Abstract

ABSTRAK Pesatnya perkembangan ekonomi digital, termasuk dalam penyediaan jasa kebersihan melalui aplikasi. Aplikasi Maxim Cleaning menjadi salah satu platform yang menawarkan jasa kebersihan dengan skema kemitraan, di mana sistem upah menjadi aspek krusial yang perlu ditinjau. Penelitian ini dilatarbelakangi oleh kebutuhan untuk memahami mekanisme penetapan upah pada aplikasi ini dan menganalisis implikasinya dari perspektif syariah, khususnya terkait konsep keadilan ('adl) dan transparansi akad (ta'yīn al 'ujrah). Permasalahan utama yang diidentifikasi adalah sistem upah per order dengan tarif tetap Rp60.000,- per jam pada Maxim Cleaning, yang meskipun transparan dalam penghitungan, belum memiliki mekanisme otomatis untuk mengelola pekerjaan yang melebihi waktu yang dipesan. Kondisi ini memaksa pekerja untuk bernegosiasi langsung dengan konsumen, membuka potensi ketidakpastian (gharar) dan kerugian bagi pihak pekerja. Hal ini menimbulkan pertanyaan tentang bagaimana sistem upah tersebut selaras dengan prinsip akad ijarah dalam Islam, serta sejauh mana aspek keadilan upah dapat terpenuhi di tengah ketidakseimbangan beban kerja dan durasi pembayaran. Rumusan masalah pada penelitian ini adalah bagaimana sistem penetapan upah jasa kebersihan pada aplikasi Maxim Cleaning dan bagaimana tinjauan Hukum Ekonomi Syariah terhadap sistem penetapan upah jasa kebersihan pada aplikasi Maxim Cleaning. Jenis penelitian ini adalah penelitian lapangan (field research) yang bersifat deskriptif. Sumber data yang digunakan adalah data primer dan data sekunder yaitu melalui wawancara dan studi pustaka. Sedangkan metode analisa data yang digunakan adalah metode kualiatif dengan menggunakan pola berfikir induktif. Hasil penelitian menunjukkan bahwa sistem penetapan upah jasa kebersihan pada aplikasi Maxim Cleaning menggunakan skema pembayaran per order dengan tarif tetap, dan meskipun menawarkan transparansi dalam penghitungan upah per jam, kelemahan ditemukan ketika pekerjaan berlangsung melebihi waktu yang dipesan tanpa adanya sistem otomatis untuk menghitung kelebihan waktu. Tinjauan Hukum Ekonomi Syariah menunjukkan bahwa sistem ini secara umum telah sesuai dengan prinsip dasar Hukum Ekonomi Syariah seperti kejelasan akad (ijarah) dan transparansi upah (ta‟yīn al-„ujrah). Namun, sistem ini masih memiliki kekurangan dalam aspek keadilan upah („adl), terutama ketika beban kerja tidak sebanding dengan durasi waktu yang dipesan. Hal ini berpotensi menimbulkan ketidakjelasan (gharar) yang seharusnya dihindari dalam muamalah Islam, dan berimplikasi pada potensi kerugian bagi pekerja. ABSTRACT The rapid development of the digital economy, including in the provision of cleaning services through applications. The Maxim Cleaning application is one of the platforms that offers cleaning services with a partnership scheme, where the wage system is a crucial aspect that needs to be reviewed. This study is motivated by the need to understand the mechanism of wage determination in this application and analyze its implications from a sharia perspective, especially related to the concept of justice ('adl) and transparency of the contract (ta'yīn al-'ujrah). The main problem identified is the wage system per order with a fixed rate of IDR 60,000 per hour at Maxim Cleaning, which although transparent in calculation, does not yet have an automatic mechanism to manage work that exceeds the time ordered. This condition forces workers to negotiate directly with consumers, opening up the potential for uncertainty (gharar) and losses for workers. This raises questions about how the wage system is in line with the principles of the ijarah contract in Islam, and to what extent the aspect of wage justice can be fulfilled amidst the imbalance in workload and payment duration. The formulation of the problem in this study is how the cleaning service wage determination system works in the Maxim Cleaning application and how the Islamic Economic Law reviews the cleaning service wage determination system in the Maxim Cleaning application. This type of research is descriptive field research. The data sources used are primary data and secondary data, namely through interviews and literature studies. While the data analysis method used is a qualitative method using an inductive thinking pattern. The results of the study indicate that the cleaning service wage determination system in the Maxim Cleaning application uses a payment scheme per order with a fixed rate, and although it offers transparency in calculating hourly wages, weaknesses are found when the work lasts beyond the time ordered without an automatic system to calculate excess time. The Islamic Economic Law review shows that this system is generally in accordance with the basic principles of Islamic Economic Law such as clarity of contracts (ijarah) and transparency of wages (ta'yīn al-'ujrah). However, this system still has shortcomings in terms of wage fairness ('adl), especially when the workload is not comparable to the duration of time ordered. This has the potential to cause ambiguity (gharar) which should be avoided in Islamic transactions, and has implications for potential losses for workers.
