Abstract

ABSTRAK Kabupaten Pesisir Barat merupakan jalan lintas Sumatera bagian Barat. Oleh sebab itu, banyak kendaraan yang bermuatan lebih. Akibat pembebanan muatan yang berlebih menjadikan jalan tidak terpelihara, dengan kerusakan jalan yang hancur sebelum umur teknis jalan tersebut tercapai dan ini pada akhirnya mengganggu seluruh jaringan jalan yang ada di jalan lintas Kabupaten Pesisir Barat. Berdasarkan latar belakang di atas peneliti tertarik untuk melakukan penelitian dengan judul “Tinjauan Fiqh Siyasah Terhadap Peran Dinas Perhubungan Dalam Implementasi Pasal 2 Peraturan Daerah Provinsi Lampung Nomor 5 Tahun 2011 Tentang Pengawasan Dan Pengendalian Kelebihan Muatan Angkutan Barang (Studi di Dinas Perhubungan Kabupaten Pesisir Barat).” Rumusan masalah dalam penelitian ini adalah (1) Bagaimana peran Dinas Perhubungan Kabupaten Pesisir Barat dalam implementasi Pasal 2 Peraturan Daerah Provinsi Lampung Nomor 5 Tahun 2011 Tentang Pengawasan Dan Pengendalian Kelebihan Muatan Angkutan Barang? (2) Bagaimana tinjauan fiqh siyasah terhadap peran Dinas Perhubungan Kabupaten Pesisir Barat dalam implementasi Pasal 2 Peraturan Daerah Provinsi Lampung Nomor 5 Tahun 2011 Tentang Pengawasan Dan Pengendalian Kelebihan Muatan Angkutan Barang? Jenis penelitian ini adalah penelitian lapangan (field research). Adapun yang menjadi informan sebagai sumber data primer dalam penelitian ini adalah 5 orang yaitu 2 orang Staff Dinas Perhubungan Kabupaten Pesisir Barat dan 3 orang sopir yang melintasi jalan lintas Kabupaten Pesisir Barat. Hasil penelitian mengemukakan bahwa Peran Dinas Perhubungan Kabupaten Pesisir Barat Dalam Implementasi Pasal 2 Peraturan Daerah Provinsi Lampung Nomor 5 Tahun 2011 Tentang Pengawasan Dan Pengendalian Kelebihan Muatan Angkutan Barang yaitu melakukan pemantauan dan evaluasi serta melakukan pelaksanaan uji kelayakan kendaraan. Namun pada pelaksanaannya belum maksimal dikarenakan evaluasi terhadap pengawasan hanya melalui pemantauan dari pos pengawasan sebagai kegiatan dan tidak melakukan penjagaan jalan sesuai dengan aturan yang ditetapkan seperti melakukan penjagaan tanpa rambu-rambu lalu lintas sebagai sarana dan prasaran yang telah disediakan dan masih terdapat juga petugas yang tidak mengidentifikasi kewajiban-kewajiban pengendara yang harus dilengkapi. Sehingga masih banyak sopir truk muatan berat yang tidak mematuhi peraturan yang berlaku. Tinjauan fiqh siyasah terhadap peran Dinas Perhubungan Kabupaten Pesisir Barat dalam implementasi Pasal 2 Peraturan Daerah Provinsi Lampung Nomor 5 Tahun 2011 Tentang Pengawasan Dan Pengendalian Kelebihan Muatan Angkutan Barang belum sesuai dengan fiqh siyasah. Hal ini Dinas Perhubungan Kabupaten Pesisir Barat dikarenakan kurangnya petugas pada pos pengawasan kendaraan muatan berat dan masih ditemukan pos pengawasan yang kosong, akibatnya masih ada kendaraan truk yang tidak mematuhi kewajiban penggunaan jalan dan terpantau. Dalam Islam, kebijakan dan peraturan perundang-undangan yang ditetapkan oleh penguasa tersebut wajib dipatuhi dan diikuti. Hal ini sesuai dengan firman Allah dalam QS An-Nisa ayat 59. Kata kunci : Fiqh Siyasah, Peran Dinas Perhubungan, Peraturan Daerah. ABSTRACT Pesisir Barat Regency is a highway to the western part of Sumatra. Therefore, many vehicles are overloaded. As a result of excessive loading, the road is not maintained, with damage to the road which is destroyed before the technical life of the road is reached and this ultimately disrupts the entire road network on the West Pesisir Regency route. Based on the above background the researcher is interested in conducting research with the title "Overview "Fiqh Siyasah on the Role of the Transportation Service in Implementing Article 2 of Lampung Province Regional Regulation Number 5 of 2011 concerning Supervision and Control of Overloading of Goods Transport (Study at the West Pesisir Regency Transportation Service)." The formulation of the problem in this research is (1) What is the role of the West Pesisir Regency Transportation Service in implementing Article 2 of Lampung Province Regional Regulation Number 5 of 2011 concerning Supervision and Control of Overloading of Goods Transport? (2) What is the fiqh siyasah review of the role of the West Pesisir Regency Transportation Service in implementing Article 2 of Lampung Province Regional Regulation Number 5 of 2011 concerning Supervision and Control of Overloading of Goods Transport? This type of research is field research. The informants as primary data sources in this research were 5 people, namely 2 staff from the West Pesisir Regency Transportation Service and 3 drivers who crossed the West Pesisir Regency highway. The results of the research show that the role of the West Pesisir Regency Transportation Service in implementing Article 2 of Lampung Province Regional Regulation Number 5 of 2011 concerning Supervision and Control of Overloading of Goods Transport is to carry out monitoring and evaluation as well as carrying out vehicle fitness tests. However, the implementation is not optimal because the evaluation of supervision is only through monitoring from monitoring posts as an activity and not carrying out road guarding in accordance with established rules such as carrying out guarding without traffic signs as the facilities and infrastructure that have been provided and there are still officers who do not Identify the driver's obligations that must be completed. So there are still many heavy truck drivers who do not comply with applicable regulations. The siyasah fiqh review of the role of the West Pesisir Regency Transportation Service in implementing Article 2 of Lampung Province Regional Regulation Number 5 of 2011 concerning Supervision and Control of Overloading of Goods Transport is not in accordance with siyasah fiqh. This is because the West Pesisir Regency Transportation Service is due to a lack of officers at heavy load vehicle monitoring posts and empty monitoring posts are still found, as a result there are still trucks that do not comply with road use obligations and are monitored. In Islam, the policies and laws and regulations set by the authorities must be obeyed and followed. This is in accordance with the word of Allah in QS An-Nisa verse 59.
