Abstract

ABSTRAK Penelitian ini ditujukan dalam rangka menganalisis Pelaksanaan pasal 20 Peraturan Kepala Kepolisian Negara Republik Indonesia Nomor 05 Tahun 2021 Tentang Penerbitan Dan Penandaan Surat Izin Mengemudi Persfektif Fiqh Siyasah Tanfidziyah dan Mengetahui pandangan Fiqh Siyasah Tanfidziyah tentang pelaksanaan Pasal 20 Peraturan Kepala Kepolisian Negara Republik Indonesia Nomor 05 Tahun 2021 Tentang pelaksanaan Penerbitan dan Penandaan Surat Izin Mengemudi. Penelitian dilaksanakan diSatlantas Metro. Polres Metode pengumpulan datanya mempergunakan field research dengan cara wawancara. Dalam menganalisis datanya diterapkan metode kualitatif yang tersaji melalui cara deskriptif. Temuan penelitian mengindikasikan, penerapan peraturan tersebut pada satlantas polres metro sudah sesuai pelaksanaannya dikarenakan beberapa Prinsip yaitu Prinsip Legalitas, Prinsip Tranparansi, Prinsip Nondiskriminasi, dan Prinsip Efektif dan Efesien; dan menurut pandangan Fiqh Siyasah Tanfidziyah tentang pelaksanaan Pasal 20 Peraturan Kepala Kepolisian Negara Republik Indonesia Nomor 05 Tahun 2021 Tentang pelaksanaan Penerbitan dan Penandaan Surat Izin Mengemudi sudah sesuai dengan prinsip pelayanan dalam Islam yang tercantum melalui siyasah tanfidziyah. Kata Kunci: Pelaksanaan, Surat Izin Mengemudi, Fiqh Siyasah Tanfidziyah. iii ABSTRACT This research aims to analyze the implementation of Article 20 of the Regulation of the Chief of the Indonesian National Police Number 05 of 2021 concerning the Issuance and Marking of Driver's Licenses from the perspective of Fiqh Siyasah Tanfidziyah and to understand the views of Fiqh Siyasah Tanfidziyah regarding the implementation of Article 20 of the Regulation of the Chief of the Indonesian National Police Number 05 of 2021 concerning the issuance and marking of Driver's Licenses. The research was conducted at the Traffic Unit of the Metro Police. The data collection method employed field research through interviews. In analyzing the data, a qualitative method was applied, presented in a descriptive manner. The findings of the research indicate that the implementation of the regulation at the Metro Police Traffic Unit is in accordance with several principles, namely the Principle of Legality, the Principle of Transparency, the Principle of Non-Discrimination, and the Principle of Effectiveness and Efficiency. Furthermore, according to the perspective of Fiqh Siyasah Tanfidziyah regarding the implementation of Article 20 of the Regulation of the Chief of the Indonesian National Police Number 05 of 2021 concerning the issuance and marking of Driver's Licenses, it is consistent with the principles of service in Islam as outlined in siyasah tanfidziyah.
