Abstract

ABSTRAK Mengacu pada proses penerapan dan pelaksanaan peraturan yang telah ditetapkan oleh pemerintah mengenai isi peraturan bupati Kabupaten Lampung Utara Nomor 44 Tahun 2021. Ini mencakup tentang tata cara penerapan, pelaksanaan peraturan dan langkahlangkah yang dilakukan oleh pemerintah Kabupaten Lampung Utara. Peraturan ini mengatur langkah-langkah, prosedur, dan mekanisme yang harus diikuti dalam setiap tahapan Pilkades, termasuk persyaratan calon, proses pencalonan, pemungutan suara, hingga pengumuman hasil. Penelitian ini bertujuan untuk menganalisis implementasi Pasal 7 Peraturan Bupati Kabupaten Lampung Utara Nomor 44 Tahun 2021 tentang Tata Cara Pelaksanaan Pemilihan Kepala Desa di Desa Kembang Gading serta meninjau kesesuaiannya dengan prinsipprinsip pelaksanaan kebijakan dalam perspektif Siyāsah Tanfidziyah. Penelitian menggunakan metode kualitatif dengan pendekatan deskriptif, melalui teknik pengumpulan data berupa observasi, wawancara, dan studi pustaka. Hasil penelitian menunjukkan bahwa pelaksanaan Pasal 7 telah berjalan dengan baik, yang ditandai dengan terlaksananya tahapan penjaringan bakal calon, verifikasi administrasi, penetapan calon, dan proses seleksi yang sesuai dengan ketentuan peraturan. Meskipun ditemukan beberapa kendala teknis seperti keterlambatan informasi dan pemahaman masyarakat yang belum merata, namun tidak menghambat jalannya proses pemilihan. Dalam perspektif Siyāsah Tanfidziyah, implementasi Pasal 7 mencerminkan prinsip pelaksanaan kebijakan yang menekankan ketertiban, kemaslahatan, tanggung jawab administratif, serta kepatuhan terhadap aturan. Penyelenggara pemilihan mampu menjalankan amanah regulasi dengan asas keadilan dan transparansi sehingga tujuan penyelenggaraan pemilihan kepala desa dapat tercapai. Dengan demikian, dapat disimpulkan bahwa penerapan Pasal 7 Peraturan Bupati Kabupaten Lampung Utara Nomor 44 Tahun 2021 di Desa Kembang Gading telah berhasil diimplementasikan secara efektif baik dalam perspektif hukum positif maupun menurut prinsip-prinsip pelaksanaan kebijakan dalam Siyāsah Tanfidziyah. ABSTRACT This document pertains to the process of implementing and enforcing regulations established by the government regarding the content of North Lampung Regency Regulation No. 44 of 2021. This covers the procedures for the application and implementation of the regulation, as well as the steps taken by the North Lampung Regency government. This regulation governs the steps, procedures, and mechanisms that must be followed in every stage of the village head election, including candidate requirements, the nomination process, voting, and the announcement of results. This study aims to analyze the implementation of Article 7 of North Lampung Regent Regulation No. 44 of 2021 on the Procedures for Conducting Village Head Elections in Kembang Gading Village and to assess its alignment with the principles of policy implementation from the perspective of Siyāsah Tanfidziyah. The research employs a qualitative method with a descriptive approach, utilizing data collection techniques such as observation, interviews, and literature review. The research findings indicate that the implementation of Article 7 has proceeded smoothly, as evidenced by the successful completion of the candidate nomination phase, administrative verification, candidate designation, and the selection process in accordance with regulatory provisions. Although several technical challenges were identified—such as delays in information dissemination and uneven public understanding—these did not hinder the election process. From the perspective of Siyāsah Tanfidziyah, the implementation of Article 7 reflects the principles of policy execution that emphasize order, public welfare, administrative responsibility, and compliance with regulations. The election organizers were able to fulfill their regulatory mandate based on the principles of justice and transparency, thereby ensuring the objectives of the village head election were achieved. Thus, it can be concluded that the application of Article 7 of North Lampung Regent Regulation No. 44 of 2021 in Kembang Gading Village has been successfully implemented effectively, both from the perspective of positive law and according to the principles of policy implementation in Siyāsah Tanfidziyah.
