Abstract

ABSTRAK Permasalahan dalam penelitian ini adalah pertama, bagaimana bentuk perjanjian kerja antara PT. Telkom Akses dengan pekerja outsourcing sebagai mitra kerja. Kedua, bagaimana tinjauan hukum Islam terhadap kerja sama yang terjadi antara antara PT. Telkom Akses sebagai pemilik modal dan pekerja outsourcing sebagai pemilik pekerjaan jika dilihat dari jaminan keselamatan kerja. Tujuan penelitian ini adalah untuk mengkaji pelaksanaan perjanjian kerja sama antara pemilik perusahaan Telkom Akses dengan pekerja outsourcing atau Mitra Kerja sebagai pemilik pekerjaan dan mengkaji tinjauan hukum Islam terhadap kerja sama yang terjadi antara perusahaan Telkom akses sebagai pemilik modal dan pekerja outsourcing sebagai pemilik pekerjaan jika dilihat dari jaminan keselamatan kerja. Penelitian ini merupakan penelitian lapangan (field research) yang bersifat deskriptif analisis. Sumber data yang digunakan data primer dan data sekunder, yaitu melalui wawancara dan studi pustaka. Metode pengumpulan data yang digunakan adalah observasi, wawancara dan dokumentasi. Adapun analisa datanya yaitu kualitatif dengan pendekatan berpikir induktif. Berdasarkan hasil penelitian, Perjanjian kerja antara PT. Telkom Akses dengan pekerja outsourcing sebagai mitra kerja sudah terlaksana sesuai dengan Undang –Undang Nomor 1 tahun 1970 tentang keselamatan kerja dan Undang-Undang Nomor 19 tahun 2016 akan tetapi PT. Telkom Akses masih belum maksimal dalam pertanggung jawaban saat terjadi kecelakaan sehingga pekerja yang harus bertanggung jawab atas risiko saat bekerja. Dalam Islam dikatakan bahwa hal tersebut merupakan salah satu bentuk kezhaliman di tengah masyarakat muslim. Kata Kunci: Tanggung Jawab Resiko Kerja, Bentuk Perjanjian Kerja, Outsourcing. ABSTRACT The problems in this study are first, what is the form of the work agreement between PT. Telkom Akses and outsourcing workers as work partners. Second, how is the Islamic law review of the cooperation that occurs between PT. Telkom Akses as the owner of capital and outsourcing workers as the owner of the work when viewed from the guarantee of work safety. The purpose of this study is to examine the implementation of the cooperation agreement between the owner of the Telkom Akses company and outsourcing workers or Work Partners as the owner of the work and to examine the Islamic law review of the cooperation that occurs between the Telkom Akses company as the owner of capital and outsourcing workers as the owner of the work when viewed from the guarantee of work safety. This research is a field research that is descriptive analysis. The data sources used are primary data and secondary data, namely through interviews and literature studies. The data collection methods used are observation, interviews and documentation. The data analysis is qualitative with an inductive thinking approach. Based on the results of the study, the work agreement between PT. Telkom Akses and outsourcing workers as work partners has been implemented in accordance with Law Number 1 of 1970 concerning work safety and Law Number 19 of 2016, but PT. Telkom Akses is still not optimal in its responsibility when an accident occurs so that workers must be responsible for the risks while working. In Islam it is said that this is a form of injustice in the midst of Muslim society. Keywords: Responsibility for Work Risks, Form of Work Agreement, Outsourcing.
