Abstract

ABSTRAK Undang-Undang Nomor 16 Tahun 2011 pasal 1 ayat (1) Tentang Bantuan Hukum menyebutkan bahwa Bantuan Hukum adalah jasa hukum yang diberikan oleh Pemberi Bantuan Hukum secara cuma-cuma kepada Penerima Bantuan Hukum. Rumusan masalah dalam penelitian ini adalah: (1) Bagaimana Peranan Lembaga Bantuan Hukum Tehadap Implementasi Undang-Undang Nomor 16 Tahun 2011 Pasal 1 Ayat (1) Tentang Bantuan Hukum (Studi Lembaga Konsultasi Bantuan Hukum UIN Raden Intan Lampung)? Bagaimana Perspektif Fiqh Siyasah Tanfidziyah Peranan Lembaga Bantuan Hukum Tehadap Implementasi Undang-Undang Nomor 16 Tahun 2011 Pasal 1 Ayat (1) Tentang Bantuan Hukum (Studi Lembaga Konsultasi Bantuan Hukum UIN Raden Intan Lampung)? Jenis metode penelitian yang digunakan ialah jenis penelitian lapangan (field research) dengan sifat penelitian Deskripstif Analisis. sumber data dalam penelitian ini: Sumber data primer dan Sumber data sekunder. Adapun populasi dalam Penelitian ini yaitu seluruh pengurus, Advokat, Konsultan, staf dan penerima bantuan hukum Lembaga Konsultasi Bantuan Hukum UIN Raden Intan Lampung. Sedangkan sampel sebanyak 11 orang. Teknik pengumpulan data dilakukan dengan metode wawancara, observasi, dan dokumentasi. Hasil penelitian ini ialah: (1) Peranan Lembaga Konsultasi Bantuan Hukum UIN Raden Intan Lampung sudah sesuai Terhadap Impelemtasi Undang-Undang Nomor 16 Tahun 2011 pasal 1 ayat (1) Tentang Bantuan hukum dengan melaksanakan konsultasi hukum secara cuma-cuma merujuk kepada Tri Dharma Perguruan Tinggi dan dilaksanakan dalam praktek konsultasi. (2) Menurut perspektif fiqh siyasah Tanfidziyah tidak bertentangan dengan hukum islam, mengingat dalam melaksanakan penyelenggaraan bantuan hukum sudah sesuai dengan prinsip tolong menolong, keadilan, dan persamaan. Lembaga Konsultasi Bantuan Hukum UIN Raden Intan Lampung Memberi bantuan hukum disetiap tingkatan, memberi penjelasan tentang hukum kepada masyarakat pencari keadilan. ABSTRACT Law Number 16 of 2011 article 1 paragraph (1) concerning Legal Aid states that Legal Aid is legal services provided by Legal Aid Providers free of charge to Legal Aid Recipients. The formulation of the problem in this research is: (1) What is the role of Legal Aid Institutions in the Implementation of Law Number 16 of 2011 Article 1 Paragraph (1) Concerning Legal Aid (Study of the Legal Aid Consultation Institute at UIN Raden Intan Lampung)? What is the Fiqh Siyasah Tanfidziyah Perspective on the Role of Legal Aid Institutions in the Implementation of Law Number 16 of 2011 Article 1 Paragraph (1) Concerning Legal Aid (Study of the Legal Aid Consultation Institute at UIN Raden Intan Lampung)? The type of research method used is field research with the nature of descriptive analysis research. Data sources in this research: Primary data sources and secondary data sources. The population in this research is all administrators, advocates, consultants, staff and legal aid recipients of the UIN Raden Intan Lampung Legal Aid Consultation Institute. Meanwhile, the sample was 5 people. Data collection techniques were carried out using interview, observation and documentation methods. The results of this research are: (1) The role of the UIN Raden Intan Lampung Legal Aid Consultation Institute in implementing Law Number 16 of 2011 concerning Legal Aid, namely that it is not yet in accordance with what has been determined by Law Number 16 of 2011 Article 1 Paragraph 1 states that legal aid is provided free of charge by legal aid providers to free legal aid recipients.(2) According to the fiqh perspective, siyasah does not conflict with Islamic law, considering that the implementation of legal aid is in accordance with the principles of mutual assistance, justice and equality. UIN Raden Intan Lampung Legal Aid Consultation Institute Provides legal assistance at every level, providing explanations about the law to people seeking justice.
