Abstract

ABSTRAK Badan Usaha Milik Daerah dapat berupa toko/kios, los dan tenda yang dimiliki/dikelola oleh pedagang kecil dan menengah, swadaya masyarakat atau koperasi serta UMK-M dengan proses jual beli barang melalui tawar menawar. Lokasi dan jarak pendirian Toko Swalayan dengan Pasar Rakyat minimal 250 meter diatur dalam Pasal 7 Peraturan Daerah Kota Bandar Lampung Nomor 3 Tahun 2022 Tentang Pengelolaan Pasar Rakyat, Pusat Perbelanjaan dan Toko Swalayan. Pasar Untung Suropati dan Pasar Tugu merupakan pasar yang berada di Kota Bandar Lampung. Terdapat Toko Swalayan yang berbentuk minimarket jaraknya tidak sampai 250 meter dari Pasar Untung Suropati dan Pasar Tugu, tentu hal ini tidak sesuai dengan peraturan yang telah dibuat oleh pemerintah. Rumusan masalah dalam penelitian ini adalah Bagaimana Implementasi Pasal 7 Peraturan Daerah Kota Bandar Lampung Nomor 3 Tahun 2022 Tentang Pengelolaan Pasar Rakyat, Pusat Perbelanjaan dan Toko Swalayan oleh Dinas Perdagangan Kota Bandar Lampung? dan Bagaimana Tinjauan Fiqh Siyāsah Terhadap Implementasi Pasal 7 Peraturan Daerah Kota Bandar Lampung Nomor 3 Tahun 2022 Tentang Pengelolaan Pasar Rakyat, Pusat Perbelanjaan dan Toko Swalayan oleh Dinas Perdagangan Kota Bandar Lampung? Metode penelitian yang digunakan dalam penelitian ini dengan jenis penelitian lapangan (field research) dan bersifat deskriptif analis. Teori yang digunakan dalam penelitian ini adalah teori Siyāsah Tanfidziyah. Data primer yang diperoleh melalui observasi, wawancara dan dokumentasi dilengkapi dengan data sekunder melalui kepustakaan yang meliputi buku, peraturan, jurnal, dokumen, penelitian terdahulu yang relevan dan lain-lain. Hasil penelitian ini menunjukan bahwa implementasi Pasal 7 Peraturan Daerah Kota Bandar Lampung Nomor 3 Tahun 2022 Tentang Pengelolaan Pasar Rakyat, Pusat Perbelanjaan dan Toko Swalayan oleh Dinas Perdagangan Kota Bandar Lampung belum sepenuhnya terealisasikan dengan baik, karena masih ada pendirian Toko Swalayan yang jaraknya kurang dari 250 meter dari lokasi Pasar Rakyat. Adapun Tinjauan Fiqh Siyāsah Terhadap Implementasi Pasal 7 Peraturan Daerah Kota Bandar Lampung Nomor 3 Tahun 2022 Tentang Pengelolaan Pasar Rakyat, Pusat Perbelanjaan dan Toko Swalayan oleh Dinas Perdagangan Kota Bandar Lampung. Dalam pelaksanaannya Dinas Perdangan Kota Bandar Lampung belum sesuai dengan prinsip-prinsip Fiqh Siyāsah dimana Dinas Perdangangan Kota Bandar Lampung sebagai pengelola dalam melaksanakan tugas dan wewenangnya di Kota Bandar Lampung belum memenuhi prinsip pemimpin yang amanah, prinsip pemimpin sebagai penegak keadilan dan prinsip musyawarah. Kata kunci : Peraturan Daerah, Pasar Rakyat, Toko Swalayan, Fiqh Siyāsah. ABSTRACT Regionally Owned Enterprises can be shops/kiosks, kiosks and tents owned/managed by small and medium traders, non-governmental organizations or cooperatives as well as MSMEs with a process of buying and selling goods through bargaining. The location and distance between a supermarket and a people's market of at least 250 meters is regulated in Article 7 of Bandar Lampung City Regional Regulation Number 3 of 2022 concerning Management of People's Markets, Shopping Centers and Supermarkets. Untung Suropati Market and Tugu Market are markets in Bandar Lampung City. There is a supermarket in the form of a minimarket less than 250 meters from Untung Suropati Market and Tugu Market, of course this is not in accordance with the regulations made by the government. The problem formulation in this research is How is the Implementation of Article 7 of Bandar Lampung City Regional Regulation Number 3 of 2022 concerning the Management of People's Markets, Shopping Centers and Self-service shops by the Bandar Lampung City Trade Office? and What is the Review of Fiqh Siyāsah on the Implementation of Article 7 of Bandar Lampung City Regional Regulation Number 3 of 2022 concerning the Management of People's Markets, Shopping Centers and Self service shops by the Bandar Lampung City Trade Office? The research method used in this study is field research and descriptive analyst. Primary data obtained through observation, interviews and documentation is complemented by secondary data through literature which includes books, regulations, journals, documents, relevant previous research and others. The results of this study show that the implementation of Article 7 of Bandar Lampung City Regional Regulation Number 3 of 2022 concerning the Management of People's Markets, Shopping Centers and Self-service shops by the Bandar Lampung City Trade Office has not been fully realized, because there are still the establishment of Supermarkets that are less than 250 meters away from the location of the People's Market. The review of Fiqh Siyāsah Tanfidziyah on the implementation of Article 7 of Bandar Lampung City Regional Regulation Number 3 of 2022 concerning the Management of People's Markets, Shopping Centers and Self-service shops. In its implementation, the Bandar Lampung City Trade Office has not been in accordance with Islamic law and the principles of Fiqh Siyāsah where the Bandar Lampung City Trade Office as the manager, in carrying out its duties and authorities in the city of Bandar Lampung, has not fulfilled the principle of trusted power, the principle of leaders as enforcers of justice and the principle of deliberation.
