Abstract

ABSTRAK Indonesia merupakan negara hukum (rechtsstaat) yang menjunjung tinggi prinsip keadilan dan kedaulatan rakyat sebagaimana tertuang dalam Pasal 1 ayat (3) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Dalam penyelenggaraan pemerintahan, rakyat memiliki hak politik untuk memilih dan dipilih melalui mekanisme Pemilihan Umum (Pemilu). Namun, muncul perdebatan terkait diperbolehkannya mantan narapidana, khususnya mantan terpidana kasus korupsi, untuk mencalonkan diri sebagai anggota legislatif. Berdasarkan masalah tersebut peneliti ingin mengetahui Bagaimana mantan narapidana diperbolehkan menjadi calon anggota Legislatif sesuai dengan Undang-Undang Nomor 7 Tahun 2017 Tentang Pemilihan Umum serta Bagaimana tinjauan Siyāsah Dusturiyyah terhadap mantan narapidana menjadi anggota legislatif dalam Pasal 240 Undang-Undang Nomor 7 Tahun 2017 Tentang Pemilihan Umum Anggota DPR, DPD, DPRD. Metode penelitian yang digunakan menggunakan pendekatan penelitian ini bersifat deskriptif analisis. Dan jenis penelitian ini adalah studi pustaka (library research), yaitu data yang berasal dari sumber-sumber literatur data kepustakaan, lalu peneliti melakukan penelaahan terhadap buku-buku yang berkaitan dengan pokok permasalahan yang dibahas, dengan cara membaca, memahami lalu disimpulkan. Berdasarkan hasil penelitian dapat disimpulkan bahwa maka peneliti menyimpulkan bahwa mantan narapidana diperbolehkan untuk menjadi calon anggota legislatif. Hal itu didukung oleh isi dari Pasal 240 ayat (1) huruf g UU No. 7 Tahun 2017 yang menyatakan bahwa seseorang yang pernah dipidana penjara selama 5 tahun atau lebih tetap boleh menjadi calon legislatif asalkan secara terbuka dan jujur mengemukakan status mantan terpidana kepada public. Tinjauan Siyāsah Dusturiyyah menyatakan bahwa kebolehan mantan narapidana menjadi anggota legislatif dapat dibenarkan, namun disertai persyaratan tertentu diantaranya, adanya taubat yang sungguhsungguh, terbuktinya integritas moral, serta penerimaan masyarakat terhadap yang bersangkutan. ABSTRACT Indonesia is a constitutional state (rechtsstaat) that upholds the principles of justice and people's sovereignty as enshrined in Article 1 paragraph (3) of the 1945 Constitution of the Republic of Indonesia. In the administration of government, the people have the political right to vote and be elected through the mechanism of general elections (Pemilu). However, there has been debate regarding whether former convicts, particularly those convicted of corruption, should be allowed to run for legislative office. Based on these issues, the researcher wanted to know how former convicts are allowed to become candidates for the legislature in accordance with Law 7 of 2017 on General Elections and how Siyāsah Dusturiyyah views former convicts becoming members of the legislature in Article 240 of Law Number 7 of 2017 on General Elections for Members of the DPR, DPD, and DPRD. The research method used in this study is descriptive analysis. This type of research is library research, which means that the data comes from literature sources. The researcher then reviews books related to the subject matter by reading, understanding, and drawing conclusions. Based on the results of the study, it can be concluded that the researcher concludes that former convicts are allowed to become legislative candidates. This is supported by the contents of Article 240 paragraph (1) letter g of Law No. 7 of 2017, which states that a person who has been sentenced to 5 years or more in prison may still become a legislative candidate as long as they openly and honestly disclose their status as a former convict to the public. A review of Siyāsah Dusturiyyah states that the permissibility of former convicts becoming members of the legislature can be justified, but is accompanied by certain requirements, including sincere repentance, proven moral integrity, and public acceptance of the person concerned.
