Abstract

ABSTRAK E-court merupakan sebuah inovasi yang dibuat oleh makamah agung menjadi trobosan akan teknologi yang semakin pesat. selain itu, memastikan setiap kalangan dapat menyelesaikan permasalahan hukum secara sedehana, cepat, dan biaya ringan. Pengadilan Negeri Kalianda Kelas IB menjadi tempat penelitian karena dari awal Mahkamah Agung menerbitkan Peraturan Mahkamah Agung mengenai E-court pengadilan negeri Kalianda menjadi salah satu pengadilan yang langsung menggunakan aplikasi E-court dan dari segi layanan Penggunaan E-court di pengadilan Negeri Kalianda termasuk jajaran Pengadilan dengan Penggunaan E-court tebanyak. Perumusan Masalah dalam penelian ini yaitu Bagaimana Implementasi Peraturan Mahkamah Agung Nomor 7 Tahun 2022 Pasal 5 Ayat (1) di Pengadilan Negeri Kalianda? Dan Bagaimana Perspektif Siyasah Tanfidziyah terhadap Pelaksanaan Peraturan Mahkamah Agung Nomor 7 Tahun 2022 Pasal 5 Ayat (1)? Metode yang dipakai yaitu penelitian lapangan yang bersifat deskriptif Analis. Teori yang dipakai dalam penelitian ini adalah Teori Siyasah Tanfidziyah. Data yang didapatkan berasal dari Observasi, Wawancara, Peraturan, Buku, Jurnal, Arsip, dan penelitian terdahulu yang relevan dan lain-lain. Hasil Penelitian Menunjukan Bahwa Implementasi Peraturan Mahkamah Agung Nomor 7 Tahun 2022 Pasal 5 Ayat (1) tentang Layanan E-court , dilihat dari segi pelayanan sudah berjalan dengan baik akan tetapi dari segi pengguna layanan masih banyak yang tidak mengerti penggunaan aplikasi yang dibuat oleh Mahkamah Agung ini. Adapun perspektif Siyasah Tanfidziyah terhadap Pelaksanaan Peraturan Makamah Agung Nomor 7 Tahun 2022 Pasal 5 Ayah (1) tentang layanan E-court , itu sendiri mengganggap E-court sebagai sebuah Ijtihad yang baik untuk kemajuan peradapan masyarakat di zaman sekarang, membantu Pemerintah dalam menyelesaikan permasalahan yang dihadapi oleh masyarakat. ABSTRACT E-court is an innovation made by the Supreme Court to be a breakthrough in increasingly advanced technology. In addition, ensuring that everyone can solve legal problems in a decent, fast, and low cost. Kalianda District Court Class IB is a research place because from the beginning the Supreme Court issued a Supreme Court Regulation regarding E-court, the Kalianda district court became one of the courts that directly used the E-court application and in terms of services for the use of E-court in the Kalianda District Court, including the ranks of Courts with the most E-court Use. The formulation of the problem in this study is how to implement the implementation of Supreme Court Regulation Number 7 of 2022 Article 5 Paragraph (1) at the Kalianda District Court? And what is Siyasah Tanfidziyah's perspective on the implementation of Supreme Court Regulation Number 7 of 2022 Article 5 paragraph (1)? The method used is field research that is descriptive of Analysts. The theory used in this study is the Theory of Siyasah Tanfidziyah. The data obtained comes from observations, interviews, regulations, books, journals, archives, and relevant previous research and others. The results of the study show that the implementation of Supreme Court Regulation Number 7 of 2022 Article 5 Paragraph (1) concerning E-court Services, seen in terms of services, has gone well, but in terms of service users there are still many who do not understand the use of the application made by the Supreme Court. As for Siyasah Tanfidziyah's perspective on the Implementation of Mahkamah Agung Regulation Number 7 of 2022 Pasal 5 Ayat (1) regarding E-court services, it itself considers E-court as a good Jihad for the advancement of community civilization in today's era, helping the Government in solving problems faced by the community.
