Abstract
ABSTRAK Netralitas aparatur negara merupakan prinsip konstitusional yang fundamental bagi terjaganya integritas tata kelola pemilu dalam negara demokratis yang berlandaskan supremasi hukum. Artikel ini mengkaji implementasi Pasal 4 Peraturan Bawaslu Nomor 6 Tahun 2018 tentang pengawasan netralitas Aparatur Sipil Negara (ASN), Tentara Nasional Indonesia (TNI), dan Kepolisian Negara Republik Indonesia (Polri) di Kabupaten Tulang Bawang Barat. Penelitian ini menggunakan pendekatan sosio-legal kualitatif dengan mengintegrasikan analisis hukum doktrinal dan penelitian lapangan empiris. Kerangka siyāsah tanfīdhiyyah digunakan sebagai instrumen normatif-analitis yang berlandaskan pada prinsip amanah, keadilan (al-„adl), akuntabilitas (mas‟ūliyyah), dan pengawasan (al-raqābah). Temuan penelitian menunjukkan bahwa meskipun mekanisme pengawasan telah memenuhi standar prosedural sebagaimana diatur dalam peraturan perundang-undangan, efektivitas substantifnya masih dibatasi oleh fragmentasi kewenangan pemberian sanksi, keterbatasan kapasitas kelembagaan, ketidakmerataan internalisasi norma netralitas, serta menguatnya relasi kekuasaan informal yang mengakar. Artikel ini berargumen bahwa diperlukan pendekatan tata kelola yang integratif dengan mengombinasikan koherensi regulatif, efektivitas institusional, dan internalisasi etika dalam pelaksanaan kewenangan publik. ABSTRACT The neutrality of state officials is a fundamental constitutional principle for maintaining the integrity of election governance in a democratic state based on the rule of law. This article examines the implementation of Article 4 of Bawaslu Regulation Number 6 of 2018 concerning the supervision of the neutrality of State Civil Apparatus (ASN), the Indonesian National Armed Forces (TNI), and the Indonesian National Police (Polri) in West Tulang Bawang Regency. This research uses a qualitative socio-legal approach by integrating doctrinal legal analysis and empirical field research. The siyāsah tanfīdhiyyah framework is used as a normative-analytical instrument based on the principles of amanah (trust), justice (al-„adl), accountability (mas‟ūliyyah), and oversight (al-raqābah). The research findings indicate that although the oversight mechanism has met procedural standards as stipulated in legislation, its substantive effectiveness is still limited by fragmented authority to impose sanctions, limited institutional capacity, uneven internalization of neutrality norms, and the strengthening of entrenched informal power relations.
