Abstract

ABSTRAK Ketidaktertiban masyarakat dalam membuang sampah terutama ke sungai dan pesisir pantai membuat lingkungan menjadi kotor seperti yang telah terjadi di Pekon Kuripan Kecamatan Pesisir Utara Kabupaten Pesisir Barat hal ini, tidak mencermikan adanya Pasal 12 Peraturan Daerah Kabupaten Pesisir Barat Nomor 12 Tahun 2017 Tentang Ketertiban Umum Dan Ketentraman Masyarakat. Dalam melakukan penertiban pembuangan sampah sembarangan ini yang sangat berperan adalah Pemerintah Pekon dan Masyarakat Pekon Kuripan. Adapun rumusan masalah dalam penelitian ini adalah Bagaimana Implementasi Pasal 12 Peraturan Daerah Kabupaten Pesisir Barat Nomor 12 Tahun 2017 tentang Ketertiban Umum dan Ketentraman Masyarakat di Pekon Kuripan Kecamatan Pesisir Utara Kabupaten Pesisir Barat? dan Bagaimana Tinjauan Fiqh Siyasah Tanfidziyah Terhadap Implementasi Pasal 12 Peraturan Daerah Kabupaten Pesisir Barat Nomor 12 Tahun 2017 tentang Ketertiban Umum dan Ketentraman Masyarakat di Pekon Kuripan Kecamatan Pesisir Utara Kabupaten Pesisir Barat?. Teori yang digunakan adalah Fiqh Siyasah Tanfidziyah tentang pelaksanaan suatu peraturan. Jenis penelitian merupakan penelitian lapangan (field research), dan sifat penelitian ini yaitu deskriptif analitis. Sumber data yang digunakan adalah jenis data primer dan sekunder. Metode pengumpulan data meliputi obeservasi, wawancara dan dokumentasi. Metode pengolahan data yaitu, reduksi data, penyajian data dan penarikan kesimpulan, kemudian analisis data menggunakan deskriptif kualitatif. Hasil penelitian menunjukkan bahwa Implementasi Pasal 12 Peraturan Daerah Kabupaten Pesisir Barat Nomor 12 Tahun 2017 Tentang Ketertiban Umum dan Ketentraman Masyarakat di Pekon Kuripan Kecamatan Pesisir Utara Kabupaten Pesisir Barat sudah terlaksana dalam bentuk sosialisasi, melakukan gotong royong, membuat bak sampah, dan pemasangan spanduk larangan membuang sampah dan berkoordinasi dengan pihak terkait. Namun, pelaksanaan tersebut belum berjalan secara optimal. Tinjauan Fiqh Siyasah Tanfidziyah Terhadap Implementasi Pasal 12 Peraturan Daerah Kabupaten Pesisir Barat Nomor 12 Tahun 2017 Tentang Ketertiban Umum dan Ketentraman Masyarakat di Pekon Kuripan Kecamatan Pesisir Utara Kabupaten Pesisir Barat pelaksanaan kebijakan ini belum sepenuhnya mencerminkan prinsip keadilan, pencegahan kerusakan. Karena, keterbatasan fasilitas seperti pembuatan bak sampah yang tidak terlalu besar dan kurang memadai serta rendahnya kesadaran dan kebiasaan masyarakat dalam membuang sampah di Pekon Kuripan, khususnya ke sungai dan pesisir pantai. Menyebabkan pelaksanaannya belum mampu memenuhi kemaslahatan umum. The theory used is Fiqh Siyasah Tanfidziyah about the implementation of a regulation. This type of research is field research, and the nature of this research is descriptive analytical. The data sources used are primary and secondary data types. Data collection methods include observation, interviews and documentation. Data processing methods, namely, data reduction, data presentation and conclusion drawing, then data analysis using qualitative descriptive. The results showed that the implementation of Article 12 of the Regional Regulation of West Pesisir Regency Number 12 of 2017 concerning Public Order and Community Peace in Pekon Kuripan, North Pesisir District, West Pesisir Regency has been carried out in the form of socialization, mutual cooperation, making garbage bins, and installing banners prohibiting littering and coordinating with related parties. However, the implementation has not run optimally. Review of Fiqh Siyasah Tanfidziyah on the Implementation of Article 12 of the Regional Regulation of West Pesisir Regency Number 12 of 2017 concerning Public Order and Community Peace in Pekon Kuripan, North Pesisir District, West Pesisir Regency, the implementation of this policy has not fully reflected the principles of justice, damage prevention. This is because of limited facilities such as the construction of garbage bins that are not too large and inadequate as well as the low awareness and habits of the community in disposing of garbage in Pekon Kuripan, especially into rivers and coastal areas.
