Abstract

ABSTRAK Penelitian ini membahas Analisis Fiqh Siyasah terhadap Peran Hakim Pengawasan dan Pengamatan berdasarkan Pasal 277 Juncto Pasal 280 Undang-Undang Nomor 8 Tahun 1981 tentang Hukum Acara Pidana (KUHAP). Fokus penelitian diarahkan pada telaah normatif mengenai kewenangan hakim dalam mengawasi pelaksanaan putusan pengadilan dan meninjau kesesuaiannya dengan prinsip-prinsip fiqh siyasah. Jenis penelitian ini adalah kualitatif dengan metode library research, yaitu menelaah bahan hukum primer berupa KUHAP, bahan hukum sekunder seperti literatur, jurnal, serta buku, dan bahan hukum tersier seperti kamus hukum. Analisis dilakukan secara deskriptif-analitis. Hasil penelitian menunjukkan bahwa peran hakim pengawasan dan pengamatan merupakan amanah syar‟i yang berfungsi menjaga keadilan substantif serta melindungi hak narapidana, sekaligus memastikan hukum berjalan sesuai nilai keadilan universal ABSTRACT This study discusses the Fiqh Siyasah Analysis of the Role of Supervisory and Monitoring Judges based on Article 277 in conjunction with Article 280 of Law Number 8 of 1981 concerning Criminal Procedure Law (KUHAP). The focus of the study is directed at a normative review of the authority of judges in supervising the implementation of court decisions and reviewing their conformity with the principles of fiqh siyasah. This study is qualitative in nature, using the library research method, which involves reviewing primary legal materials in the form of the KUHAP, secondary legal materials such as literature, journals, and books, and tertiary legal materials such as legal dictionaries. The analysis is descriptive analytical. The results of the study show that the role of judges in supervision and observation is a sharia mandate that serves to maintain substantive justice and protect the rights of prisoners, while ensuring that the law is carried out in accordance with universal values of justice.
