Abstract

ABSTRAK Minuman keras selama ini telah menjadi penyebab berbagai tindak kejahatan di negeri ini. Kota Bandar lampung seharusnya sudah diberlakukan penerapan bagi penjual minuman keras untuk tidak lagi menjual minuman keras sejenis tuak dan minuman keras lainnya karena sangat meresahkan masyarakat terutama sangat berpengaruh untuk remaja, karena kebanyakan anak muda terjebak dalam pencandu minuman keras, hampir semua remaja kedapatan sedang kumpul-kumpul mabuk adalah mereka yang masih muda. Beberapa alasan anak-anak remaja lebih memilih tuak adalah karena mereka belum memiliki banyak uang untuk membeli minuman beralkohol lainnya. Adapun rumusan masalah dalam penelitian ini yaitu Bagaimana Peran Satuan Polisi Pamong Praja Dalam Menertibkan Pedagang Tuak Berdasarkan Perda No.1 Tahun 2018 Pasal 6 Ayat 2 Tentang Ketenteraman Masyarakat Dan Ketertiban Umum dan Bagaimana Tinjauan Fiqh Siya>sah Terhadap Peran Satuan Polisi Pamong Praja Dalam Menertibkan Pedagang Tuak. Sedangkan Tujuan dalam penelitian ini adalah untuk mengetahui dan menganalisa peran Satuan Polisi Pamong Praja Dalam Menertibkan Pedagang Tuak Berdasarkan Perda No.1 Tahun 2018 Pasal 6 Ayat 2 Tentang Ketenteraman Masyarakat Dan Ketertiban Umum, serta untuk Mengetahui dan Menganalisa Bagaimana Tinjauan Fiqh Siya>sah Terhadap Peran Satuan Polisi Pamong Praja Dalam Menertibkan Pedagang Tuak. Jenis penelitian ini adalah studi lapangan (field Research). Penelitian ini menggunakan metode kualitatif untuk mendeskripsikan permasalahan dan fokus penelitian. Dari segi sifat penelitian ini sendiri yaitu penelitian diskriptif kualitatif. Adapun kesimpulan dari penelitian ini yaitu Satpol PP dalam menjalankan peran dan tugasnya berdasarkan Perda No.1 Tahun 2018 Pasal 6 Ayat 2 Tentang Ketenteraman Masyarakat Dan Ketertiban Umum sudah sangat sesuai dengan peraturan tersebut. Meskipun terdapat faktor-faktor penghambat dalam menjalankan tugasnya, Satpol PP tetap berusaha untuk menjalankan amanah yang telah diberikan oleh Walikota, sedangkan menurut fiqh siya>sah Dalam pandangan fiqh siya>sah peran Satpol PP dalam menertibkan pedagang tuak sudah sejalan dengan prinsip pemerintahan dalam Islam yaitu al- amr bi al- ma’ruf wa al-nahy an al-munkar dan prinsip pelaksanaan hukum. Hal ini menunjukkan bahwa Satpol PP dalam menjalankan perannya sudah sesuai dengan fiqh siya>sah dan juga tidak melanggar syariat Islam yang berlaku. Satpol PP dalam menertibkan pedagang juga tidak menggunakan kekerasan yang bisa menimbulkan bahaya dan menyakiti orang lain. Kata Kunci : Satpol PP, Pedagang Tuak , Fiqh Siya>sah. ABSTRACT Alcoholic beverages have caused various crimes in this country. The city of Bandar Lampung should have implemented a regulation for liquor sellers to no longer sell alcoholic beverages such as tuak and other alcoholic beverages because they are very disturbing to the community, especially very influential for teenagers, because most young people are trapped in alcoholic beverage addiction, almost all teenagers caught hanging out drunk are those who are still young. Some of the reasons teenagers prefer tuak are because they don't have much money to buy other alcoholic beverages. The formulation of the problem in this study is How is the Role of the Civil Service Police Unit in Controlling Palm Wine Traders Based on Regional Regulation No. 1 of 2018 Article 6 Paragraph 2 Concerning Public Order and Public Order and How is the Fiqh siya>sah Review of the Role of the Civil Service Police Unit in Controlling Palm Wine Traders. While the purpose of this study is to determine and analyze the role of the Civil Service Police Unit in Controlling Palm Wine Traders Based on Regional Regulation No. 1 of 2018 Article 6 Paragraph 2 Concerning Public Order and Public Order, and to Determine and Analyze How is the Fiqh siyasah Review of the Role of the Civil Service Police Unit in Controlling Palm Wine Traders. This type of research is a field study. This study uses qualitative methods to describe the problems and focus of the research. This research uses qualitative methods to describe the problems and research focus. In terms of the nature of this research, it is qualitative descriptive research. The conclusion of this study is that Satpol PP in carrying out its role and duties Based on Regional Regulation No. 1 of 2018 Article 6 Paragraph 2 Concerning Public Order and Public Order is very much in accordance with the regulation. Although there are inhibiting factors in carrying out its duties, Satpol PP continues to strive to carry out the mandate given by the Mayor, while according to fiqh siya>sah In the view of fiqh siya>sah, the role of Satpol PP in controlling palm wine traders is in line with the principles of governance in Islam, namely al-amr bi al ma'ruf wa al-nahy an al-munkar and the principle of implementing the law. This shows that Satpol PP in carrying out its role is in accordance with fiqh Fiqh Siya>sah and also does not violate applicable Islamic law.
