Abstract

ABSTRAK Mahkamah Agung menyatakan keberatan uji materiil atas AD//ART Partai Demokrat kepengurusan Agus Harimurti Yudhoyono (AHY) dari para pemohon tidak dapat diterima. Adapun rumusan masalah dalam penelitian ini yaitu Bagaimana Putusan MA Nomor 39 P/HUM/2021 terkait hak uji materiil AD/ART partai politik dan bagaimana prespektif fiqih siyasah dusturiyyah-nya. Tujuan dalam penelitian ini. Untuk mengetahui bagaimana Putusan MA Nomor 39 P/HUM/2021 terkait hak uji materiil AD/ART partai politik dan presfektif fiqih siyasah terhadap Putusan MA Nomor 39 P/HUM/2021 terkait hak uji materiil AD/ART partai politik. Penelitian ini menggunakan jenis penelitian hukum normatif. Adapun pendekatan yang digunakan dalam menelaah isu hukum skripsi ini adalah pendekatan perundang-undangan dan pendekatan kasus. maka data yang dikumpulkan yaitu Undang-Undang Dasar 1945, Undang-Undang Nomor 3 Tahun 2009 Tentang Mahkamah Agung. Teknik pengumpulan bahan hukum dalam penelitian ini menggunakan model studi kepustakaan. Hasil Penelitian menunjukkan bahwa Mahkamah Agung menolak untuk melakukan pengujian materiil terhadap AD/ART partai politik dalam kasus tersebut. Meskipun permohonan judicial review telah diajukan, Mahkamah Agung menegaskan bahwa AD/ART partai politik bukanlah peraturan perundang-undangan yang dapat diuji materiil di Mahkamah Agung. Dalam konteks fiqh siyāsah dusturiyah, Mahkamah Agung dianggap mirip dengan wilayah al mazalim yang menangani kasus pelanggaran hukum oleh pemerintah terhadap rakyat. Analisis menunjukkan bahwa putusan tersebut mempertimbangkan kemaslahatan yang lebih besar dan didasarkan pada dasar hukum yang jelas. Oleh karena itu, putusan tersebut sesuai dengan ajaran fiqh siyāsah dusturiyah dalam menegakkan keadilan. Kata Kunci: Fiqh Siyasah Dusturiyah, Hak Uji Materil, Mahkamah Agung. ABSTRACT The Supreme Court stated that the petitioners' objection to the judicial review of the bylaws of the Demokrat Party under the management of Agus Harimurti Yudhoyono (AHY) could not be accepted. The formulation of the problem in this study is how the Supreme Court Decision Number 39 P/HUM/2021 related to the right to judicial review of the AD/ART of political parties and how the perspective of fiqih siyasah dusturiyyah. The purpose of this research. To find out how Supreme Court Decision Number 39 P/HUM/2021 related to the right to judicial review of political party bylaws and the perspective of fiqih siyasah on Supreme Court Decision Number 39 P/HUM/2021 related to the right to judicial review of political party bylaws. This research uses normative legal research. The approach used in examining the legal issues of this thesis is a statutory approach and a case approach. then the data collected are the 1945 Constitution, Law Number 3 of 2009 concerning the Supreme Court. The technique of collecting legal materials in this research uses a literature study model. The results showed that the Supreme Court refused to conduct a material review of the bylaws of political parties in the case. Although a judicial review application has been filed, the Supreme Court emphasized that the bylaws of political parties are not laws and regulations that can be materially tested in the Supreme Court. In the context of fiqh siyāsah dusturiyah, the Supreme Court is considered similar to wilayah al mazalim, which handles cases of law violations by the government against the people. The analysis shows that the decision considers the greater good and is based on a clear legal basis. Therefore, the decision is in accordance with the teachings of fiqh siyasah dusturiyah in upholding justice. Keywords: Fiqh Siyasah Dusturiyah, Right to Material Test, Supreme Court.
