Abstract
ABSTRAK Masyarakat di Banjar Negara Kecamatan Baradatu Kabupaten Way kanan sering melakukan kegiatan bagi hasil kebun kopi. Kebun kopi yang diserahkan oleh pemilik kebun kepada penggarap untuk dikelola. Pratik perjanjian kerja sama yang dilakukan dalam bagi hasil pengelolaan kebun kopi yaitu dengan menerapkan Musaqoh. Dalam pembagian hasil pengelolaan kebun kopi, pemilik kebun dan pengelola kebun tersebut kedua belah pihak harus sepakat dan adil. Pada penerapan bagi hasil yang dilakukan oleh pemilik kebun dan penggarap dengan cara membagi 50: 50 yaitu 50% untuk pemilik kebun dan 50% untuk pengelola, dengan biaya operasional yang di tanggung oleh kedua nya yang dipotong dari hasil panen kopi tersebut. Biaya operasional dalam mengelola kebun kopi berupa obat- obatan, pupuk, biaya giling kopi, dan biaya upah pekerja dalam memetik buah kopi tersebut. Rumusan masalah dari penelitian ini adalah untuk meninjau bagaimana praktik bagi hasil dalam pengelolaan kebun kopi di Kampung Banjar Negara Kecamatan Baradatu Kabupaten Way kanan, serta bagaimana tinjauan hukum ekonomi syariah terhadap praktik bagi hasil pengelolaan kebun kopi di Kampung Banjar Negara Kecamatan Baradatu Kabupaten Way Kanan. Tujuan dalam melakukan penelitian ini adalah untuk meninjau bagaimana praktik bagi hasil pengelolaan kebun kopi di Kampung Banjar Negara Kecamatan Baradatu Kabupaten Way Kanan serta mengetahui tinjuan hukum ekonomi syariah dalam bagi hasil pengelolaan kebun kopi di Kampung Banjar Negara Kecamatan Baradatu Kabupaten Way Kanan. Metode yang dipakai dalam penelitian ini ialah analisis kualitatif deskriptif dan penelitian lapangan (field research), sumber data yang yang dikumpulkan adalah data primer yaitu yaitu berupa data yang diambil dari informan penelitian yang terdiri dari 3 orang pemilik kebun dan 3 orang sebagai pengelola kebun kopi dengan cara pendekatan melalui wawancara, observasi, dan dokumentasi, sedangkan sumber data lainnya untuk menunjang didapatkan dari literatur dan ke pustakaan. Dari hasil penelitian diatas dapat disimpulkan bahwa pratik bagi hasil pengelolaa kebun kopi di Kampung Banjar Negara Kecamatan Baradatu Kabupaten Way Kanan, belum sesuai dengan syariat islam karena kerugian yang ditanggung oleh satu pihak jika hasil panen kopi tidak mencukupi biaya operasional maka penggarap mengeluarkan uang pribadi untuk menetupi biaya operasional yang kurang. Serta kurangnya saksi dalam melakukan perjanjian secara lisan yang sering menyebabkan kecurangan dalam praktik bagi hasil.ABSTRACT The community in Banjar Negara, Baradatu Subdistrict, Way kanan Regency often conducts coffee farm profit-sharing activities. The coffee plantation is handed over by the plantation owner to the cultivator to be managed. The practice of cooperation agreements carried out in the profit sharing of coffee plantation management is by applying Musaqoh. In the division of the results of the management of the coffee plantation, the owner of the garden and the manager of the garden both parties must agree and be fair. In the application of profit sharing carried out by garden owners and cultivators by dividing 50: 50, namely 50% for garden owners and 50% for managers, with operational costs borne by both of them deducted from the coffee harvest. Operational costs in managing a coffee plantation are in the form of medicines, fertilizers, the cost of grinding coffee, and the cost of wages for workers in picking the coffee fruit. The formulation of the problem of this research is to review how the practice of profit sharing in the management of coffee plantations in Banjar Negara Village, Baradatu District, Way Kanan Regency, and how the review of sharia economic law on the practice of profit sharing in the management of coffee plantations in Banjar Negara Village, Baradatu District, Way Kanan Regency. The purpose of this research is to review how the practice of profit sharing of coffee plantation management in Banjar Negara Village, Baradatu Subdistrict, Way Kanan Regency and to find out the sharia economic law review in profit sharing of coffee plantation management in Banjar Negara Village, Baradatu Subdistrict, Way Kanan Regency. The method used in this research is descriptive qualitative analysis and field research, the source of data collected is primary data, namely in the form of data taken from research informants consisting of 3 garden owners and 3 people as coffee garden managers by approaching through interviews, observation, and documentation, while other data sources to support are obtained from literature and library. From the results of the above research it can be concluded that the practice of profit sharing of coffee plantations in Banjar Negara Village, Baradatu District, Way Kanan Regency, is not in accordance with Islamic law because of the losses borne by one party if the coffee harvest does not cover operational costs, the cultivator spends personal money to cover the lack of operational costs. As well as the lack of witnesses in making oral agreements that often cause fraud in the practice of profit sharing.
