Abstract

ABSTRAK Penelitian ini berjudul Tinjauan Hukum Islam Dalam Penyelesaian Bagi Hasil Peternakan Tidak Sesuai Dengan Kesepakatan Awal di Kelurahan Waydadi Kecamatan Sukarame Kota Bandar Lampung. Latar belakang permasalahan ini karena tidak sesuai dengan kesepakatan awal bagi hasil dilakukan dalam bentuk uang, Rumusan masalah yang ada dalam penelitian ini adalah bagaimana sistem pelaksanaan pembagian bagi hasil hewan ternak ini masih terdapat sengketa dengan hukum Islam yang berlaku dalam Kelurahan Waydadi Kecamatan Sukarame Kota Bandar Lampung. Hal tersebut dikarenakan adanya suatu masalah pada pemilik ternak sehingga ingin mengambil kembali hewan ternaknya yang sudah dititipkan kepada pengelola sebelum waktunya. Metode yang digunakan dalam penelitian ini adalah metode pendekatan kualitatif, yaitu dengan menjelaskan, menjabarkan, dan menggambarkan yang ada, kemudian dianalisis dan ditarik kesimpulan. Penelitian ini termasuk penelitian lapangan (field research). Penelitian lapangan adalah penelitian yang dilakukan di lapangan khususnya dalam pengumpulan data, biasanya lokasi penelitian berada di masyarakat atau kelompok manusia tertentu dan objek tertentu. Teori yang saya gunakan adalah teori Muḍarabah Maka dalam hal ini lah peneliti secara langsung turun ke lapangan melakukan penelitian untuk mendapatkan data-data serta informasi di Desa Waydadi, Kecamatan Sukarame, Kota Bandar Lampung. Hasil analisis dari penelitian ini adalah penyelesaian dari ketidaksesuaian dengan perjanjian awal di pihak pemilik ternak pada pemelihara kambing di Kelurahan Waydadi Kecamatan Sukarame Bandar Lampung dilaksanakan dengan cara menjual hewan ternak tersebut yang kemudian menerapkkan sistem bagi hasil atas penjualan hewan ternak tersebut yang di mana pihak pemelihara seharusnya mendapatkan hasil dari ternakan kambing yang diurusnya tetapi dalam penerapannya pihak pemelihara tidak mendapatkan hasil apapun. Sistem penyelesaian dari ke tidak sesuaian dengan perjanjian awal di pihak pemilik ternak pada pemelihara kambing di Kelurahan Waydadi Kecamatan Sukarame Kota Bandar Lampung tidak sesuai dengan ajaran hukum Islam dikarenakan akad yang dilakukan tidak sesuai dengan perjanjian di awal. ABSTRACT This research is entitled Review of Islamic Law in Settlement of Livestock Production Sharing Not in Accordance with the Initial Agreement in Waydadi Village, Sukarame District, Bandar Lampung City. The background to this problem is because it is not in accordance with the initial agreement that profit sharing is carried out in the form of money. The formulation of the problem in this research is how the system for implementing the distribution of livestock results is still in dispute with the Islamic law that applies in Waydadi Village, Sukarame District, Bandar Lampung City. . This is because there is a problem with the livestock owner so he wants to take back his livestock which has been entrusted to the manager prematurely. The method used in this research is a qualitative approach, namely by explaining, describing and describing what exists, then analyzing it and drawing conclusions.This research includes field research. Field research is research conducted in the field, especially in data collection, usually the location of the research is in a certain community or group of people and certain objects. So in this case, the researcher directly went to the field to conduct research to obtain data and information in Waydadi Village, Sukarame District, Bandar Lampung City. The results of the analysis from this research are that the resolution of the non-conformity with the initial agreement on the part of the livestock owner to the goat keeper in Waydadi Village, Sukarame District, Bandar Lampung, is carried out by selling the livestock and then implementing a profit sharing system for the sale of the livestock, which the keeper should get results from the goat farming he manages but in practice the keeper does not get any results. The settlement system for non-compliance with the initial agreement on the part of livestock owners and goat keepers in Waydadi Village, Sukarame District, Bandar Lampung City is not in accordance with the teachings of Islamic law because the contract carried out is not in accordance with the initial agreement.
