Abstract

ABSTRAK Penelitian ini bertujuan untuk menganalisis konsep perlindungan petani berdasarkan perspektif fiqh siyasah dusturiyah dalam Undang-Undang Nomor 19 Tahun 2013 tentang Perlindungan dan Pemberdayaan Petani. Perlindungan petani merupakan upaya strategis negara dalam menjamin kesejahteraan, keberlanjutan usaha tani, serta perlindungan terhadap risiko usaha seperti gagal panen, ketimpangan harga, dan keterbatasan akses sarana produksi sesuai yang tertuang pada pasal 7 ayat 2 UU Pemberdayaan dan Perlindungan Petani. Dalam perspektif fiqh siyasah dusturiyah, tanggung jawab negara terhadap petani dipandang sebagai kewajiban untuk menjaga kemaslahatan rakyat melalui kebijakan yang adil, partisipatif, dan berpihak pada kelompok lemah. Metode penelitian yang digunakan adalah pendekatan yuridis normatif dengan teknik pengumpulan data melalui studi kepustakaan terhadap sumber-sumber hukum Islam, literatur fiqh siyasah dusturiyah, peraturan perundang-undangan, serta dokumen pendukung lainnya. Analisis dilakukan dengan membandingkan konsep perlindungan petani dalam fiqh siyasah dusturiyah dengan ketentuan yang terdapat dalam Undang-Undang Nomor 19 Tahun 2013. Hasil penelitian menunjukkan bahwa secara prinsip, nilai-nilai perlindungan petani dalam fiqh siyasah dusturiyah sejalan dengan tujuan Undang-Undang Nomor 19 Tahun 2013, yaitu mewujudkan keadilan sosial, kesejahteraan, dan keberlanjutan sektor pertanian. Namun, dalam tataran implementasi, masih ditemukan berbagai kendala seperti lemahnya pengawasan, ketidakadilan kebijakan harga, dan kurangnya sosialisasi program pemerintah kepada petani. Dengan demikian, diperlukan penguatan kebijakan yang berlandaskan nilai keadilan dan kemaslahatan agar perlindungan petani tidak hanya bersifat normatif, tetapi juga dapat dirasakan secara nyata oleh petani di lapangan. ABSTRACT This study aims to analyze the concept of farmer protection based on the perspective of fiqh siyasah industrialism in Law Number 19 of 2013 concerning the Protection and Empowerment of Farmers. Farmer protection is a strategic effort by the state to ensure welfare, the sustainability of farming businesses, and safeguard against business risks such as crop failure, price inequality, and limited access to production facilities, as stipulated in Article 7 paragraph 2 of the Farmer Empowerment and Protection Law. From the perspective of fiqh siyasah industrialism, the state's responsibility to farmers is seen as an obligation to safeguard the public welfare through fair, participatory policies that favor vulnerable groups. The research method used is a normative juridical approach, with data collection techniques through literature review of Islamic legal sources, fiqh siyasah industrialism literature, laws and regulations, and other supporting documents. The analysis was conducted by comparing the concept of farmer protection in Islamic jurisprudence (fiqh siyasah industri) with the provisions contained in Law Number 19 of 2013. The results of the study indicate that, in principle, the values of farmer protection in Islamic jurisprudence (fiqh siyasah industri) align with the objectives of Law Number 19 of 2013, namely to realize social justice, welfare, and sustainability in the agricultural sector. However, at the implementation level, various obstacles remain, such as weak supervision, unfair pricing policies, and inadequate publicity of government programs for farmers. Therefore, strengthening policies based on the values of justice and welfare is necessary so that farmer protection is not merely normative but canalso be felt concretely by farmers in the field.
