Abstract

ABSTRAK Kawasan tanpa rokok adalah area atau lokasi yang di tetapkan secara resmi oleh pemerintah di dalamnya. Penerapan kawasan tanpa rokok dapat meliputi tempat-tempat umum seperti kantor pemerintahan, fasilitas kesehatan, sekolah, tempat ibadah, dan transportasi umum. Maka itu pemerintahan Kabupaten Tulang Bawang Barat mengeluarkan Peraturan Daerah Nomor 01 Tahun 2017 tentang Kawasan Tanpa Rokok, pada pasal 7 secara tegas melarang kegiatan merokok di rumah sakit. Namun masih saja ada masyarakat yang merokok di area yang sudah di tetapkan sebagai kawasan tanpa rokok. Rumusan masalah dalam penelitian ini adalah (1) Bagaimana Implementasi Pasal 7 Peraturan Daerah Kabupaten Tulang Bawang Barat Nomor 01 Tahun 2017 tentang Kawasan Tanpa Rokok di Rumah sakit Asy Syifa Medika Tulang Bawang Barat? (2) Faktor-faktor apa saja yang mempengaruhi Pelaksanaan Pasal 7 Peraturan Daerah Kabupaten Tulang Bawang Barat Nomor 01 Tahun 2017 di Rumah Sakit Asy Syifa Medika Tulang Bawang Barat? (3) Bagaimana Implementasi Pasal 7 Peraturan Daerah Kabupaten Tulang Bawang Barat Nomor 01 Tahun 2017 tentang Kawasan Tanpa Rokok di Rumah sakit Asy Syifa Medika Tulang Bawang Barat ditinjau dari perspektif Siyāsah Tanfīżiyyah Syarīʿah? Penelitian ini bertujuan menganalisis implementasi pasal 7 Peraturan Daerah Kabupaten Tulang Bawang Barat Nomor 01 Tahun 2017 tentang Kawasan Tanpa Rokok di Rumah sakit Asy Syifa Medika Tulang Bawang Barat dan meninjau berdasarkan perspektif Siyāsah Tanfīżiyyah Syarīʿah. Metode penelitian yang digunakan adalah kualitatif dengan pendekatan penelitian lapangan (field research). Data diperoleh melalui observasi, wawancara, studi pustaka, dan dokumentasi. Kemudian, dianalisis secara deskriptif-analisis dengan mengaitkan temuan empiris dan prinsip-prinsip pelaksanaan kekuasaan dalam Islam. Hasil penelitian menunjukkan bahwa implementasi pasal 7 Peraturan Daerah Kabupaten Tulang Bawang Barat di Rumah sakit Asy Syifa Medika belum berjalan. Hal ini disebabkan oleh lemahnya pengawasan, kurang tegasnya penegakan sanksi, serta rendahnya kesadaran masyarakat terhadap pentingnya kawasan tanpa rokok. Ditinjau dari perspektif Siyāsah Tanfīżiyyah Syarīʿah, kondisi tersebut menunjukkan belum maksimalnya peran pemerintah dan pelaksana kebijakan dalam menjalankan amanah kekuasaan untuk menjaga kemaslahatan umum, khususnya perlindungan terhadap jiwa (ḥifẓ an-nafs) sebagai bagian dari maqāṣid asy-syarī„ah. Oleh karena itu, diperlukan penguatan komitmen pemerintah daerah dan manajemen rumah sakit dalam menegakkan kebijakan kawasan tanpa rokok secara konsisten dan berkeadilan agar selaras dengan tujuan syariat Islam. ABSTRACT No smoking areas are areas or locations that are officially designated by the government as such. The implementation of smoke free areas can include public places such as government offices, health facilities, schools, place of worship, and public transportation. Therefore the government of West Tulang Bawang Regency issued Regional Regulation Number 01 of 2017 concering Smokefree Areas, article 7 explicitly prohibits smoking in hospitals. However, there are still people who smoke in areas that have been designated as non smoking areas. Based on this background, the author conducted research with the thesis title “Siyāsah Tanfīżiyyah Syarīʿah Review of the Implementation of Article 7 of the West Tulang Bawang Regional Regulation Number 01 of 2017 concering Smokefree Areas (study at Asy Syifa Medika Hospital, West Tulang Bawang Regency). The formulation of the problems in this study are (1) How is Article 7 of West Tulang Bawang Regency Regulation Number 01 of 2017 concerning Smokefree Areas implemented at Asy Syifa Medika Hospital in West Tulang Bawang? (2) What factors influence the implementation of Article 7 of West Tulang Bawang Regency Regulation Number 1 of 2017 at Asy Syifa Medika Hospital in West Tulang Bawang? (3) How is the implementation of Article 7 of West Tulang Bawang Regency Regulation Number 1 of 2017 concerning Smokefree Areas in Asy Syifa Medika Hospital, West Tulang Bawang, reviewed from the perspective of Siyāsah Tanfīżiyyah Syarīʿah? This study aims to analyze the implementation of Article 8 of West Tulang Bawang Regency Regulation Number 01 of 2017 concerning Smokefree Areas in Asy Syifa Medika Hospital, West Tulang Bawang, and review it based on the perspective of Siyāsah Tanfīżiyyah Syarīʿah. The research method used is qualitative with a field research approach. Data was obtained through observation, interviews, literature study, and documentation. It was then analyzed descriptively by linking empirical findings and the principles of exercising power in Islam. The results of the study show that the implementation of Article 7 of the West Tulang Bawang Regency Regulation at Asy Syifa Medika Hospital has not been carried out. This is due to weak supervision, lack of strict enforcement of sanctions, and low awareness among some members of the community regarding the importance of smokefree areas. From the perspective of Siyāsah Tanfīżiyyah Syarīʿah, this condition shows that the government and policy implementers have not fully carried out their mandate to protect the public interest, particularly the protection of life (ḥifẓ an-nafs) as part of maqāṣid asy-syarī„ah. Therefore, it is necessary to strengthen the commitment of local governments and hospital management in consistently and fairly enforcing smokefree zone policies in line with the objectives of Islamic law.
