Abstract

Abstrak Pemenuhan pendidikan terhadap Penyandang Disabilitas bukan hanya dilihat dari sisi penerimaan ketika masuk di suatu lembaga pendidikan, tetapi juga harus dilihat sejauh mana lembaga pendidikan memberikan kebutuhan bagi penyandang disabilitas yang belajar di lembaga pendidikan tersebut, sebab hal tersebut telah dijamin oleh Undang-Undang Nomor 8 Tahun 2016 bahwa pemerintah dan masyarakat berkewajiban mengupayakan terpenuhinya hak-hak penyandang disabilitas. Perlu adanya kesadaran dari lembaga pendidikan yang menerima siswa berkebutuhan khusus agar sensitif terhadap penyandang disabilitas untuk melakukan pemenuhan kebutuhan dan aksesibilitas bagi penyandang disabilitas di lembaga pendidikan tersebut Penelitian ini membahas implementasi Pasal 9 Peraturan Daerah Provinsi Lampung Nomor 10 Tahun 2013 tentang Pelayanan dan Pemenuhan Hak-Hak Penyandang Disabilitas di SLB Kurnia Poncowati, Lampung Tengah, dalam perspektif Fiqh Siyasah Tanfidziyah. Penelitian ini merupakan jenis penelitian lapangan (field research) dan memiliki sifat penelitian yaitu pendekatan deskriptif kualitatif serta pengumpulan data dilakukan dengan cara observasi, wawancara, dan dokumentasi. Dinas Pendidikan dan Kebudayaan Kabupaten Lampung Tengah telah mulai menerapkan upaya pemenuhan hak pendidikan bagi penyandang disabilitas, sesuai dengan Peraturan Daerah Provinsi Lampung Nomor 10 Tahun 2013 tentang Pelayanan dan Pemenuhan Hak-Hak Penyandang Disabilitas. Salah satu bentuk implementasinya adalah pendirian Sekolah Luar Biasa yang memang ditujukan bagi anak-anak penyandang disabilitas. Dalam pelaksanaannya, dinas dan pihak sekolah telah berusaha memenuhi standar operasional pendidikan, termasuk penyediaan sarana, prasarana, serta tenaga pendidik yang sesuai untuk mendidik peserta didik berkebutuhan khusus. Dalam perspektif Fiqh Siyasah Tanfidziyyah, Dinas Pendidikan berperan sebagai pelaksana dari peraturan atau kebijakan yang telah ditetapkan oleh pemimpin (imam). Dalam konteks ini, Dinas Pendidikan dan Kebudayaan serta Sekolah Luar Biasa Kurnia Poncowati Kabupaten Lampung Tengah termasuk dalam kategori wizarah atau wazir, karena berperan dalam menjalankan serta mendukung implementasi kebijakan yang ditetapkan oleh pemimpin. Kata Kunci : Pemenuhan Pendidikan, Penyandang Disabilitas, Fiqh Siyasah Tanfidziyah Abstract Providing educational opportunities for people with disabilities is not only seen from the acceptance aspect of an educational institution, but also from the extent to which the educational institution meets the needs of those studying there. This is guaranteed by Law Number 8 of 2016, which mandates that the government and society are obligated to strive to fulfill the rights of people with disabilities. Educational institutions that accept students with special needs must be aware of their sensitivity to disabilities and ensure that they meet their needs and ensure accessibility within the institution. This study examines the implementation of Article 9 of Lampung Provincial Regulation Number 10 of 2013 concerning Services and Fulfillment of the Rights of Persons with Disabilities at the Kurnia Poncowati Special Needs School in Central Lampung, from the perspective of Islamic Fiqh (Islamic Law). This study is a field research study with a qualitative descriptive approach. Data collection is conducted through observation, interviews, and documentation. The Education and Culture Office of Central Lampung Regency has begun implementing efforts to fulfill the right to education for people with disabilities, in accordance with Lampung Provincial Regulation Number 10 of 2013 concerning Services and Fulfillment of the Rights of Persons with Disabilities. One form of implementation is the establishment of Special Schools specifically intended for children with disabilities. In its implementation, the office and schools have strived to meet educational operational standards, including the provision of facilities, infrastructure, and appropriate teaching staff to educate students with special needs. From the perspective of Fiqh Siyasah Tanfidziyyah, the Education Office plays a role as an implementer of regulations or policies that have been established by the leader (imam). In this context, the Education and Culture Office and the Kurnia Poncowati Special School of Central Lampung Regency are included in the category of wizarah or wazir, because they play a role in implementing and supporting the implementation of policies established by the leader.
