Abstract

ABSTRAK Fenomena pedagang kaki lima (PKL) di trotoar Masjid Agung Istiqlal Bandar Jaya Barat Kabupaten Lampung Tengah menimbulkan persoalan ketertiban umum, kemacetan, dan terganggunya fungsi fasilitas publik. Untuk menanggapi hal tersebut, Pemerintah daerah melalui Satuan Polisi Pamong Praja (Satpol PP) Menerapkan Pasal 8 Ayat (1) Huruf a Peraturan Daerah Kabupaten Lampung Tengah Nomor 16 Tahun 2018 Tentang Ketertiban umum dan Ketentraman masyarakat. Penelitian ini dilakukan guna mengetahui implementasi perda tersebut oleh Satpol PP serta menelaahnya dari perspektif siyāsah tanfīżīyyah yang menekankan pada prinsip kemaslahatan dan keadilan sosial. penelitian ini menggunakan metode penelitian lapangan (field research). Pengumpulan data diperoleh melalui wawancara dan dokumentasi dengan Satpol PP Kabupaten Lampung Tengah dan para PKL yang berjualan di kawasan trotoar masjid, dan data sekunder dikumpulkan dari literatur, peraturan perundang-undangan, serta dokumen resmi pemerintah daerah. Analisis data dilakukan dengan metode analisis kualitatif, yaitu menggambarkan implementasi perda sebagaimana adanya, kemudian ditinjau dengan teori siyāsah tanfīżīyyah untuk menemukan relevansinya dengan nilai-nilai Islam. Hasil penelitian menunjukkan bahwa implementasi Pasal 8 Ayat (1) Huruf a Peraturan Daerah Kabupaten Lampung Tengah Nomor 16 Tahun 2018 telah terlaksanakan namun belum maksimal karena hanya dilaksanakan melalui tahap pendataan PKL, sosialisasi terkait larangan penggunaan trotoar sebagai tempat berdagang, pemberian surat teguran secara bertahap, hingga tindakan penertiban langsung bagi pelanggaran yang tetap berlanjut. Mekanisme tersebut mencerminkan prinsip-prinsip dalam siyāsah tanfīżīyyah, yaitu pelaksanaan otoritas pemerintah dalam menegakkan peraturan demi kemaslahatan publik, menjaga akses dan fungsi fasilitas umum, menciptakan keamanan dan keteraturan sosial, serta melindungi hak masyarakat luas. Pendekatan persuasif dan humanis yang diterapkan juga selaras dengan nilai keadilan dan tidak menimbulkan kemudaratan yang lebih besar bagi PKL. Meskipun efektivitasnya masih dipengaruhi keterbatasan lokasi relokasi serta tingginya ketergantungan ekonomi pedagang terhadap area tersebut, kebijakan ini tetap menunjukkan upaya pemerintah dalam menjalankan kewajiban syar’i untuk menjaga kemaslahatan dan ketertiban masyarakat melalui tindakan yang terukur dan berkeadilan. ABSTRACT The phenomenon of street vendors (PKL) occupying the sidewalks of Istiqlal Grand Mosque, Bandar Jaya Barat, Central Lampung, has created problems of public order, traffic congestion, and the disruption of public facilities. In response, the local government through the Civil Service Police Unit (Satpol PP) Implemented Regional Regulation of Central Lampung Regency Number 16 of 2018 Article 8 Paragraph (1) letter a concerning Public Order and Community Tranquility. This study aims to examine the implementation of the regulation by Satpol PP and analyze it from the perspective of siyāsah tanfīżīyyah, which emphasizes the principles of public benefit (maslahah) and social justice. This study employs a field research method with a descriptive qualitative approach. Primary data were obtained through interviews with the Civil Service Police Unit (Satpol PP) of Central Lampung Regency and street vendors (PKL) operating around the mosque sidewalks, while secondary data were collected from literature, legal regulations, and official government documents. Data analysis was conducted using a descriptive-analytical method, which describes the implementation of the local regulation as it occurs in reality, then relates it to the theory of siyāsah tanfīżīyyah to identify its relevance to Islamic values. The results of the study indicate that the implementation of Article 8 Paragraph (1) Letter a of the Regional Regulation of Central Lampung Regency Number 16 of 2018 has been carried out but not yet optimally, as it is limited to several stages: collecting data on street vendors, socializing the prohibition of using sidewalks as trading areas, issuing written warnings in stages, and conducting direct enforcement actions against those who continue to violate the regulation. These mechanisms reflect the principles of siyāsah tanfīżiyyah, namely the exercise of governmental authority in enforcing regulations for the public benefit, ensuring access and function of public facilities, creating security and social order, and protecting the rights of the broader community. The persuasive and humanistic approach applied also aligns with the values of justice and avoids causing greater harm to the street vendors. Although its effectiveness is still constrained by the limited availability of proper relocation sites and the high economic dependence of street vendors on these strategic areas, the policy nevertheless demonstrates the government’s efforts in fulfilling its shar’i obligation to maintain public welfare and order through measured and equitable actions..
