Abstract

ABSTRAK Praktik bermu’amalah tentu adanya rukun dan syarat yang telah ditentukan oleh Allah Swt. supaya tidak ada yang menzalimi sesama umat-Nya. Menurut para ulama, menjual induk hewan atau anaknya dalam kondisi anaknya masih menyusui sehingga terpaksa harus dipisah, hukumnya adalah haram dan batal akadnya. Tetapi, pada kenyataanya terdapat transaksi jual beli sapi betina yang masih menyusui dan memisahkan dengan anaknya yang terjadi di Desa Rukti Basuki Rumbia Lampung Tengah. Rumusan masalah dalam penelitian ini adalah bagaimana praktik jual beli sapi dalam masa menyusui di Desa Rukti Basuki Rumbia? dan Bagaimana tinjauan fikih muamalah tentang prakktik jual beli sapi dalam masa menyusui di Desa Rukti Basuki Rumbia Lampung Tengah? Teori yang digunakan dalam penelitian ini yaitu teori akad jual beli. Jenis penelitian ini adalah penelitian lapangan (field Research) dengan mendatangi langsung lokasi penelitian di Desa Rukti Basuki Rumbia Lampung Tengah. Metode pengumpulan data yang digunakan dalam penelitian ini yaitu wawancara, observasi dan dokumentasi yang diperoleh langsung dari 3 penjual dan 6 pembeli. Data yang telah dikumpulkan selanjutnya dianalisis dengan menggunakan metode analisis kualitatif dengan menggunakan pola berpikir induktif. Berdasarkan hasil penelitian yang telah dilakukan bahwa praktik jual beli sapi dalam masa masih menyusui yang terjadi di Desa Rukti Basuki Rumbia Lampung Tengah ialah dibolehkan. Karena objek berupa induk sapi tersebut dalam kondisi sehat dan dapat hamil kembali. Induk sapi dipisahkan dengan anaknya berumur 4 bulan atau lebih yang sudah layak diberikan susu formula. Sedangkan berdasarkan tinjauan fikih muamalah, praktik jual beli sapi yang masih dalam masa menyusui yang terjadi di Desa Rukti Basuki Rumbia sudah memenuhi rukun dan syarat. Di antara penjual dan pembeli tidak ada unsur keterpaksaan. Selain rukun dan syarat yang sudah terpenuhi, adapun prinsip-prinsip jual beli yang terpenuhi juga dimana barang yang diperjualbelikan halal, saling rela tanpa paksaan, objek nya bermanfaat yaitu menguntungkan penjual dan pembeli, informasi yang diberikan benar dan menyeluruh, serta keadilan terhadap induk sapi dan anak sapi (pedet) yang sudah dipisahkan. ABSTRACT The practice of mu'amalah certainly has harmony and conditions that have been determined by Allah SWT. so that no one will wrong his fellow people. According to the ulama, selling a mother animal or its calf while the calf is still breastfeeding and has to be separated is haram and the contract is void. However, in reality there are buying and selling transactions of female cows that are still breastfeeding and separated from their calves that occur in Rukti Basuki Village, Rumbia, Central Lampung. The formulation of the problem in this research is what is the practice of buying and selling cows during the lactation period in Rukti Basuki Rumbia Village? and What is the muamalah fiqh review of the practice of buying and selling cows during the lactation period in Rukti Basuki Village, Rumbia, Central Lampung? The theory used in this study is the theory of the sale and purchase agreement. This type of research is field research by visiting the research location directly in Rukti Basuki Rumbia Village, Central Lampung. The data collection methods used in this study were interviews, observations and documentation obtained directly from 3 sellers and 6 buyers. The data that has been collected was then analyzed using a qualitative analysis method using an inductive thinking pattern. Based on the results of the research that has been conducted, the practice of buying and selling cows while they are still breastfeeding that occurred in Rukti Basuki Rumbia Village, Central Lampung is permissible. Because the object in the form of a mother cow is in a healthy condition and can get pregnant again. The mother cow is also separated from her child aged 4 months or more which is worthy of being given formula milk. Meanwhile, based on the review of muamalah fiqh, the practice of buying and selling cows that are still breastfeeding that occurred in Rukti Basuki Rumbia Village has fulfilled the pillars and requirements. There is no element of coercion between the seller and the buyer. In addition to the pillars and requirements that have been fulfilled, there are also principles of buying and selling that are fulfilled where the goods traded are halal, mutually willing without coercion, the object is beneficial, namely benefiting the seller and buyer, the information provided is correct and comprehensive, and applies justice to the mother cow and calf (calf) that have been separated.
