Abstract

ABSTRAK Pada dasarnya suatu kota atau daerah tertentu terdapat peraturan daerah yang mengatur tata ruang dan estetika kota guna menjaga keindahan lingkungan. Salah satu aturan yang biasanya diatur adalah terkait dengan pemasangan reklame atau pamflet, termasuk tempat tempat yang diperbolehkan atau tidak diperbolehkan untuk dipasangi pamflet. Karna hal itu Pemerintah Daerah Kota Bandar Lampung menerbitkan Pasal 16 huruf K Peraturan Daerah Nomor 01 Tahun 2018 Tentang Ketentraman Masyarakat dan Ketertiban Umum. Rumusan masalah dalam skripsi ini adalah Bagaimana Implementasi Pasal 16 Huruf K Peraturan Daerah Kota Bandar Lampung Nomor 01 Tahun 2018 Tentang Ketentraman Masyarakat Dan Ketertiban umum dan Bagaimana Implementasi Pasal 16 huruf K Peraturan Daerah Kota Bandar Lampung Nomor 01 Tahun 2018 Tentang Ketentraman Masyarakat dan Ketertiban Umum pada Satuan Polisi Pamong Praja Kota Bandar Lampung berdasarkan perspektif Fiqh Siyāsah Tanfīżiyyah. Tujuan penelitian dalam skripsi ini adalah untuk mengetahui Bagaimana Implementasi Pasal 16 Huruf K Peraturan Daerah Kota Bandar Lampung Nomor 01 Tahun 2018 Tentang Ketentraman Masyarakat Dan Ketertiban Umum dan untuk mengetahui Bagaimana Implementasi Pasal 16 huruf K Peraturan Daerah Kota Bandar Lampung Nomor 01 Tahun 2018 Tentang Ketentraman Masyarakat dan Ketertiban Umum pada Satuan Polisi Pamong Praja Kota Bandar Lampung berdasarkan perspektif Fiqh Siyāsah Tanfīżiyyah. Hasil dari penelitian ini dapat disimpulkan Implementasi Pasal 16 Huruf K Peraturan Daerah Kota Bandar Lampung Nomor 01 Tahun 2018 Tentang Ketentraman Masyrakat Dan Ketertiban Umum yang dilakukan SATPOL PP dalam pelaksanaan penertiban pamflet sudah terlaksana tetapi hanya sebagian. Berdasarkan perspektif Fiqh Siyāsah Tanfīżiyyah, sebagai wazir al – tanfidz belum sesuai dalam melaksanakan tugas dikarenakan penertiban pamflet pada pohon hanya pada jalan protokol serta sosialisasi pada para pelaku usaha untuk pemasangan pamflet yang baik dan tepat belum pernah terlaksana. Berdasarkan siyāsah qaḍā`iyyah dalam penegakan hukumnya termasuk dalam qaḍā hisbah karena termasuk pelanggaran ringan maka dari itu SATPOL PP melakukan penertiban langsung dengan mencabut pamflet yang dipaku di pohon Dalam asas – asas amanat, asas keadilan, asas ketaataan dan asas musyawarah juga belum sesuai sedangkan dalam Fiqh Siyāsah Tanfīżiyyah Undang – Undang yang sudah dibuat wajib untuk ditaatin demi kemashlahatan masyarakat. ABSTRACT Basically, in a certain city or region there are regional regulations that regulate the spatial planning and aesthetics of the city in order to maintain the beauty of the environment. One of the rules that is usually regulated is related to the display of advertisements or pamphlets, including places where pamphlets are permitted or not permitted. Because of this, the Bandar Lampung City Regional Government issued Article 16 letter K of Regional Regulation Number 01 of 2018 concerning Community Peace and Public Order. The formulation of the problem in this thesis is How to Implement Article 16 Letter K of Bandar Lampung City Regional Regulation Number 01 of 2018 concerning Community Peace and Public Order and How to Implement Article 16 letter K of Bandar Lampung City Regional Regulation Number 01 of 2018 concerning Public Peace and Public Order in Bandar Lampung City Civil Service Police Unit based on the Fiqh Siyāsah perspective Tanfīżiyyah. The aim of the research in this thesis is to find out how to implement Article 16 Letter K of Bandar Lampung City Regional Regulation Number 01 of 2018 concerning Community Peace and Public Order and to find out How to Implement Article 16 letter K of Bandar Lampung City Regional Regulation Number 01 of 2018 concerning Public Order and Public Order in the Bandar Lampung City Civil Service Police Unit based on the Fiqh Siyāsah perspective Tanfīżiyyah. This research includes field research. The results of this research can be concluded that the implementation of Article 16 Letter K of Bandar Lampung City Regional Regulation Number 01 of 2018 concerning Community Peace and Public Order carried out by SATPOL PP in implementing pamphlet control has been implemented but only partially. Based on the perspective of Fiqh Siyāsah Tanfīżiyyah, as vizier al - tanfidz it is not appropriate to carry out his duties because controlling pamphlets on trees only on protocol roads and outreach to business actors to install pamphlets properly and appropriately has never been carried out. Based on the siyāsah qaḍā`iyyah in law enforcement, it is included in the qaḍā hisbah because it is a minor violation, therefore SATPOL PP carries out direct control by removing pamphlets nailed to trees. In the principles of mandate, the principle of justice, the principle of obedience and the principle of deliberation are also not appropriate, whereas in Fiqh Siyāsah Tanfīżiyyah Laws that have been made must be obeyed for the benefit of society.
