Abstract

ABSTRAK Pasal 12 huruf G Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan mengemukakan salah satu peran Satlantas adalah menyelenggarakan pendidikan berlalu lintas. Diketahui Bahwa di Kecamatan Kebun Tebu Kabupaten Lampung Barat masih banyak masyarakat yang tidak mematuhi peraturan dalam berlalu lintas. Banyak anak dibawah umur yang diberi kepercayaan oleh orangtuanya untuk mengendarai motor. Berdasarkan latar belakang di atas peneliti tertarik untuk melakukan penelitian dengan judul “Implementasi Pasal 12 Undang-Undang Nomor 22 Tahun 2009 Tentang Lalu Lintas dan Angkutan Jalan Perspektif Fiqh Siyāsah Tanfiżiyah (Studi di Kecamatan Kebun Tebu Kabupaten Lampung Barat)”. Penelitian ini termasuk penelitian lapangan (field research) dengan sifat deskriptif. Informan dalam penelitian ini sebanyak 8 orang yaitu 1 orang Peratin, 2 orang polisi lalu lintas dan 5 orang masyarakat Kecamatan Kebun Tebu Kabupaten Lampung Barat. Teknik pengumpulan data dengan wawancara, observasi, dan dokumentasi. Hasil penelitian mengemukakan bahwa implementasi Pasal 12 Huruf G Undang-Undang Nomor 22 Tahun 2009 Tentang Lalu Lintas dan Angkutan Jalan di Kecamatan Kebun Tebu Kabupaten Lampung Barat belum maksimal dilakukan. Pihak Kepolisian Satuan Lalu Lintas belum melakukan penyuluhan dan sosialisasi untuk menanggulangi pelanggaran lalu lintas yang dilakukan oleh Masyarakat. Implementasi Pasal 12 Huruf G Undang-Undang Nomor 22 Tahun 2009 Tentang Lalu Lintas dan Angkutan Jalan di Kecamatan Kebun Tebu Kabupaten Lampung Barat tidak sesuai dengan prinsip siyāsah tanfiżiyah. Pihak kepolisian hanya melakukan upaya respensif dalam bentuk penilangan, penyitaan dan teguran dilakukan kepada masyarakat yang melanggar lalu lintas. Dalam Islam, kebijakan dan peraturan perundang-undangan yang ditetapkan oleh penguasa tersebut wajib dipatuhi dan diikuti sesuai dengan firman Allah dalam QS An-Nisā’ ayat 59. Kata Kunci : Undang-Undang, Pendidikan Berlalu Lintas, Fiqh Siyāsah Tanfiżiyah. ABSTRACT Article 12 letter G of Law Number 22 of 2009 concerning Road Traffic and Transportation states that one of the roles of Traffic Police is to provide traffic education. It is known that in Kebun Tebu District, West Lampung Regency, there are still many people who do not obey traffic regulations. Many underage children are trusted by their parents to ride motorbikes. Based on the above background, researchers are interested in conducting research with the title "Implementation of Article 12 of Law Number 22 of 2009 concerning Road Traffic and Transportation from the Fiqh Siyāsah Tanfiżiyah Perspective (Study in Kebun Tebu District, West Lampung Regency)". This research includes field research with a descriptive nature. The informants in this research were 8 people, namely 1 Peratin person, 2 traffic policemen and 5 people from the people of Kebun Tebu District, West Lampung Regency. Data collection techniques using interviews, observation and documentation. The research results show that the implementation of Article 12 Letter G of Law Number 22 of 2009 concerning Road Traffic and Transportation in Kebun Tebu District, West Lampung Regency has not been carried out optimally. The Traffic Police Unit has not carried out outreach and outreach to deal with traffic violations committed by the public. The implementation of Article 12 Letter G of Law Number 22 of 2009 concerning Road Traffic and Transportation in Kebun Tebu District, West Lampung Regency is not in accordance with the principles of siyāsah tanfiżiyah. The police only make responsive efforts in the form of fines, confiscations and warnings to people who violate traffic. In Islam, the policies and laws and regulations set by the authorities must be obeyed and followed in accordance with the word of Allah in QS An-Nisā' verse 59.
