Abstract

ABSTRAK Penelitian ini berjudul "Perlindungan Hukum terhadap Jual Beli Tanah Perspektif Hukum Positif dan Hukum Ekonomi Syariah" bertujuan untuk menganalisis perlindungan hukum yang diberikan kepada pihak pihak yang terlibat dalam transaksi jual beli tanah di Indonesia. Fokus utama penelitian ini adalah untuk mengevaluasi efektivitas regulasi hukum positif serta penerapan prinsip-prinsip hukum ekonomi syariah dalam memberikan perlindungan kepada pembeli dan penjual tanah, terutama dalam menghadapi praktik penyalahgunaan wewenang oleh mafia tanah. Rumusan masalah yang dibahas yaitu bagaimana perlindungan hukum terhadap hak anak dari istri kedua dalam kasus jual beli hak atas tanah warisan menurut perspektif hukum ekonomi syaraiah, serta bagaimana perlindungan hukum terhadap hak anak dari istri kedua dalam jual beli hak atas tanah warisan menurut perspektif hukum positif dan hukum ekonomi syaraiah. Metode penelitian yang digunakan adalah kualitatif dengan pendekatan induktif, yang memungkinkan peneliti untuk menarik kesimpulan umum dari fenomena khusus yang terjadi di lapangan. Data primer dikumpulkan melalui wawancara dengan pihak-pihak terkait, termasuk PPAT dan pembeli tanah, sedangkan data sekunder diambil dari dokumen hukum dan putusan pengadilan yang relevan. Penelitian menunjukkan ada kesenjangan dalam perlindungan hukum untuk hak anak dan istri kedua dalam jual beli tanah warisan di Indonesia. Hukum tidak diterapkan dengan baik, dan prinsip syariah belum diikuti. Ini menyebabkan sengketa tanah dan masalah dengan mafia tanah. Reformasi hukum diperlukan, termasuk memperkuat regulasi dan mendidik masyarakat tentang pentingnya melibatkan semua ahli waris dalam jual beli untuk mencegah konflik. It aims to analyze the legal protection provided to the parties involved in land sale and purchase transactions in Indonesia. The main focus of this study is to evaluate the effectiveness of positive legal regulations and the application of Islamic economic law principles in providing protection to land buyers and sellers, particularly in the face of abuse of power by land mafia. The research problem addressed is how legal protection is afforded to the rights of children from a second wife in cases of purchasing rights to inherited land according to the perspective of Islamic economic law, as well as how legal protection is provided to the rights of children from a second wife in the sale and purchase of inherited land rights from the perspective of positive law and Islamic economic law. The research method employed is qualitative with an inductive approach, allowing the researcher to draw general conclusions from specific phenomena occurring in the field. Primary data was collected through interviews with relevant parties, including land deed officials (PPAT) and land buyers, while secondary data was obtained from relevant legal documents and court decisions. The study reveals a gap in legal protection for the rights of children and second wives in the sale and purchase of inherited land in Indonesia. The law is not effectively enforced, and Islamic principles are not adequately followed. This leads to land disputes and issues with land mafia. Legal reform is necessary, including strengthening regulations and educating the public about the importance of involving all heirs in sales to prevent conflicts.
