Abstract
ABSTRAK Penelitian ini membahas tentang analisis hukum ekonomi syariah terhadap konsumen yang tetap membeli produk yang sedang diboikot, khususnya produk yang dikaitkan dengan dukungan terhadap negara Israel, di Kelurahan Gunung Sulah, Bandar Lampung. Konflik ini bukan hanya tentang teritorial, tetapi juga melibatkan aspek politik, agama dan hak asasi manusia. Fenomena boikot ini muncul sebagai bentuk solidaritas umat Islam terhadap penderitaan rakyat Palestina, yang sudah dihimbau secara langsung lewat Fatwa MUI No.83 tahun 2023 tentang hukum dukungan terhadap perjuangan Palestina. Namun, masih ditemukan masyarakat yang memilih untuk tetap membeli produk-produk tersebut. Alasan-alasan yang dikemukakan antara lain karena faktor kebiasaan, kebutuhan, maupun ketidaktahuan. Adapun tujuan dari penelitian ini adalah untuk menganalisis perilaku konsumen tersebut melalui pendekatan hukum ekonomi syariah dengan menggunakan teori prinsip-prinsip jual beli, yaitu prinsip kebolehan, prinsip maṣlạḥah, prinsip keseimbangan, dan prinsip keadilan. Metode yang digunakan dalam penelitian ini adalah pendekatan kualitatif dengan jenis penelitian lapangan (field research). Data yang tertera diperoleh melalui wawancara dengan masyarakat Kelurahan Gunung Sulah Bandar Lampung, dan dokumentasi terhadap masyarakat setempat. Hasil penelitian menunjukkan adanya keragaman pendapat dari masyarakat Kelurahan Gunung Sulah Bandar Lampung. Dalam fenomena ini, sebagian masyarakat memiliki kesadaran terhadap isu boikot dan berupaya menghindarinya sebagai wujud solidaritas atau penolakan terhadap tindakan yang diasosiasikan dengan produk tersebut, dan sebagian yang lain masih tetap menggunakan produk-produk yang berafiliasi dengan Israel. Menurut pandangan fiqh mu’āmalah, jual beli produk yang diboikot pada dasarnya tetap sah selama tidak mengandung unsur haram dan dilakukan atas dasar kerelaan. Namun, dari sudut pandang prinsip maṣlạḥah dan keadilan, perilaku membeli produk yang secara langsung atau tidak langsung mendukung penindasan dinilai tidak sejalan dengan nilai-nilai Islam. Prinsip keseimbangan menuntut adanya kesadaran konsumen untuk mempertimbangkan aspek moral dan sosial dalam transaksi. Oleh karena itu, umat Islam diharapkan lebih selektif dalam memilih produk dengan mempertimbangkan dampaknya terhadap umat secara luas. ABSTRACT This research discusses the Islamic legal perspective on consumers who continue to purchase products currently under boycott, particularly those linked to support for the state of Israel, in Gunung Sulah Subdistrict, Bandar Lampung. This conflict is not only about territorial issues but also involves political, religious, and humatn rights aspects. The boycott phenomenon emerges as a form of solidarity among Muslims toward the suffering of the Palestinian people, which has been directly addressed through MUI Fatwa No. 83 of 2023 concerning the ruling on support for the Palestinian struggle. However, there are still members of the community who choose to continue purchasing these products. The reasons stated include habit, necessity, or lack of awareness. The purpose of this research is to analyze the behavior of these consumers through the lens of Islamic law using the theory of the principles of buying and selling, namely the principle of permissibility, the principle of maṣlaḥah (public interest), the principle of balance, and the principle of justice. The method used in this research is a qualitative approach with a type of field research. The data presented was obtained through interviews with the residents of Gunung Sulah Subdistrict, Bandar Lampung, and documentation of the local community. The research findings show a diversity of opinions among the people of Gunung Sulah. In this phenomenon, some residents are aware of the boycott issue and strive to avoid such products as a form of solidarity or rejection of actions associated with them. Others, however, continue to use products affiliated with Israel. From the perspective of Islamic commercial jurisprudence (fiqh mu’āmalah), purchasing these boycotted products remains valid as long as the transaction does not involve prohibited elements and is conducted with mutual consent. Nevertheless, from the standpoint of the principles of maṣlạḥah and justice, purchasing products that directly or indirectly support oppression is considered inconsistent with Islamic values. The principle of balance demands that consumers be conscious of the moral and social aspects of their transactions. Therefore, Muslims are expected to be more selective in choosing products by considering their broader impact on the ummah.
