Abstract

ABSTRAK Eksploitasi anak merupakan masalah global yang serius dan kompleks, melibatkan penyalahgunaan anak untuk keuntungan orang dewasa. Salah satu bentuk ekspolitasi pada anak yang marak terjadi adalah pekerja anak yang berjualan di lampu merah-lampu merah jalanan termasuk lampu merah di Jalan Sultan Agung Way Halim, Bandar Lampung. Peraturan Daerah Kota Bandar Lampung pasal 18 Nomor 02 Tahun 2016 menegaskan pentingnya melindungi dan memenuhi hak-hak anak. Anak dianggap sebagai aset bangsa yang harus dirawat dan dibina agar tumbuh menjadi generasi penerus yang berkualitas. Peraturan ini bertujuan untuk memastikan semua anak di Kota Bandar Lampung mendapatkan hak-haknya secara penuh, tanpa diskriminasi. Hak-hak tersebut meliputi kesempatan untuk tumbuh kembang secara optimal, baik fisik, mental, maupun sosial. Namun pada kenyataanya masih banyak di temukan kasus ekploitasi anak yang belum teratasi. Rumusan masalah pada penelitian ini adalah bagaimana Implementasi pasal 18 Peraturan Daerah Kota Bandar Lampung Nomor 2 Tahun 2016 tentang penyelenggaraan perlindungan anak terhadap anak yang dipekerjakan menjadi pedagang kaki lima di Jalan Sultan Agung Kecamatan Way Halim Kota Bandar Lampung dan bagaimana Tinjauan Fiqh Siyasah terhadap Implementasi Pasal 18 Peraturan Daerah kota Bandar Lampung Nomor 2 Tahun 2016 Tentang penyelenggaraan perlindungan anak terhadap anak yang dipekerjakan menjadi pedagang kaki lima di Jalan Sultan Agung Kecamatan Way Halim Kota Bandar Lampung. Tujuan dari penelitian ini adalah untuk mengetahui bagaimana Implementasi pasal 18 Peraturan Daerah Kota Bandar Lampung Nomor 2 Tahun 2016 tentang penyelenggaraan perlindungan anak terhadap anak yang dipekerjakan menjadi pedagang kaki lima di Jalan Sultan Agung Kecamatan Way Halim Kota Bandar Lampung dan bagaimana Tinjauan Fiqh Siyasah terhadap Implementasi Pasal 18 Peraturan Daerah kota Bandar Lampung Nomor 2 Tahun 2016 Tentang penyelenggaraan perlindungan anak terhadap anak yang dipekerjakan menjadi pedagang kaki lima di Jalan Sultan Agung Kecamatan Way Halim Kota Bandar Lampung. Penelitian ini bersifat deskriptif analisis, sumber data yang digunakan yaitu primer dan sekunder. Analisis data menggunakan analisis kualitatif. Hasil penelitian ini ditemukan bahwa Implementasi Pasal 18 Peraturan Daerah Nomor 2 tentang Penyelenggaraan Perlindungan Anak terhadap anak yang dipekerjakan menjadi pedagang kaki lima di Jalan Sultan Agung Wayhalim Bandar Lampung belum bisa dikatakan optimal, Dinas Pemberdayaan Perempuan dan Anak (DPPPA) dan Dinas Sosial (Dinsos) sudah berupaya semaksimal mungkin, namun masih terdapat beberapa hal yang perlu di atasi dan diperbaiki. Tinjauan fiqh siyasah terhadap peran Dinas Pemberdayaan Perempuan dan Perlindungan Anak dalam penerapan penyelenggaraan perlindungan anak di Jalan Sultan Agung Wayhalim Bandar Lampung berjalan dengan baik dan tidak melanggar kaidah hukum Islam maupun fiqh siyasah. Peran Dinas Pemberdayaan Perempuan dan Perlindungan Anak dalam melindungi anak memiliki landasan yang kuat dalam ajaran Islam, terutama terkait konsep khilafah, maslahat umum, dan perlindungan terhadap kelompok lemah. ABSTRACT Child exploitation is a serious and complex global issue involving the abuse of children for the benefit of adults. One form of child exploitation that is prevalent is child laborers selling goods at traffic lights, including those on Jalan Sultan Agung Way Halim, Bandar Lampung. Regulation of Bandar Lampung City, Article 18 of Regulation No. 02 of 2016 emphasizes the importance of protecting and fulfilling children's rights. Children are considered the nation's assets that must be nurtured and developed to grow into a quality future generation. This regulation aims to ensure that all children in Bandar Lampung City receive their full rights without discrimination. These rights include the opportunity to develop optimally, both physically, mentally, and socially. However, in reality, many cases of child exploitation remain unresolved. The research question in this study is how the implementation of Article 18 of Bandar Lampung City Regulation No. 2 of 2016 on the protection of children who are employed as street vendors on Jalan Sultan Agung, Way Halim District, Bandar Lampung City, and how Fiqh Siyasah reviews the implementation of Article 18 of Bandar Lampung City Regulation No. 2 of 2016 on the protection of children who are employed as street vendors on Jalan Sultan Agung, Way Halim District, Bandar Lampung City. the protection of children employed as street vendors on Sultan Agung Street in Way Halim District, Bandar Lampung City. The purpose of this study is to determine how Article 18 of Bandar Lampung City Regulation No. 2 of 2016 on the implementation of child protection for children employed as street vendors on Sultan Agung Street, Way Halim District, Bandar Lampung City is implemented and how Fiqh Siyasah reviews the implementation of Article 18 of Bandar Lampung City Regulation No. 2 of 2016 on the implementation of child protection for children employed as street vendors on Sultan Agung Street, Way Halim District, Bandar Lampung City. the protection of children employed as street vendors on Sultan Agung Street in Way Halim District, Bandar Lampung City. This research is descriptive and analytical in nature, using both primary and secondary data sources. Data analysis was conducted using qualitative analysis. The results of this study found that the implementation of Article 18 of Regional Regulation Number 2 concerning the Protection of Children who are employed as street vendors on Jalan Sultan Agung Wayhalim in Bandar Lampung cannot yet be considered optimal. The Women's Empowerment and Child Protection Agency (DPPPA) and the Social Affairs Agency (Dinsos) have made every effort, but there are still several issues that need to be addressed and improved. A review of fiqh siyasah regarding the role of the Women's Empowerment and Child Protection Agency in the implementation of child protection on Jalan Sultan Agung Wayhalim in Bandar Lampung is proceeding well and does not violate Islamic law or fiqh siyasah. The role of the Women's Empowerment and Child Protection Agency in protecting children has a strong foundation in Islamic teachings, particularly regarding the concepts of khilafah, public interest, and protection of vulnerable groups.
