Abstract

ABSTRAK Penelitian ini bertujuan untuk menganalisis implementasi Pasal 13 huruf c Peraturan Daerah Kota Bandar Lampung Nomor 7 Tahun 2018 tentang Izin Penyelenggaraan dan Penataan Rumah Kost ditinjau dari perspektif Siyāsah Tanfīżiyyah. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi kasus yang dipusatkan pada Satuan Polisi Pamong Praja Kota Bandar Lampung sebagai pelaksana penegakan peraturan daerah. Pendekatan yang digunakan memadukan yuridis- empiris dan normatif-keislaman. Data diperoleh melalui wawancara, observasi lapangan, dan studi kepustakaan, kemudian dianalisis secara deskriptif-analitis. Hasil penelitian menunjukkan bahwa secara normatif ketentuan Pasal 13 huruf c telah selaras dengan prinsip-prinsip Fiqh Siyāsah, khususnya maslahah mursalah, ta„zir, keadilan (al-„adl), dan tanggung jawab kekuasaan (mas‟uliyyah alsulthah). Namun, implementasinya di lapangan belum optimal. Pengawasan yang bersifat reaktif, dominasi pendekatan persuasif tanpa konsistensi sanksi administratif, serta keterbatasan sumber daya dan koordinasi lintas sektor menyebabkan tujuan kemaslahatan publik belum sepenuhnya tercapai. Penelitian ini menyimpulkan bahwa efektivitas penataan rumah kost menuntut penegakan hukum yang konsisten, proporsional, dan berorientasi pada kemaslahatan sesuai prinsip Siyāsah Tanfīżiyyah. ABSTRACT This study aims to analyze the implementation of Article 13 letter c of Bandar Lampung City Regulation Number 7 of 2018 concerning the Licensing and Regulation of Boarding Houses from the perspective of Siyāsah Tanfīżiyyah. The research employs a qualitative case study approach focused on the Bandar Lampung City Civil Service Police Unit (Satpol PP) as the authority responsible for enforcing local regulations. It integrates juridical-empirical and normative Islamic legal approaches. Data were collected through interviews, field observations, and literature review, and analyzed using a descriptive- analytical method. The findings reveal that, normatively, Article 13 letter c is consistent with the principles of Fiqh Siyāsah, particularly maslahah mursalah, ta„zir, justice (al-„adl), and governmental responsibility (mas‟uliyyah al-sulthah). However, its practical implementation remains suboptimal. Reactive supervision, the dominance of persuasive measures without consistent administrative sanctions, and limited institutional capacity and interagency coordination have hindered the achievement of public welfare objectives. This study concludes that effective boarding house regulation requires consistent and proportional law enforcement oriented toward public welfare in accordance with the principles of Siyāsah Tanfīżiyyah
