung jawaban hukum bagi pelaksana kebijakan. Ketidaktepatan sasaran juga dapat menimbulkan ketidakadilan distributif yang bertentangan dengan prinsip kepastian hukum dan asas kemanfaatan dalam penyelenggaraan pemerintahan. Meski demikian, keberadaan regulasi yang jelas, peran pendamping sosial, serta mekanisme pengawasan internal menjadi faktor pendukung dalam meminimalisir risiko pelanggaran hukum dan mendukung pelaksanaan program sesuai dengan prinsip akuntabilitas dan kemaslahatan. Perspektif siyasah tanfidziyah, kebijakan ini mencerminkan tanggung jawab pemerintah dalam mewujudkan kemaslahatan, namun masih memerlukan perbaikan tata kelola. Penelitian ini merekomendasikan pembaruan data dan peningkatan anggaran agar bantuan sosial lanjut usia lebih efektif dan tepat sasaran. ABSTRACT Elderly social assistance constitutes a government social protection policy aimed at ensuring social welfare for vulnerable groups as regulated in Article 35 of Government Regulation Number 43 of 2004. This study analyzes the implementation of Article 35 of Government Regulation Number 43 of 2004 concerning social assistance for the elderly at the Social Affairs Office of Bandar Lampung City from the perspective of siyasah tanfidziyah. This research employs a qualitative method using interviews and documentation as data collection techniques. The findings indicate that the implementation of elderly social assistance has not been optimal due to budget constraints and inaccuracies in beneficiary data, resulting in the distribution of assistance not being fully well-targeted. This condition potentially gives rise to legal implications, including the failure to fulfill the constitutional rights of the elderly to social welfare guarantees, the occurrence of maladministration in data collection and assistance distribution, and the potential for administrative irregularities that may lead to legal accountability for policy implementers. Inaccurate targeting may also create distributive injustice, which contradicts the principles of legal certainty and public benefit in governance. Nevertheless, the existence of clear regulations, the role of social facilitators, and internal supervision mechanisms serve as supporting factors in minimizing the risk of legal violations and promoting program implementation in accordance with the principles of accountability and public welfare (maslahah). From the perspective of siyasah tanfidziyah, this policy reflects the government's responsibility to realize public welfare, although improvements in governance are still required. This study recommends updating beneficiary data and increasing the budget allocation to ensure that elderly social assistance becomes more effective and better targeted.
