Abstract
ABSTRACT Marriage in Islam is a sacred institution that requires a common faith as the basis for forming a harmonious family. However, the phenomenon of one spouse converting to another religion after marriage is becoming increasingly common in modern pluralistic societies. An academic problem arises when such religious conversions are not always born out of spiritual awareness, but rather due to external factors such as administrative requirements, family pressure, or social legitimacy. This creates a dilemma, both from the perspective of Islamic law, where the majority of scholars state that apostasy can invalidate a marriage, and from the perspective of Indonesian positive law, which requires divorce to be settled only through the courts. This normative vacuum raises issues regarding the status of marriage, children's rights, and the continuity of the household. This study aims to analyze the conversion of one spouse after marriage from the perspective of Islamic law, while also critiquing it with the theory of Maqashid al-Syari'ah. Using qualitative methods, library research, and a statute approach, This study examines legislation, classical fiqh literature, and contemporary academic studies related to religious conversion in marriage. However, in the Indonesian context, such decisions are not automatically valid because they must be decided through a religious court. Analysis using the maqashid al-syari'ah approach emphasizes that the phenomenon of religious conversion must be viewed from the perspective of the objectives of sharia, namely the protection of religion (hifz al-din), life (hifz al-nafs), offspring (hifz al-nasl), honor (hifz al-'ird), and property (hifz al-mal). The conclusion of this study affirms the importance of reformulating Islamic family law regulations in Indonesia to be more responsive to the phenomenon of post-marital religious conversion. Clear rules, fair verification of motivation, and maqashid-based mediation mechanisms are needed to prevent social damage and protect the welfare of the family. Keywords: Religious Conversion, Marriage, Islamic Law, Maqashid al-Syari‘ah.
