Abstract
ABSTRAK Penelitian ini mengkaji urgensi terhadap putusan Mahkamah Konstitusi Nomor 60/PUU-XXII/2024 pada pemilihan kepala daerah serentak tahun 2024 Baru-baru ini, Mahkamah Konstitusi mengabulkan putusan Nomor 60/PUU-XXII/2024, yang merupakan pengujian Pasal 40 ayat (3) Undang-Undang Nomor 10 tahun 2016 yang diajukan oleh Partai Buruh dan Partai Gelora yang bertentangan dengan prinsip kedaulatan rakyat serta prinsip negara hukum karena membatasi hak para pemohon, anggota maupun pengurus partai politik yang akan mengajukan atau diajukan sebagai calon kepala daerah atau wakil kepala daerah. Rumusan dan adanya penelitian ini ialah1) Bagaimana penentuan ambang batas dukungan partai politik pada calon kepala daerah studi putusan Mahkamah Konsitusi nomor 60/PUU-XXII/2024 2) Bagaimana tinjauan Siyasah qadh’iyyah terhadap penentuan ambang batas dukungan partai politik pada calon kepala daerah studi putusan Mahkamah Konsitusi nomor 60/PUU-XXII/2024 Penelitian ini masuk kedalam jenis Penelitian Pustaka ( Library Research) dengan metode pengumpulan data dokumen dan analisis yang dilakukan adalah analisis Kualitatif. Hasil penelitian ini menyimpulkan bahwa Penentuan ambang batas dukungan partai politik pada calon kepala daerah sebagaimana diatur dalam Pasal 40 ayat (1) dan ayat (3) Undang-Undang Nomor 10 Tahun 2016 tentang Pemilihan Kepala Daerah, membatasi hak politik partai-partai kecil untuk berpartisipasi dalam pemilihan. Melalui Putusan Mahkamah Konstitusi Nomor 60/PUU-XXII/2024, Mahkamah Konstitusi menyatakan ketentuan tersebut bertentangan dengan UUD 1945 dan tidak memiliki kekuatan hukum mengikat secara bersyarat, sehingga seluruh partai politik, termasuk yang tidak memiliki kursi di DPRD, tetap dapat mengusulkan pasangan calon kepala daerah sepanjang memenuhi syarat administratif. Dalam penelitian ini menggunakan Analisis Siyasah Qadhai’yyah terhadap putusan Mahkamah Konstitusi Nomor 60/PUUXXII/2024 menunjukkan bahwa putusan tersebut mencerminkan nilainilai keadilan (al-‘adl), kemaslahatan umum (maslahah al-‘ammah), kepastian hukum (al-yaqīn), dan penghapusan kezaliman (raf‘al-dzulm). Mahkamah Kontitusi melalui putusannya telah menegakkan keadilan substantif, memperluas partisipasi politik rakyat, dan menjaga independensi lembaga peradilan. ABSTRACK This study examines the urgency of the Constitutional Court Decision Number 60/PUU-XXII/2024 in the context of the 2024 simultaneous regional elections. Recently, the Constitutional Court granted Decision Number 60/PUU-XXII/2024, which reviewed Article 40 paragraph (3) of Law Number 10 of 2016, submitted by the Labour Party and the Gelora Party. The petition argued that the provision violated the principles of popular sovereignty and the rule of law because it restricted the political rights of the petitioners, including members and administrators of political parties, to nominate or be nominated as candidates for regional head or deputy regional head. The research formulates two main questions: (1) How is the threshold of political party support for regional head candidates determined, as examined through Constitutional Court Decision Number 60/PUU-XXII/2024 and (2) How does Siyasah qadh’iyyah view the determination of political party support thresholds for regional head candidates, based on the same decision? This study employs a Library Research method, using document-based data collection and qualitative analysis. The findings conclude that the determination of the political party support threshold for regional head candidates, as regulated in Article 40 paragraphs (1) and (3) of Law Number 10 of 2016, limits the political rights of smaller parties to participate in regional elections. Through Constitutional Court Decision Number 60/PUUXXII/2024, the Court declared these provisions unconstitutional and conditionally non-binding, thereby allowing all political parties— including those without seats in the Regional House of Representatives (DPRD)—to propose candidate pairs for regional head elections as long as administrative requirements are met. The study’s analysis using Siyasah qadhā’iyyah of Constitutional Court Decision Number 60/PUU-XXII/2024 demonstrates that the ruling reflects the values of justice (al-‘adl), public interest (maslahah al- ‘ammah), legal certainty (al-yaqīn), and the elimination of injustice (raf‘ al-dzulm). Through this decision, the Constitutional Court has upheld substantive justice, expanded public political participation, and maintained the independence of the judiciary.
