Abstract

ABSTRAK Hak penyandang disabilitas untuk memperoleh pendidikan telah payungi oleh landasan yuridis yaitu undang-undang no. 4 tahun 1997, bahwa pemerintah menjamin adanya kesempatan yang sama bagi penyandang disabilitas untuk berhak mendapatkan layanan pendidikan. Oleh karena itu perlu adanya layanan untuk membantu penyandang disabilitas agar mudah mengakses pendidikan terutama di perguruan tinggi. Berdasarkan latar belakang di atas peneliti tertarik untuk melakukan penelitian dengan judul “Tinjauan Fiqh Siyasah Tanfidziyah Terhadap Implementasi Undang-undang Nomor 8 Tahun 2016 Tentang Penyandang Disabilitas dalam Pemenuhan Hak Pendidikan (Studi di Universitas Islam Negeri Raden Intan Lampung).” Rumusan masalah dalam penelitian ini adalah (1) Bagaimana implementasi Undang-undang Nomor 8 Tahun 2016 Tentang Penyandang Disabilitas mengenai pemenuhan hak pendidikan penyandang disabilitas di Universitas Islam Negeri Raden Intan Lampung? (2) Bagaimana tinjauan fiqh siyasah tanfidziyah terhadap implementasi pemenuhan hak pendidikan penyandang disabilitas di Universitas Islam Negeri Raden Intan Lampung? Penelitian ini adalah jenis penelitian lapangan (field research). Penelitian ini adalah penelitian yang bersifat deskriptif. Adapun yang menjadi informan sebagai sumber data primer dalam penelitian ini sebanyak 4 orang yaitu Bapak Muhammad Yusuf, S.Pd., selaku Staff Dinas Pendidikan Kota Bandar Lampung, Bapak Prof. Dr. H. Alamsyah, S.Ag., M.Ah., selaku Wakil Rektor 1 Universitas Islam Negeri Raden Intan Lampung, Bapak Mairizal Salehudin Siatan S.E., MM, selaku Kepala bidang perencanaan Universitas Islam Negeri Raden Intan Lampung dan Bapak Nugroho Arif Setiawan, M.Psi., selaku Kepala Lab Psikolog Universitas Islam Negeri Raden Intan Lampung. Teknik pengumpulan data dengan wawancara, observasi, dan dokumentasi. Teknik analisa data dengan reduksi data, display data, dan verifikasi data. Hasil penelitian menyimpulkan bahwa implementasi Pasal 42 ayat 3 Undang-undang Nomor 8 Tahun 2016 Tentang Penyandang Disabilitas mengenai pemenuhan hak pendidikan penyandang disabilitas di Universitas Islam Negeri Raden Intan Lampung belum berjalan dengan baik. Hal ini dibuktikan dari pemberian fasilitas bagi mahasiswa penyandang disabilitas masi belum terpenuhi di Universitas Islam Negeri Raden Intan Lampung. Tinjauan fiqh siyasah tanfidziyah terhadap implementasi pemenuhan hak pendidikan penyandang disabilitas di Universitas Islam Negeri Raden Intan Lampung belum sesuai dengan prinsip fiqh siyasah tanfidziyah. Dalam Islam, pemimpin memiliki kewenangan untuk menjabarkan dan mengaktualisasikan perundangundangan yang telah dirumuskan. Keterbukaan Universitas Islam Negeri Raden Intan Lampung menerima calon mahasiswa dari penyandang disabilitas tidak diimbangi dengan aksesibilitas. Faktanya ketika melihat realitas di lapangan, aksesibilitas bagi mahasiswa penyandang disabilitas di Universitas Islam Negeri Raden Intan Lampung masih belum lengkap, memadai, dan merata. ABSTRACT The right of persons with disabilities to obtain education is covered by a juridical basis, namely Law no. 4 of 1997, that the government guarantees equal opportunities for people with disabilities to have the right to receive educational services. Therefore, there is a need for services to help people with disabilities to easily access education, especially in tertiary institutions. Based on the above background, researchers are interested in conducting research with the title "Review of Fiqh Siyasah Tanfidziyah on the Implementation of Law Number 8 of 2016 concerning Disabled Persons in Fulfilling Educational Rights (Studies at Raden Intan Lampung State Islamic University)." The formulation of the problem in this research is (1) How is the implementation of Law Number 8 of 2016 concerning Persons with Disabilities regarding the educational rights of persons with disabilities at the Raden Intan State Islamic University, Lampung? (2) What is the view of siyasah tanfidziyah fiqh on the implementation of education for people with disabilities at the Raden Intan Lampung State Islamic University? This research is a type of field research (field research). This research is descriptive research. There were 4 informants as primary data sources in this research, namely Mr. Muhammad Yusuf, S.Pd., as Staff of the Bandar Lampung City Education Office, Mr. Prof. Dr. H. Alamsyah, S.Ag., M.Ah. , as Deputy Chancellor 1 of the State Islamic University of Raden Intan Lampung, Mr. Mairizal Salehudin Siatan S.E., MM, as Head of planning of the State Islamic University of Raden Intan Lampung and Mr. Nugroho Arif Setiawan, M.Psi., as Head of the Psychologist Lab of the State Islamic University of Raden Intan Lampung. Data collection techniques using interviews, observation and documentation. Data analysis techniques using data reduction, data display, and data verification. The results of the research concluded that the implementation of Article 42 paragraph 3 of Law Number 8 of 2016 concerning Persons with Disabilities regarding fulfilling the educational rights of persons with disabilities at the Raden Intan Lampung State Islamic University has not gone well. This is proven by the fact that the provision of facilities for students with disabilities is still not fulfilled at the Raden Intan Lampung State Islamic University. The fiqh siyasah tanfidziyah review of the implementation of fulfilling the educational rights of persons with disabilities at the State Islamic University of Raden Intan Lampung is not in accordance with the principles of fiqh siyasah tanfidziyah. In Islam, leaders have the authority to describe and actualize the legislation that has been formulated. The openness of Raden Intan Lampung State Islamic University to accept prospective students with disabilities is not balanced with accessibility. In fact, when looking at the reality on the ground, accessibility for students with disabilities at Raden Intan Lampung State Islamic University is still not complete, adequate and equitable.
