Abstract

ABSTRAK Perlindungan konsumen terhadap praktik pengangkutan penumpang bus memegang peranan penting bagi terjaminnya perlindungan terhadap penumpang bus, pengemudi yang taat aturan, pelayanan yang baik, dan tanggung jawab perusahaan jasa untuk para konsumennya sangat di butuhkan oleh konsumen, untuk itu pengangkutan harus berjalan dengan aman dan nyaman agar roda perekonomian tidak terhambat. Dalam proses pengangkutan penumpang, seringkali perusahaan bus Raja Basa Utama trayek Rajabasa-Kota Agung tidak menaati aturan-aturan yang telah diatur dalam hukum Islam. Rumusan masalah yang diteliti dalam penelitian ini adalah Bagaimana bentuk perlindungan konsumen terhadap praktik pengangkutan penumpang bus Raja Basa Utama trayek Rajabasa-Kota Agung? dan bagaimana perlindungan konsumen terhadap praktik pengangkutan penumpang bus Raja Basa Utama trayek Rajabasa-Kota Agung dalam tinjauan hukum Islam?. Sedangkan tujuan dari penelitian ini adalah untuk mendeskripsikan dan menganalisis perlindungan konsumen terhadap praktik pengangkutan penumpang bus Raja Basa Utama trayek Rajabasa-Kota Agung dan untuk mengetahui perlindungan konsumen terhadap praktik pengangkutan penumpang bus Raja Basa Utama trayek Rajabasa-Kota Agung dalam tinjauan hukum Islam.Metode penelitian dalam penelitian ini adalah metode kualitatif deskriptif. Sumber data yang penulis gunakan terdiri dari sumber data primer yaitu diperoleh dari hasil observasi, wawancara, serta dokumentasi dan sumber data skunder diperoleh dari buku-buku, jurnal dan sumber online yang berkaitan dengan penelitian ini. Hasil dari penelitian ini dapat disimpulkan bahwa PO Raja Basa Utama memiliki bentuk perlindungan terhadap konsumen yang dirugikan apabila tidak mendapatkan fasilitas tempat duduk yaitu dengan memberi potongan harga dari harga normal untuk para penumpang yang berdiri dan bus Raja Basa Utama memberikan pertanggung jawaban atas kecelakaan lalu lintas berupa asuransi dari pihak PT Raharja. Dalam pelaksanaan perlindungan konsumen terhadap praktik pengangkutan penumpang bus dalam tinjauan hukum Islam pihak Raja Basa Utama trayek Rajabasa-Kota Agung sudah memenuhi ketentuan-ketentuan yang berlaku di dalam hukum Islam yaitu melalui Qiyas sumber hukum dalam Islam dengan membandingkan sesuatu yang ditetapkan hukumnya berdasarkan nash, maka peneliti ini memakai Maqaṣid Syari’ah, didalam Maqaṣid Syari’ah bus Raja Basa Utama sudah memenuhi aspek dharuriyat tetapi belum memenuhi aspek hajiyat karena penumpang masih mengalami kesulitan dan ketidak nyamanan dalam perjalanan. ABSTRACT Consumer protection against bus passenger transportation practices plays an important role in ensuring protection for bus passengers, drivers who obey the rules, good service, and the responsibility of service companies to their consumers is very much needed by consumers, for that transportation must run safely and comfortably so that the wheels of the economy are not hampered. In the process of transporting passengers, the Raja Basa Utama bus company on the Rajabasa-Kota Agung route often does not comply with the rules that have been regulated in Islamic law. The formulation of the problem studied in this study is How is the form of consumer protection against the practice of transporting passengers on the Raja Basa Utama bus on the Rajabasa-Kota Agung route? and how is consumer protection against the practice of transporting passengers on the Raja Basa Utama bus on the Rajabasa-Kota Agung route in the perspective of Islamic law?. While the purpose of this study is to describe and analyze consumer protection against the practice of transporting passengers on the Raja Basa Utama bus on the Rajabasa-Kota Agung route and to determine consumer protection against the practice of transporting passengers on the Raja Basa Utama bus on the Rajabasa-Kota Agung route in the perspective of Islamic law. The research method in this study is a descriptive qualitative method. The data sources that the author uses consist of primary data sources, namely obtained from the results of observations, interviews, and documentation and secondary data sources obtained from books, journals and online sources related to this study. The results of this study can be concluded that PO Raja Basa Utama has a form of protection for consumers who are disadvantaged if they do not get seating facilities, namely by giving discounts from the normal price for standing passengers and the Raja Basa Utama bus provides liability for traffic accidents in the form of insurance from PT Raharja. In implementing consumer protection against the practice of transporting bus passengers in the review of Islamic law, the Raja Basa Utama route Rajabasa-Kota Agung has fulfilled the provisions applicable in Islamic law, namely through Qiyas sources of law in Islam by comparing something that is determined by law based on texts, so this researcher uses Maqaṣid Syari'ah, in Maqaṣid Syari'ah the Raja Basa Utama bus has fulfilled the dharuriyat aspect but has not fulfilled the hajiyat aspect because passengers still experience difficulties and discomfort during the trip.
