Abstract
ABSTRAK Setiap kekayaan yang sudah mencapai Nishab adalah wajib dizakati. Batu akik adalah salah satu komoditi yang memiliki harga cukup tinggi, dan semestinya pemiliknya mengeluarkan zakat batu akik sebagai zakat maal. Meskipun demikian, menurut fiqh Islam batu-batuan tidak wajib untuk dizakati. Adapun ulama mazhab berbeda pendapat tentang zakat batu akik tersebut menurut empat mazhab. Rumusan masalah dalam penelitian ini adalah bagaimana metode istinbath hukum Ulama Mazhab tentang zakat batu akik? Dan bagaimana persamaan dan perbedaan pendapat Ulama Mazhab tentang zakat batu akik?. Adapun tujuan penelitian ini adalah untuk mengetahui metode istinbath hukum Ulama Mazhab terkait penentuan Zakat batu akik dan untuk mengetahui persamaan serta perbedaan pendapat tentang zakat batu akik menurut Ulama Mazhab. Penelitian ini adalah penelitian studi kepustakaan, dengan pendekatan masalah deskriptif analisis komparatif, mengenai pandangan empat Mazhab tentang zakat batu akik dan dianalisa untuk mencari sebab yang melatar belakangi pandangan diantara keempat Mazhab tersebut. Penelitian ini menggunakan teknik pengumpulan data melalui riset kepustakaan, yaitu mengumpulkan data penelitian dengan cara membaca dan menelaah sumber-sumber data baik kitab-kitab, buku-buku, majalah majalah, dan sumber bacaan lainnya untuk menjawab masalah-masalah terkait dengan penelitian ini yaitu pandangan empat Mazhab tentang zakat batu akik, mencari sebab yang melatar belakangi pandangan diantara keempat Mazhab tersebut. Hasil penelitian menunjukkan bahwa menurut Madzhab Maliki, barang tambang itu terbagi menjadi dua bagian. Pertama, yang diperoleh melalui usaha yang berat, tentang hal itu sudah ada kesepakatan bahwa hanya dikenakan zakat biasa. Kedua, yang diperoleh tanpa usaha yang berat. Dalam hal ini Mazhab Maliki tidak punya pendapat tegas. Mazhab Maliki mengatakan bahwa besar zakatnya 2,5% sama dengan zakat uang. Menurut Mazhab Hanafi zakat yang wajib dikeluarkan hanya pada barang tambang beku yang bisa meleleh dan terbentuk dengan menggunakan api, dengan besaran zakatnya yaitu seperlima atau 2,5%. Mazhab Syafi’i berpendapat tidak wajib mengeluarkan zakat pada barang tambang seperti besi, tembaga, timah, kristal, batubara, fairuz, zamrud dan zabarjad. Akan tetapi, Mazhab Syafi’i mewajibkan zakat kepada emas dan perak saja. Mazhab Hambali berpendapat besaran zakat untuk batu akik yaitu 20 mitsqal emas (85 gram) sama seperti dengan zakat emas. Kata Kunci: Zakat, Batu Akik, Mazhab. ABSTRACT Every wealth that has reached Nishab is obligatory to be zakat. Agate stones are one of the commodities that have a relatively high price, and their owners should pay zakat on agate stones as zakat maal. However, according to Islamic jurisprudence, stones are not obligatory to be given zakat. As for the scholars of the schools of thought, they have differing opinions on the zakat of agate according to the four schools. The formulation of the problem in this research is how the method of istinbath hukum (legal reasoning) by the Ulama Mazhab regarding zakat on agate stones? And what are the similarities and differences in the opinions of the Mazhab scholars regarding the zakat on agate stones? The purpose of this research is to understand the methods of legal reasoning (istinbath) of the Mazhab scholars related to the determination of zakat on agate stones and to identify the similarities and differences in opinions about zakat on agate stones according to the Mazhab scholars. This research is a library study, with a descriptive comparative analysis approach, regarding the views of the four schools of thought on the zakat of agate stones, and it is analyzed to find the reasons behind the differing views among these four schools. This research uses data collection techniques through library research, which involves gathering research data by reading and reviewing various sources such as books, magazines, and other reading materials to address issues related to this research, namely the views of the four schools of thought on the zakat of agate stones, and to find the reasons behind the differing views among these four schools. The research results show that according to the Maliki school of thought, mining products are divided into two parts. First, those obtained through heavy effort, which have been agreed upon to be subject only to regular zakat. Second, those obtained without heavy effort. In this case, the Maliki school does not have a definitive opinion. The Maliki school states that the zakat amount is 2.5%, the same as the zakat on money. According to the Hanafi school, zakat is only obligatory on solid minerals that can melt and form using fire, with the zakat amount being one-fifth or 2.5%. The Shafi'i school believes that zakat is not obligatory on minerals such as iron, copper, tin, crystal, coal, fairuz, emerald, and zabarjad. However, the Shafi'i school mandates zakat only on gold and silver. The Hanbali school holds that the zakat amount for agate is 20 mitsqal of gold (85 grams), the same as for gold zakat.
