Abstract

ABSTRAK Prinsip dasar penyelenggaraan pemerintahan dalam konsep Al Ahwal Al-Syakhsiyyah adalah terwujudnya kemaslahatan untuk keluarga, sehingga pemilihan kepala Desa sebagai proses atau mekanisme untuk memilih pemimpin seharusnya tidak menimbulkan dampak yang dapat merusak kerukunan hubungan suami istri yang selama ini menjadi ciri masyarakat pedesaan. Pelaksanaan Pilkades telah menyisakan berbagai persoalan baik yang berkaitan dengan proses maupun hasil pemilihan yang bila terus dibiarkan akan menimbulkan konflik horizontal di masyarakat. Sehingga diperlukan penataan kembali dalam proses penyelesaian sengketa Pelanggaran Pemilihan Kepala Desa. Penelitian ini merupakan penelitian kualitatif, dengan pendekatan sosiologis dan syar’i. Rumusan masalah dalam penelitian ini adalah Bagaimana dampak pemilihan kepala Desa terhadap kerukunan keluarga suami dan istri di Pekon Sukamara Kecamatan Bulok Kabupaten Tanggamus dan Bagaimana dampak pemilihan kepala Desa terhadap kerukunan keluarga suami dan istri di Pekon Sukamara Kecamatan Bulok Kabupaten Tanggamus dalam perspektif hukum Islam. Jenis penelitian lapangan adalah penelitian yang bertujuan untukmengumpulkan data dari lokasi atau lapangan. Penelitian lapangan juga bersifat fleksibel karena selama proses penelitian penulis diperbolehkan untuk memodifikasi rumusan masalah maupun format-format yang digunakan. Berdasarkan Hasil penelitian menunjukkan bahwa pemilihan kepala desa di Pekon Sukamara, Kecamatan Bulok, Kabupaten Tanggamus, dapat mempengaruhi kerukunan suami istri, terutama saat terjadi perbedaan pilihan politik. Beberapa pasangan dari 560 Kartu Keluarga mengalami ketegangan akibat perbedaan pandangan selama proses pemilihan bahkan 10 pasangan di antara nya sampai berujung pada perceraian. Namun, mayoritas pasangan yang memahami dan menerapkan ajaran hukum Islam, seperti musyawarah, kesabaran, dan saling menghormati, mampu mengatasi konflik tersebut dan menjaga keharmonisan rumah tangga. Dari perspektif hukum Islam, kerukunan keluarga merupakan nilai fundamental yang harus dijaga. Islam menekankan pentingnya musyawarah, silaturahmi, dan pengutamaan kebaikan bersama dalam menyelesaikan konflik, termasuk yang timbul akibat perbedaan politik. Dengan demikian, kerukunan keluarga perlu menjadi prioritas utama untuk menjaga stabilitas dan kesejahteraan rumah tangga, sekaligus memperkuat fondasi sosial dalam masyarakat. ABSTRACT The basic principle of government administration in the concept of Al-Ahwal Al-Syakhsiyyah is the realization of benefits for the family, so that the election of the village head as a process or mechanism to choose leaders should not have an impact that can damage the harmony of the relationship between husband and wife which has been a characteristic of rural communities. The implementation of the Pilkades has left various problems both related to the process and election results which, if left unchecked, will cause horizontal conflicts in society. So that it is necessary to rearrange in the process of resolving disputes over Village Head Election Violations. This research is a qualitative research, with a sociological and sharia approach. The formulation of the problem in this study is how the impact of the election of the village head on the harmony of husband and wife families in Pekon Sukamara, Bulok District, Tanggamus Regency and how the impact of the election of the village head on the harmony of husband and wife families in Pekon Sukamara, Bulok District, Tanggamus Regency in the perspective of Islamic law. This type of field research is research that aims to collect data from a location or field. Field research is also flexible because during the research process the author is allowed to modify the problem formulation and the formats used. In this case, the research was carried out by going directly to the research location in Pekon Sukamara, Bulok District, Tanggamus Regency. Based on the results of the study, it shows that the election of the village head in Pekon Sukamara, Bulok District, Tanggamus Regency, can affect the harmony of husband and wife, especially when there is a difference in political choices. Several couples from the 560 Family Membership Documents experienced tension due to differences of opinion during the election process, 10 of which even ended in divorce . However, the majority of couples who understand and apply the teachings of Islamic law, such as deliberation, patience, and mutual respect, are able to overcome these conflicts and maintain domestic harmony. A good understanding of Islamic teachings is an important factor in mitigating potential political conflicts in the family, so that the harmony between husband and wife is maintained despite differences in choices.
