Abstract

ABSTRAK Penelitian ini dilatar belakangi transaksi jual beli emas pada MiniGold Di Distributor Kota Bandar Lampung. Transaksi jual beli emas Minigold dengan sistem kredit yang dilakukan dengan cara memesan barang terlebih dahulu melalui distributor, penjual tidak menerapkan uang muka dan tidak memberikan tempo atau jangka waktu pelunasan sampai kapan pelunasan kredit tersebut berakhir tetapi terdapat penambahan harga setelah terjadi kesepakatan. Sedangkan diawal kesepakatan tidak dijelaskan mengenai adanya penambahan harga. Dan barang akan diserahkan diakhir setelah angsuran selesai. Apabila pembeli tidak dapat melunasi angsuran tersebut maka uang yang dibayarkan diawal akan hangus dan tidak mendapatkan barang. Penelitian ini bertujuan untuk menganalisis hukum Islam terhadap transaksi jual beli MiniGold secara kredit pada Distributor MiniGold Bandar Lampung, khususnya terkait penerapan sistem pembayaran. Rumusan masalah dalam penelitian ini adalah: (1) Bagaimana Sistem Penambahan Harga Dalam Transaksi Jual Beli Emas MiniGold Dengan Sistem Kredit Melalui Media Sosial Pada Distributor MiniGold Bandar Lampung? (2) Bagaimana Tinjauan Hukum Islam Terhadap Penambahan Harga Oleh Distributor Dalam Transaksi Jual Beli Emas MiniGold Dengan Sistem Kredit Melaui Media Sosial Pada Distributor Di Bandar Lampung? Penelitian ini bertujuan untuk mengetahui sistem penambahan yang digunakan dalam transaksi jual beli emas secara kredit dan untuk mengetahui tinjauan hukum Islam mengenai sistem penambahan harga dalam transaksi jual beli MiniGold secara kredit pada Distributor Bandar Lampung. Pada penelitian ini peneliti menggunakan metode penelitian lapangan (field research). Lokasi peneltian ini berada di Distributor MiniGold Bandar Lampung yang berada di Sukabumi dan Way Halim. Metode pengambilan data menggunakan metode observasi, wawancara, dan dokumentasi, kemudian dianalisis dengan metode deskriptif analisis melalui pola pikir deduktif. Penelitian ini menggunakan sumber data primer dan data sekunder yang diperoleh melalui hasil wawancara dengan para distributor dan konsumen yang pernah melakukan transaksi jual beli emas secara kredit dengan distributor tersebut. Hasil dari penelitian ini dapat disimpulkan bahwa sistem penambahan harga dalam transaksi jual beli emas MiniGold secara kredit tidak dijelaskan di dalam perjanjian sehingga ada ketidakjelasan dan tidak transparan dalam transaksi tersebut. Sedangkan dalam tinjauan hukum Islam penambahan harga dalam transaksi jual beli emas MiniGold tidak diperbolehkan sebab menambahkan harga dari harga sebenarnya mendekati dengan riba nasi’ah dan mengandung unsur ketidakpastian dalam transaksinya. Kata Kunci : Jual Beli Emas, MiniGold, Kredit, Hukum Islam. ABSTRACT This research was motivated by gold trading transactions at MiniGold Distributors in Bandar Lampung City. MiniGold gold trading transactions with a credit system were carried out by ordering goods in advance through a distributor. The seller did not apply a down payment and did not provide a deadline or a time limit for repayment until when the credit repayment would end, but there was an additional price after an agreement was reached. Meanwhile, at the beginning of the agreement, it was not explained regarding the additional price. And the goods would be handed over at the end after the installments were completed. If the buyer could not pay off the installments, the money paid at the beginning would be forfeited and they would not receive the goods. This study aimed to analyze Islamic law on MiniGold gold trading transactions on credit at MiniGold Distributors in Bandar Lampung, especially regarding the application of the payment system. The problem formulations in this study were: (1) How is the System of Adding Prices in MiniGold Gold Trading Transactions with a Credit System Through Social Media at MiniGold Distributors in Bandar Lampung? (2) How is the Islamic Law Review of the Price Increase by Distributors in MiniGold Gold Trading Transactions with a Credit System Through Social Media at Distributors in Bandar Lampung? This research aimed to determine the system of additional charges used in gold credit transactions and to examine the Islamic law perspective on the system of price increases in MiniGold credit transactions at Distributors in Bandar Lampung. In this study, the researcher used a field research method. The location of this research was at the MiniGold Distributor in Bandar Lampung, which is located in Sukabumi and Way Halim. The data collection method used observation, interviews, and documentation methods, then analyzed by descriptive analysis methods through a deductive mindset. This study used primary and secondary data sources obtained through interviews with distributors and consumers who had made gold trading transactions on credit with the distributor. The results of this study can be concluded that the system of adding prices in MiniGold gold trading transactions on credit was not explained in the agreement so there was a lack of clarity and transparency in the transaction. Meanwhile, in the view of Islamic law, the addition of prices in MiniGold gold trading transactions is not allowed because adding prices from the actual price is close to riba nasi'ah and contains elements of uncertainty in the transaction.
