Abstract

ABSTRAK Permasalahan Para Pedagang selalu menjadi polemik dalam berbagai kalangan, baik kalangan masyarakat maupun kalangan pemerintah. Keberadaan para pedagang yang bejualan sembarangan dinilai cukup mengganggu ketertiban, kenyamanan, dan keindahan kota, salah satunya di Kabupaten Ogan Komering Ulu Timur. Salah satu kebijakan Pemerintahan Daerah Kabupaten Ogan Komering Ulu Timur dalam menangani masalah Pedagang yang kurang tertib, yaitu dengan Peraturan Daerah Kabupaten Ogan Komering Ulu Timur Nomor 33 Tahun 2008 Tentang Kebersihan, Ketertiban, dan Kesehatan Lingkungan, banyaknya para pedagang yang tidak mengindahkan peraturan pemerintah daerah seperti pada Pasal 40 ayat 1 huruf C yang mengatur pedagang untuk selalu menjaga dalam kebersihan, keindahan, ketentraman dan ketertiban lingkungan sekitarnya, serta berjualan atau berdagang sembarangan. Berdasarkan masalah tersebut peneliti ingin mengetahui Implementasi Pasal 40 Ayat 1 Huruf C Peraturan Daerah Kabupaten Ogan Komering Ulu Timur Nomor 33 Tahun 2008 Tentang Kebersihan, Keindahan, Ketertiban, dan Kesehatan Lingkungan di Kabupaten Oku Timur dan untuk mengetahui Perspektif Siyāsah Tanfidżiyyah terhadap Implementasi Pasal 40 Ayat 1 Huruf C Peraturan Daerah Kabupaten Ogan Komering Ulu Timur Nomor 33 Tahun 2008 Tentang Kebersihan, Keindahan, Ketertiban, dan Kesehatan Lingkungan di Kabupaten Ogan Komering Ulu Timur. Metode penelitian yang digunakan menggunakan pendekatan kualitatif yang sumber datanya diperoleh dari hasil wawancara dan dokumentasi pada bagian-bagian yang terlibat terhadap permasalahan diatas seperti aparat setempat dan masyarakat Kecamatan Martapura Kabupaten Ogan Komering Ulu Timur. Dan jenis penelitian ini adalah lapangan (field research). dengan melalui wawancara, dan mengambil dokumentasi langsung kepada masyarakat. Berdasarkan hasil penelitian dapat disimpulkan bahwa Implementasi Pasal 40 Ayat 1 Huruf c Peraturan Daerah Kabupaten Ogan Komering Ulu Timur Nomor 33 Tahun 2008 Tentang Kebersihan, Keindahan, Ketertiban, dan Kesehatan Lingkungan di Kabupaten Ogan Komering Ulu Timur telah berjalan dengan cukup efektif, serta sesuai dengan aturan yang telah berlaku dan melakukan berbagai upaya dalam menerapkan peraturan tersebut. Perspektif Siyāsah Tanfidżiyyah terhadap Implementasi Pasal 40 Ayat 1 Huruf C Peraturan Daerah Kabupaten Ogan Komering Ulu Timur Nomor 33 Tahun 2008 Tentang Kebersihan, Keindahan, Ketertiban, dan Kesehatan Lingkungan di Kabupaten Ogan Komering Ulu Timur pun sudah sesuai nilai nilai ajaran islam secara Siyāsah Tanfidżiyyah yang berkeadilan, meperhatikan kesejahteraan rakyatnya demi tercapainya kemaslahatan rakyat. The perspective of Siyāsah Tanfidżiyyah on the Implementation of Article 40 Paragraph 1 Letter C of the Regional Regulation of East Ogan Komering Ulu Regency Number 33 of 2008 concerning Cleanliness, Beauty, Order, and Environmental Health in East Ogan Komering Ulu Regency is also in accordance with the values of Islamic teachings in Siyāsah Tanfidżiyyah which is just, paying attention to the welfare of the people in order to achieve the benefit of the people. the benefit of the people.
