Abstract

ABSTRAK Didalam jual beli online juga terdapat fenomena jasa titip beli online atau yang biasa dikenal dengan “jastip”, jasa titip sendiri merupakan sistem kegiatan jual beli yang dilakukan oleh seseorang untuk membelikan sesuatu yang kemudian ditambahkan dengan biaya imbalan atau uang jasa titipnya. Namun dalam pembelian melalui jasa titip online tersebut terkadang masih memiliki kendala atau hambatan yaitu ketidaksesuaian barang yang dibeli. Islam sendiri telah memberikan solusi bagi pihak-pihak yang merasa dirugikan atas barang yang dibeli dalah fiqh muamalah dikenal dengan istilah hak khiyar. Rumusan masalah penelitian ini adalah, Bagaimana praktik hak khiyar dalam jual beli sistem jasa titip online pada akun instagram @narrashop_bdl? Bagaimana tinjauan hukum Islam terhadap praktik hak khiyar dalam jual beli sistem jasa titip online? Jenis penelitian ini adalah penelitian lapangan (field research) yang bertujuan untuk memperoleh data dari lokasi atau lapangan. Analisis data menggunakan metode deskriptif analisis, yaitu untuk mengetahui bagaimana Tinjauan Hukum Islam Terhadap Praktik Hak Khiyar Dalam Jual Beli Sistem Jasa Titip Online di akun Instagram @narrashop_bdl. Berdasarkan hasil penelitian yang telah dilakukan yaitu Penerapan praktik hak khiyar dalam jual beli sistem jasa titip online pada akun instagram @narrashop_bdl dilakukan dengan penitip menghubungi pemilik jasa titip untuk membeli barang kemudian pemilik jasa titip membelikan barang yang diinginkan penitip. Jika terjadi kerusakan pada barang yang dibeli maka pemilik jasa titip akan memberikan ganti rugi dengan syarat penitip harus mempunyai bukti video unboxing barang. Tinjauan hukum Islam terhadap praktik hak khiyar dalam jual beli sistem jasa titip online pada akun instagram @narrashop_bdl sudah sesuai dengan rukun dan syarat jual beli, rukun dan syarat wakalah bil-ujrah serta sudah sesuai dengan syarat dan konsep khiyar yaitu pemilik jasa titip sudah memberikan hak kebebasan memilih sesuai dengan pernyataan Syeikh Wahbah Al-Zuhaily yaitu:”khiyar adalah hak untuk memilih bagi penjual dan pembeli yang melakukan akad jual beli untuk meneruskan atau membatalkan jual beli yang disepakati sesuai dengan kondisi masing-masing pihak yang melakukan akad jual beli”. Kata Kunci: khiyar, Jual Beli, Jasa Titip. ABSTRACT In online buying and selling there is also the phenomenon of online buying and selling services or what is commonly known as "jastip". However, when purchasing through online entrustment services, sometimes there are still problems or obstacles, namely incompatibility of the goods purchased. Islam itself has provided a solution for parties who feel disadvantaged by the goods they purchased in muamalah fiqh, known as khiyar rights. The formulation of the research problem is, How is the practice of khiyar rights in buying and selling the online entrustment service system on the Instagram account @narrashop_bdl? How does Islamic law review the practice of khiyar rights in buying and selling online entrustment services systems? This type of research is field research which aims to obtain data from a location or field. Data analysis uses descriptive analysis methods, namely to find out how Islamic Law Reviews the Practice of Khiyar Rights in Buying and Selling the Online Entrustment Services System on the Instagram account @narrashop_bdl. Based on the results of the research that has been carried out, namely, the application of the right of khiyar practice in the online buying and selling service system on the Instagram account @narrashop_bdl is carried out by the depositor contacting the owner of the entrustment service to buy goods, then the owner of the entrustment service buys the goods that the entruster wants. If there is damage to the goods purchased, the owner of the entrusting service will provide compensation on the condition that the consignor must have video evidence of the unboxing of the goods. Islamic law review of the practice of khiyar rights in buying and selling the online entrustment service system on the Instagram account @narrashop_bdl is in accordance with the pillars and conditions of sale and purchase, the pillars and conditions of wakalah bil-ujrah and is in accordance with the terms and concept of khiyar, namely the owner of the entrustment service has given the rights freedom of choice is in accordance with the statement of Sheikh Wahbah Al-Zuhaily, namely: "khiyar is the right to choose for sellers and buyers who enter into a sale and purchase agreement to continue or cancel the agreed sale and purchase in accordance with the conditions of each party entering into the sale and purchase agreement."
