Abstract

ABSTRAK Dalam menegakkan kedisplinan, Pemerintah memiliki Peraturan Pemerintah Nomor 94 Tahun 2021 Tentang Displin Pegawai Negeri Sipil, hal ini dimaksudkan untuk mendidik dan membina Pegawai Negeri Sipil agar tidak melakukan pelanggaran atas kewajiban dan larangan. Pemberian hukuman disiplin kerja bagi PNS tercantum dalam Pasal 8 Peraturan Pemerintah Nomor 94 Tahun 2021 Tentang Displin Pegawai Negeri Sipil. Pegawai dikatakan disiplin jika memenuhi tiga faktor, yaitu menaati waktu kerja, melakukan pekerjaan dengan baik, mematuhi semua peraturan dan norma sosial. Penelitian ini bertujuan untuk mengetahui pelaksanaan pasal 8 Peraturan Pemerintah Nomor 94 Tahun 2021 Tentang Displin Pegawai Negeri Sipil di Sekolah Menengah Atas Negeri 8 Kota Bandar Lampung. Jenis metode penelitian ini ialah penelitian lapangan (field research), sifat penelitian deskripstif analisis. Sumber data berupa data primer dan data sekunder. Teknik pengumpulan data dilakukan dengan wawancara, observasi, dan dokumentasi. Teknis analisis data melalui pemeriksaan data, sistematisasi data, dan kesimpulan. Hasil penelitian ini ialah (1) Implementasi Pasal 8 Peraturan Pemerintah Nomor 94 Tahun 2021 tentang Disiplin Pegawai Negeri Sipil di Sekolah Menengah Atas Negeri 8 Kota Bandar Lampung diberikan kepada pegawai negeri sipil yang melakukan pelanggaran kedisiplinan berupa displin waktu, disiplin berpakaian, disiplin kualitas kerja, disiplin peraturan dan disiplin perilaku. Hukuman tersebut yakni hukuman disiplin ringan yang berupa teguran lisan, teguran tertulis dan pernyataan tidak puas secara tertulis. Hukuman disiplin sedang yang berupa pemotongan tunjangan kinerja sebesar 25% (dua puluh lima persen) selama 6 (enam) bulan, pemotongan tunjangan kinerja sebesar 25% (dua puluh lima persen) selama 9 (sembilan) bulan dan pemotongan tunjangan kinerja sebesar 25% (dua puluh lima persen) selama 12 (dua belas) bulan. Hukuman disiplin berat berupa penurunan jabatan setingkat lebih rendah selama 12 (dua belas) bulan, pembebasan dari jabatannya menjadi jabatan pelaksana selama 12 (dua belas) bulan dan pemberhentian dengan hormat tidak atas permintaan sendiri sebagai PNS. (2) Tinjauan Fiqh Siyāsah Terhadap Implementasi Pasal 8 Peraturan Pemerintah Nomor 94 Tahun 2021 Tentang Disiplin Pegawai Negeri Sipil di Sekolah Menengah Atas Negeri 8 Kota Bandar Lampung telah sesuai dengan prinsip hakikat Siyāsah Tanfīżiyyah, yakni prinsip keadilan, prinsip jujur, prinsip profesional dan prinsip amanah. Implementasi ini dinilai cukup tegas dan mampu memberikan efek jera terhadap oknum yang kerap melakukan pelanggaran. Kata Kunci: Displin, Pegawai, Negeri, Sipil. ABSTRACT In enforcing discipline, the Government has Government Regulation Number 94 of 2021 concerning Civil Servant Discipline, this is intended to educate and foster Civil Servants so that they do not violate obligations and prohibitions. The imposition of work disciplinary sanctions for Civil Servants is stated in Article 8 of Government Regulation Number 94 of 2021 concerning Civil Servant Discipline. Employees are said to be disciplined if they meet three factors, namely obeying working hours, doing their jobs well, obeying all regulations and social norms. This study aims to determine the implementation of Article 8 of Government Regulation Number 94 of 2021 concerning Civil Servant Discipline at State Senior High School 8, Bandar Lampung City. The type of research method is field research, the nature of the research is descriptive analysis. Data sources are in the form of primary data and secondary data. Data collection techniques were carried out through interviews, observations, and documentation. Data analysis techniques through data examination, data systematization, and conclusions. The results of this study are (1) Implementation of Article 8 of Government Regulation Number 94 of 2021 concerning Civil Servant Discipline at State Senior High School 8 of Bandar Lampung City is given to civil servants who commit disciplinary violations in the form of time discipline, dress discipline, work quality discipline, regulation discipline and behavioral discipline. The punishments are light disciplinary punishments in the form of verbal warnings, written warnings and written statements of dissatisfaction. Medium disciplinary punishments in the form of a 25% (twenty five percent) reduction in performance allowances for 6 (six) months, a 25% (twenty five percent) reduction in performance allowances for 9 (nine) months and a 25% (twenty five percent) reduction in performance allowances for 12 (twelve) months. Severe disciplinary punishments in the form of demotion to a lower level for 12 (twelve) months, release from office to an acting position for 12 (twelve) months and honorable dismissal not at one's own request as a civil servant. (2) Review of Fiqh Siyāsah on the Implementation of Article 8 of Government Regulation Number 94 of 2021 Concerning Civil Servant Discipline at State Senior High School 8, Bandar Lampung City has been in accordance with the principles of the essence of Siyāsah Tanfīżiyyah, namely the principle of justice, the principle of honesty, the principle of professionalism and the principle of trustworthiness. This implementation is considered quite firm and is able to provide a deterrent effect on individuals who often commit violations. Keywords: Discipline, Employees, State, Civil.
