Abstract
ABSTRAK Seiring berjalannya waktu kebutuhan hidup manusia akan mengalami peningkatan oleh adanya budaya konsumtif yang semakin meluas dimasyarakat yang mengakibatkan manusia melakukan transaksi jual beli kredit untuk memenuhi kebutuhan dengan biaya yang besar. Dalam hal ini PT FIFGROUP cabang Kedaton kota Bandar Lampung merupakan lembaga leasing yang menawarkan pembiayaan konvensional dan syariah bagi konsumen yang ingin membeli berbagai kebutuhan serta memberikan asuransi terkait jual beli kredit ialah berupa klaim asuransi atas barang kredit yang hilang. Dalam pembahasan ini pihak leasing menolak klaim asuransi pada konsumen yang kehilangan barang kredit, sehingga konsumen mengalami kekecewaan dan memutuskan tidak melunasi angsuran kredit tersebut. Rumusan masalah dalam penelitian ini adalah Bagaimana perlindungan konsumen atas barang kredit yang hilang di PT FIFGROUP cabang Kedaton kota Bandar Lampung? dan Bagaimana perlindungan konsumen atas barang kredit yang hilang perspektif hukum Islam dan hukum positif? Jenis penelitian yang digunakan ialah jenis penelitian lapangan (field research) dan sifat penelitian ini yaitu deskriptif kualitatif. Sumber data yang digunakan adalah jenis data primer dan data sekunder. Metode pengumpulan data meliputi, wawancara dan dokumentasi. Metode pengolahan data yaitu, edit dan sistematika data, kemudian data analisis dengan metode kualitatif. Berdasarkan hasil penelitian dapat disimpulkan, Pertama, Dalam pelaksanaan perlindungan konsumen pihak leasing sangat bertanggung jawab dalam memberikan klaim asuransi terhadap barang kredit yang hilang, tidak hanya itu pihak leasing juga memberikan solusi lain berupa pengajuan banding apabila alternatif yang pertama ditolak. Kedua, Berdasarkan penelitian bahwa pandangan hukum Islam dengan menggunakan teori murabahah dalam pelaksanaan perlindungan konsumen yaitu sudah sesuai dengan kompilasi hukum ekonomi syariah dalam Pasal 42 yaitu: “kewajiban memikul kerugian yang tidak disebabkan kesalahan satu pihak dinyatakan sebagai resiko”. Yakni sudah menjadi kewajiban konsumen sebagai pengguna asuransi ketika klaim asuransi dinyatakan ditolak dan tidak dapat mengajukan banding apabila terjadi kerugian berupa hilangnya barang kredit tersebut. Sedangkan pandangan hukum positif dalam pelaksanaan perlindungan konsumen yakni sudah sesuai dengan Pasal 19 ayat (1) dan ayat (2) Undang-undang No 8 Tahun 1999 tentang perlindungan konsumen yaitu ganti rugi sebagaimana yang dimaksud pada ayat (1) dan ayat (2) tidak berlaku apabila pelaku usaha dapat membuktikan bahwa kesalahan tersebut atas faktor penggelapan, hipnotis, penipuan, dan pencurian yang melibatkan keluarga atau kerabat tertanggung (konsumen). Kata Kunci: Perlindungan Konsumen, Barang Kredit, Perspektif Hukum Islam dan Hukum Positif. ABSTRACT As time goes by, human needs will increase due to the increasingly widespread consumer culture in society which results in people carrying out credit buying and selling transactions to meet their needs at large costs. In this case, PT FIFGROUP, Kedaton branch, Bandar Lampung city, is a leasing institution that offers conventional and sharia financing for consumers who want to buy various necessities and provides insurance related to credit buying and selling, namely in the form of insurance claims for lost credit goods. In this discussion, the leasing party rejected insurance claims from consumers who lost credit items, so that consumers experienced disappointment and decided not to pay off the credit installments. The problem formulation in this research is How is consumer protection for lost credit goods at PT FIFGROUP Kedaton branch, Bandar Lampung city? and How is consumer protection for credit goods missing from the perspective of Islamic law and positive law? The type of research used is field research and the nature of this research is descriptive qualitative. The data sources used are primary data and secondary data. Data collection methods include interviews and documentation. Data processing methods are editing and systematic data, then data analysis with qualitative methods. Based on the research results, it can be concluded, Firstly, in implementing consumer protection, the leasing party is very responsible in providing insurance claims for lost credit items, not only that, the leasing party also provides another solution in the form of filing an appeal if the first alternative is rejected. Second, based on research, the Islamic legal perspective using the murabahah theory in implementation of consumer protection is in accordance with the compilation of sharia economic law in Article 42, namely: "the obligation to bear losses that are not caused by the fault of one party is stated as a risk". Namely, it is the consumer's obligation as an insurance user when an insurance claim is declared rejected and cannot submit an appeal if a loss occurs in the form of the loss of the credit item. Meanwhile, the positive legal view in implementing consumer protection is that it is in accordance with Article 19 paragraph (1) and paragraph (2) of Law No. 8 of 1999 concerning consumer protection, namely that compensation as intended in paragraph (1) and paragraph (2) is not applies if the business actor can prove that the fault is due to embezzlement, hypnosis, fraud and theft involving the family or relatives of the insured (consumer).
